DECREE

Annulling a number of decrees of the Government

Pursuant to Law No. 63/2025/QH15 on Organisation of the Government;

Pursuant to Law No. 64/2025/QH15 on Promulgation of Legal Documents, which is amended and supplemented by Law No. 87/2025/QH15;

At the proposal of the Minister of Justice;

The Government promulgates the Decree annulling a number of decrees of Government.

Article 1. To annul the whole of the following Decrees

1. The Government’s Decree No. 35‑CP of May 27, 1995, placing the National Reserves Department to be under the Government.

2. The Government’s Decree No. 88‑CP of December 14, 1995, on sanctioning of administrative violations in cultural activities and cultural services, and in preventing and combating social evils.

3. The Government’s Decree No. 36-CP of June 19, 1996, amending and supplementing a number of articles of the Regulation promulgated together with Decree No. 87-CP (of December 12, 1995), Decree No. 88-CP (of December 14, 1995) and Decree No. 194-CP (of December 31, 1994) of the Government.

4. The Government’s Decree No. 05/1999/ND-CP of February 3, 1999, on people’s identity cards.

5. The Government’s Decree No. 08/2003/ND-CP of February 10, 2003, on activities of overseas representative missions of the Socialist Republic of Viet Nam serving economic development tasks.

6. The Government’s Decree No. 66/2004/ND-CP of February 19, 2004, on transfer of the State Securities Commission of Vietnam to the Ministry of Finance.

7. The Government’s Decree No. 138/2006/ND-CP of November 15, 2006, detailing the implementation of the Civil Code’s provisions on civil relations involving foreign elements.

8. The Government’s Decree No. 170/2007/ND-CP of November 19, 2007, amending and supplementing a number of articles of the Government’s Decree No. 05/1999/ND-CP of February 3, 1999, on people’s identity cards.

9. The Government’s Decree No. 61/2011/ND-CP of July 26, 2011, amending and supplementing a number of articles of Government’s Decree No. 135/2004/ND-CP of June 10, 2004, on application of the measure of consignment to medical treatment facilities and the operational organisation of medical treatment facilities under the Ordinance on Handling of Administrative Violations, and regimes applicable to minors and persons voluntarily receiving medical treatment.

10. The Government’s Decree No. 97/2011/ND-CP of October 21, 2011, on inspectors and inspection collaborators.

11. The Government’s Decree No. 106/2013/ND-CP of September 17, 2013, amending and supplementing a number of articles of the Government’s Decree No. 05/1999/ND-CP of February 3, 1999, on people’s identity cards, which is amended and supplemented by the Government’s Decree No. 170/2007/ND-CP of November 19, 2007.

12. The Government’s Decree No. 92/2014/ND-CP of October 8, 2014, amending and supplementing Clause 1, Article 16 of the Government’s Decree No. 97/2011/ND-CP of October 21, 2011, on inspectors and inspection collaborators.

13. The Government’s Decree No. 117/2014/ND-CP of December 8, 2014, on commune, ward, and township health organisations.

14. The Government’s Decree No. 33/2015/ND-CP of March 27, 2015, on the implementation of inspection conclusions.

15. The Government’s Decree No. 37/2018/ND-CP of March 10, 2018, providing in detail the implementation of monitoring and educational measures for under-18 offenders who are exempted from penal liability.

16. The Government’s Decree No. 75/2018/ND-CP of May 15, 2018, on the organisation, tasks, powers, uniforms and badges of security guards on board ships.

17. The Government’s Decree No. 29/2022/ND-CP of April 29, 2022, detailing, and providing measures to implement, the National Assembly Standing Committee’s Resolution No. 12/2021/UBTVQH15 of December 30, 2021, permitting the implementation of a number of mechanisms and policies in the health sector for COVID-19 prevention and control.

18. The Government’s Decree No. 145/2025/ND-CP of June 12, 2025, on the determination of powers of two-tier local administrations, and the delegation and decentralisation of powers in the field of rural and urban planning.

Article 2. To annul:

1. Article 3 of the Government’s Decree No. 103/2009/ND-CP of November 6, 2009, promulgating the Regulation on cultural activities and commercial provision of public cultural services, and Article 28 of Regulation on cultural activities and commercial provision of public cultural services promulgated together with Decree No. 103/2009/ND-CP.

2. Articles 6 and 7 of the Government’s Decree No. 22/2023/ND-CP of May 12, 2023, amending and supplementing a number of articles of the Decrees concerning business activities in the field of natural resources and environment.

3. Article 13 of the Government’s Decree No. 35/2023/ND-CP of June 20, 2023, amending and supplementing a number of articles of the Decrees in the fields under the state management by the Ministry of Construction.

4. Article 26 of the Government’s Decree No. 79/2023/ND-CP of November 15, 2023, detailing a number of articles of, and providing measures to implement, the Law on Intellectual Property Law regarding plant variety rights.

5. Clause 3, Article 39 of the Government’s Decree No. 121/2025/ND-CP of June 11, 2025, on the delegation and decentralisation of powers in the fields under the state management by the Ministry of Justice.

6. Article 32 of the Government’s Decree No. 148/2025/ND-CP of June 12, 2025, on the delegation of powers and decentralisation in the field of health.

Article 3. Implementation provisions

1. This Decree takes effect on December 1, 2026.

2. Ministers, heads of ministerial-level agencies, Chairpersons of provincial-level People’s Committees, and related agencies and units shall implement this Decree.-
