DECREE

Defining the functions, tasks, powers and organisational structure of the Office of the Government[1]

 

Pursuant to Law No. 63/2025/QH15 on Organisation of the Government;

At the proposal of the Minister, Chairman of the Office of the Government;

The Government promulgates the Decree defining the functions, tasks, powers and organisational structure of the Office of the Government.

 

Article 1. Position and functions

The Office of the Government is a ministerial-level agency of the Government, and a strategic, critical and confidential advisory body that directly assists the Government and the Prime Minister (including also Deputy Prime Ministers).

The Office of the Government functions to advise on general affairs and coordinate activities in order to assist the Government and the Prime Minister in organising the Government’s general activities, and leading, directing and administering the operation of the Government; performs the function as the general information and communication centre serving the Government’s and the Prime Minister’s leadership, direction and administration and providing information to the pubic; and ensure physical, technical and logistical conditions for the operation of the Government and the Prime Minister.

Article 2. Tasks and powers

The Office of the Government shall perform the tasks and exercise the powers provided in the Law on Organisation of the Government and the Government’s regulations on functions, tasks, powers and organisational structures of ministries and ministerial-level agencies, and the following specific tasks and powers:

 1. Providing advices on general affairs and coordinating activities of the Government:

a/ To assume the prime responsibility for formulating and managing the Government’s working programmes in accordance with law; to monitor and urge ministries, ministerial-level agencies and government-attached agencies (below referred to as ministries and sectors), People’s Committees of provinces and centrally run cities (below referred to as provincial-level People’s Committees), and related agencies and organisations in implementing the Government’s working programmes and working regulations; to summarise, urge, examine and evaluate the practical implementation of such programmes and regulations and results thereof, and report thereto the Government;

b/ To coordinate with ministries, sectors, provincial-level People’s Committees and related agencies and organisations in preparing and finalising schemes, projects and draft legal documents for submission to the Government for consideration and decision in accordance with law;

c/ To assume the prime responsibility for reviewing and providing opinions on the order, procedures, competence and principal contents of to-be-submitted dossiers in accordance with regulations; to summarise divergent opinions of related ministries, sectors and agencies; and to provide general advices on contents of, and giving its independent opinions on, schemes, projects, draft legal documents, and other affairs that are to be submitted to the Government by ministries, sectors, provincial-level People’s Committees and related agencies and organisations;

d/ To assume the prime responsibility for, and coordinate with related ministries, sectors, provincial-level People’s Committees, agencies and organisations in, preparing agendas of the Government’s meetings, conferences and working meetings of the Government and the Standing Board of the Government, and serving these meetings and conferences;

dd/ To advise and assist the Government in working relations with the agencies of the Party, the National Assembly, the National Assembly Standing Committee, the President and the Central Committee of the Vietnam Fatherland Front and central bodies of socio-political organisations, the Supreme People’s Court, and the Supreme People’s Procuracy;

e/ To assume the prime responsibility for formulating schemes, projects and draft legal documents and making reports as assigned by the Government.

2. Providing general advices and coordinating activities of the Prime Minister:

a/ To assume the prime responsibility for formulating and managing the Prime Minister’s working programmes in accordance with law; to monitor, urge, inspect, summarise, evaluate and report on the practical implementation of the Prime Minister’s working programmes and results thereof;

b/ To assume the prime responsibility for reviewing and giving opinions on the order, procedures, competence and principal contents of to-be-submitted dossiers in accordance with regulations; to summarise divergent opinions from related ministries, sectors and agencies; and to provide general advices regarding contents of, and giving its independent opinions on, schemes, projects and draft legal documents, and other affairs that are to be submitted to the Prime Minister by ministries, sectors, provincial-level People’s Committees and related agencies and organisations;

c/ To assume the prime responsibility for, and coordinate with ministries, sectors, provincial-level People’s Committees and related agencies and organisations in, finalising contents, procedures, dossiers and draft documents for submission to the Prime Minister for consideration and decision, for other routine affairs that are to be submitted by ministries, sectors, provincial-level People’s Committees and related agencies and organisations;

