DECREE

Annulling a number of Decrees of the Government^[1]

Pursuant to Law No. 63/2025/QH15 on Organization of the Government;

Pursuant to Law No. 64/2025/QH15 on Promulgation of Legal Documents, which is amended and supplemented by Law No. 87/2025/QH15;

At the proposal of the Minister of Justice;

The Government promulgates the Decree annulling a number of Decrees of the Government.

Article 1. To annul the whole of Decrees

To annul the whole of the following Decrees:

1. The Government’s Decree No. 35/2005/ND-CP of March 17, 2005, on disciplining of cadres and civil servants.

2. The Government’s Decree No. 105/2006/ND-CP of September 22, 2006, detailing and guiding the implementation of a number of articles of the Law on Intellectual Property regarding protection of intellectual property rights and state management of intellectual property.

3. The Government’s Decree No. 35/2007/ND-CP of March 8, 2007, on e-transactions in banking activities.

4. The Government’s Decree No. 27/2010/ND-CP of March 24, 2010, on the mobilization of other police forces and commune Public Security forces to coordinate with road traffic police forces in patrolling and controlling road traffic order and safety when necessary.

5. The Government’s Decree No. 119/2010/ND-CP of December 30, 2010, amending and supplementing a number of articles the Government’s Decree No. 105/2006/ND-CP of September 22, 2006, detailing and guiding the implementation of a number of articles of the Law on Intellectual Property regarding protection of intellectual property rights and state management of intellectual property.

6. The Government’s Decree No. 137/2013/ND-CP of October 21, 2013, detailing the implementation of a number of articles of the Electricity Law and the Law Amending and Supplementing a Number of Articles of the Electricity Law.

7. The Government’s Decree No. 04/2015/ND-CP of January 9, 2015, on the exercise of democracy in the operation of state administrative agencies and public non-business units.

8. The Government’s Decree No. 63/2020/ND-CP of June 8, 2020, on the security industry.

Article 2. To annul part of Decrees

To annul part of the following Decrees:

1. To annul Clause 1, Article 12 of the Government’s Decree No. 65/2017/ND-CP of May 19, 2017, on specific policies on varieties, capital and technology in the development of the growing and exploitation of pharmaceutical materials.

2. To annul Chapter III of the Government’s Decree No. 08/2018/ND-CP of January 15, 2018, amending a number of Decrees concerning business investment conditions falling within the scope of state management by the Ministry of Industry and Trade.

Article 3. Implementation provisions

1. This Decree takes effect on December 30, 2025.

2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees, and related agencies and units shall implement this Decree.-
