Decree No. 49/2011/ND-CP dated June 21, 2011 of the Government amending, supplementing Decree No. 173/2007/ND-CP dated November 28, 2007 of the Government on the organization and operation of maritime pilotage

THE GOVERNMENT

The Decree No. 49/2011/ND-CP dated June 21, 2011 of the Government amending, supplementing Decree No. 173/2007/ND-CP dated  November 28, 2007 of the Government on the organization and operation of maritime pilotage

Pursuant to the Law on Government Organization dated December 25, 2001;

Pursuant to the Maritime Code dated June 14, 2005;

Pursuant to the Enterprise Law dated November 29, 2005;

At the proposals of the Ministry of Transport,

DECREES:

Article 1. Amending, supplementing Article 11 of the Decree No. 173/2007/ND-CP dated November 28, 2007 of the Government on the organization and operation of maritime pilotage as following:

“Article 11. Financial mechanisms for operation of pilotage companies

1. Pilotage fees constitute a state budget revenue. Pilotage companies will directly charge maritime pilotage.

2. The expense resource for paying maritime pilotage service is taken from maritime pilotage charging resource and supplemented from the state budget.

3. The Ministry of Transport is responsible for building, issuing the economic – technical level of maritime pilotage service and implementing orders on supply of maritime pilotage service in country.

4. The Ministry of Finance chairs and coordinate with the Ministry of Transport in instructing the regime on order on supply of maritime pilotage service, administrative system of charging, paying and using maritime pilotage in accordance with the legal regulations on charges, fees and suitable with the current situation on organization and operation of maritime pilotage.”

Article 2. Implementation effect

This Decree takes effect on September 01, 2011.

Article 3. Implementation responsibility

Ministers, heads of ministerial-level agencies, heads of government-attached agencies and presidents of provincial/municipal Peoples Committees, Director of Vietnam Maritime Department and organizations, individuals shall implement this Decree.
