Decree 285/2025/ND-CP annulling a number of the Government's Decrees

DECREE

On annulling a number of the Government’s Decrees

Pursuant to the Law on Organization of the Government No. 63/2025/QH15;

Pursuant to the Law on Promulgation of Legal Documents No. 64/2025/QH15, which was amended and supplemented under Law No. 87/2025/QH15;

At the proposal of the Minister of Justice;

The Government hereby promulgates the Decree annulling a number of the Government’s Decrees.

Article 1. Full annulment of Decrees 

To annul the following Decrees in whole:

1. Decree No. 35/2005/ND-CP dated March 17, 2005, of the Government, on the disciplinary handling of cadres and civil servants.

2. Decree No. 105/2006/ND-CP dated September 22, 2006, of the Government, detailing and guiding the implementation of a number of articles of the law on intellectual property on protection of intellectual property rights and on state management of intellectual property.

3. Decree No. 35/2007/ND-CP dated March 08, 2007, of the Government, on banking e-transactions.

4. Decree No. 27/2010/ND-CP dated March 24, 2010, of the Government, prescribing the mobilization of other police forces and commune police to coordinate with the road traffic police in conducting patrol and control activities to ensure road traffic order and safety in necessary circumstances.

5. Decree No. 119/2010/ND-CP dated December 30, 2010, of the Government, amending and supplementing a number of articles the Government’s Decree No. 105/2006/ND-CP of September 22, 2006, detailing and guiding a number of articles of the Law on Intellectual Property regarding protection of intellectual property rights and state management of intellectual property.

6. Decree No. 137/2013/ND-CP dated October 21, 2013, of the Government, detailing a number of articles of the Electricity Law and the Law Amending and Supplementing a Number of Articles of the Electricity Law.

7. Decree No. 04/2015/ND-CP dated January 09, 2015, of the Government, on the implementation of grassroots democracy in the operation of state administrative agencies and public non-business units.

8. Decree No. 63/2020/ND-CP dated June 08, 2020, of the Government, providing regulations on the security industry.

Article 2. Partial annulment of Decrees

To annul the following Decrees in part:

1. To annul Clause 1, Article 12 of Decree No. 65/2017/ND-CP dated May 19, 2017, of the Government, on special policies regarding varieties, capital, and technology in the development of the cultivation and exploitation of medicinal materials.

2. To annul Chapter III of Decree No. 08/2018/ND-CP dated January 15, 2018, of the Government, amending a number of Decrees concerning business investment conditions under the state management of the Ministry of Industry and Trade.

Article 3. Implementation provisions

1. This Decree takes effect from December 30, 2025.

2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, Chairpersons of People's Committees of provinces and cities and concerned units and agencies shall implement this Decree.
