DECREE
Amending and supplementing a number of articles of the Government’s Decree No. 36/2025/ND-CP of February 25, 2025, defining the functions, tasks, powers and organisational structure of the Government Office[1]
Pursuant to Law No. 63/2025/QH15 on Organisation of the Government;
At the proposal of the Minister-Chairperson of the Government Office;
The Government promulgates the Decree amending and supplementing a number of articles of the Government’s Decree No. 36/2025/ND-CP of February 25, 2025, defining the functions, tasks, powers and organisational structure of the Government Office.
Article 1. To amend and supplement a number of articles of the Government’s Decree No. 36/2025/ND-CP of February 25, 2025, defining the functions, tasks, powers and organisational structure of the Government Office
1. To annul the phrase “control administrative procedures” in Article 1.
2. To annul tasks and powers on control of administrative procedures in Clause 3, Article 2.
3. To annul the phrase “to settle administrative procedures in the electronic environment” in Point dd, Clause 4, Article 2.
4. To amend Clause 8, Article 2 as follows:
“8. To self-examine legal documents, examine documents and dispose of unlawful documents under its competence in accordance with law.”
5. To annul the word “inspection” in Clause 10, Article 2.
6. To amend and supplement Article 3 as follows:
“Article 3. Organisational structure
The organisational structure of the Government Office consists of the following units:
1. The General Affairs Department.
2. The Legal Affairs Department.
3. The Department of General Economics.
4. The Department for Industry.
5. The Department for Agriculture.
6. The Department for Science, Education and Cultural-Social Affairs.
7. The International Relations Department.
8. The Internal Affairs Department.
9. The Department for Civil Service Organisation.
10. The Department for Inspection Monitoring (Department I).
11. The Department for the National Assembly, Localities and Mass Organisations Affairs.
12. The Secretariat-Editorial Department.
13. The Administrative Affairs Department.
14. The Organisation and Personnel Department.
15. The Digital Transformation Agency.
16. The Administration-Finance Agency.
17. The Vietnam Government Portal.
The units within the organisational structure of the Government Office are administrative organisations whose functions, tasks, powers and organisational structures are defined by the Minister-Chairperson of the Government Office.
The Vietnam Government Portal may use the official seal bearing the national emblem.
The Administrative Affairs Department has 3 divisions.
The Minister-Chairperson of the Government Office shall submit the list of public non-business units under the Government Office to the Prime Minister for promulgation.”
Article 2. Transitional provisions
1. The Enterprise Renewal Department may perform its assigned functions and tasks and delegated powers in accordance with current regulations until the Minister-Chairperson of the Government Office promulgates a decision defining the functions, tasks and powers of the Department of General Economics.
2. The Administrative Procedures Control Agency (specified in Clause 16, Article 3 of the Government’s Decree No. 36/2025/ND-CP of February 25, 2025, defining the functions, tasks, powers and organisational structure of the Government Office) may continue performing its assigned functions and tasks and delegated powers in accordance with current regulations until the competent authorities’ decisions defining the functions, tasks and powers of the Digital Transformation Agency under the Government Office and the Administrative Procedures Control Agency under the Ministry of Justice take effect.
Article 3. Effect and implementation responsibilities
1. This Decree takes effect on January 1, 2026.
2. The Minister-Chairperson of the Government Office, ministers, heads of ministerial-level agencies, heads of government-attached agencies, and chairpersons of provincial-level People’s Committee shall implement this Decree.-