d/ To proactively grasp the practical performance of, report and give advices to the Prime Minister on, key tasks requiring focused leadership and direction; and to propose measures for handling and responding to unexpected or emerging matters requiring urgent settlement;

dd/ To act as the focal point in assisting the Government and the Prime Minister in implementing working programmes assigned by the Political Bureau, the Secretariat, the National Assembly, the National Assembly Standing Committee and the Executive Committee of the Government Communist Party of Vietnam (CPV) Organisation;

e/ To assist the Prime Minister in coordinating the implementation of working programmes of the Government and the Prime Minister; and to coordinate activities among the Government members in accordance with working programmes of the Government and the Prime Minister;

g/ To coordinate activities among ministries, sectors and provincial-level People’s Committees in the formulation and implementation of policies and laws and the implementation of working programmes;

h/ To coordinate activities of interdisciplinary coordination organisations, working teams and advisory organisations headed or established by the Prime Minister;

i/ To propose the Government or the Prime Minister to assign ministries, sectors, provincial-level People’s Committees or related agencies and organisations to formulate mechanisms, policies, schemes, projects and draft legal documents for submission to competent authorities for decision; or to proactively study and propose initiatives and new mechanisms and policies for submission to the Government or the Prime Minister for consideration and decision;

k/ In case ministries and related agencies have exchanged opinions but there remains divergent opinions on issues to be submitted to the Government or the Prime Minister, the Office of the Government shall report to and propose the Government or the Prime Minister to consider and decide on, or propose the Prime Minister to chair meetings with leaders of related ministries, sectors, provincial-level People’s Committees, agencies and organisations to consider and decide on, plans on settlement of such issues;

l/ To assume the prime responsibility for, and coordinate with ministries, sectors, provincial-level People’s Committees and related agencies and organisations in, preparing the Government’s or the Prime Minister’s working reports and explanatory reports to be submitted to, and answers to questions of the National Assembly, the National Assembly Standing Committee, the President, competent agencies and the People as directed by the Prime Minister;

m/ To assume the prime responsibility for compiling and editing articles, speeches, press interviews and documents (including also printed documents and video recordings) to serve the Prime Minister’s activities, and prepare reports, documents and other directives according to the Prime Minister’s direction; to review, supplement and finalise them after the Prime Minister delivers speeches or gives opinions; and at the same time organise the permanent archive thereof under the Party’s and State’s regulations;

n/ To organise the monitoring, urging and evaluation of the performance of tasks assigned by the Government or the Prime Minister to ministries, sectors, provincial-level People’s Committees, and related agencies, organisations and individuals; to propose necessary measures to ensure administrative order and discipline in the performance of tasks;

o/ To propose the Prime Minister to evaluate the Government members and chairpersons of provincial-level People’s Committees in their performance of tasks assigned by the Government or the Prime Minister; and to propose measures for handling persons and entities failing to comply with the Government’s working regulations;

p/ To act as the focal point and coordinate with ministries, sectors, provincial-level People’s Committees and related agencies and organisations, in preparing agendas serving the Prime Minister’s meetings, working sessions and working trips to localities and grassroots organisations;

q/ To attend meetings and conferences of ministries, sectors, provincial-level People’s Councils and People’s Committees and related agencies and organisations; to request ministries, sectors, provincial-level People’s Committees and related agencies and organisations to provide relevant documents and data, and report on the performance of tasks assigned by the Government or the Prime Minister; to join interdisciplinary organisations that are headed by the Prime Minister under regulations; to take the initiative in working with ministries, sectors, provincial-level People’s Committees and related agencies and organisations in order to grasp the practical situation for better serving the Government’s and the Prime Minister’s leadership, direction and administration work;

r/ To propose the Prime Minister to form specialised working teams, strategic advisory organisations and councils to advise on and provide recommendations for handling major, important and urgent issues;

s/ To immediately return, clearly stating reasons, dossiers that are incomplete or do not comply with the law-specified order and procedures or regulations or fall beyond the Government’s or the Prime Minister’s handling competence or in which submitters do not clearly propose plans for solution or settlement; and at the same time report thereon to the Prime Minister and notify them to submitting agencies;

t/ To assume the prime responsibility for formulating schemes, projects and draft legal documents and other documents as assigned by the Prime Minister.

3. Performing the function as the general information and communication centre serving the Government’s and the Prime Minister’s leadership, direction and administration

a/ To make daily, periodical, thematic and extraordinary reports under regulations, and other reports as requested by the Government or the Prime Minister;

b/ To receive information on the Government’s and the Prime Minister’s leadership, direction and administration work from ministries, sectors, provincial-level People’s Committees, agencies, organisations and individuals; to take the initiative in monitoring, coordinating and grasping the practical policy implementation in order to promptly give advices to and propose the Government or the Prime Minister to consider and direct the prompt handling of urgent and burning issues of public concern;

c/ To provide Government members, chairpersons of provincial-level People’s Councils and provincial-level People’s Committees, agencies of the Party and the State, and related agencies and organisations with information on the country’s socio-economic development and the Government’s and Prime Minister’s leadership, direction and administration work in accordance with law;

d/ To collect and summarise press information and issues of public concern; to submit daily reports on, give advices to, and propose to the Prime Minister for direction of, issues in need of settlement;

dd/ To organise the monitoring and summarisation of public opinions and prepare periodic and ad-hoc reports on mechanisms and policies; and to give advices and propose measures to the Prime Minister for direction and administration;

e/ To assume the prime responsibility for, and coordinate with ministries, sectors, provincial-level People’s Committees and related agencies and organisations in, developing, managing and operating information systems and databases as assigned by the Government or the Prime Minister; to be connected to, and directly access and use data from, information systems and national and specialised databases; to ensure connection, coordination, integration and sharing of information between the Office of the Government and ministries, sectors and provincial-level People’s Committees; to analyse, forecast and provide information serving the Government’s and the Prime Minister’s leadership, direction and administration work in accordance with law;

g/ To assume the prime responsibility for guiding and urging ministries, sectors and provincial-level People’s Committees to send and receive electronic documents; to observe the reporting regime serving the Government’s and the Prime Minister’s direction and administration work in accordance with law.

4. Providing information to the public

a/ To provide the public with information on major activities and important decisions in the Government’s and the Prime Minister’s leadership, direction and administration work and outstanding economic, political and social events and other information in accordance with law and under the Prime Minister’s direction;

b/ To organise communications about and provide strategic orientations for policy communications concerning the Government’s and the Prime Minister’s leadership, direction and administration work; and to develop and administer multi-platform communication channels and products serving the Government’s and the Prime Minister’s leadership, direction and administration work;

c/ To make statements on behalf of the Government and the Prime Minister;

d/ To assume the prime responsibility for, and coordinate with ministries, sectors, provincial-level People’s Committees and related agencies and organisations in, holding the Government’s press conferences and providing information to the press on a periodical basis or an unscheduled basis; to advise the Prime Minister on media interviews in accordance with law;

dd/ To coordinate with the central information and communications agencies in communicating and providing information on socio-economic development, direction and administration activities, and policy orientations within the ambit of the Government’s and the Prime Minister’s functions and tasks;

e/ To request related agencies and press agencies to correct and revise inaccurate or inappropriate information; to promptly prevent and address false or distorted information; and to act as the focal point for providing official information serving the Government’s and the Prime Minister’s leadership, direction and administration work;

g/ To prepare and issue press releases on the Government’s and Prime Minister’s direction and administration work on a daily basis or an unscheduled basis; to provide standardised information to ministries, sectors, provincial-level People’s Committees and press agencies for use in communications;

h/ To coordinate inter-ministerial and inter-sectoral information to ensure its consistency; to give advices on draft press releases prepared by ministries and sectors that contain important, sensitive or cross-sectoral content relating to the Government’s and the Prime Minister’s direction and administration work;

i/ To perform the state management of Công Báo (the Official Gazette); to manage, publish and distribute Công Báo of the Socialist Republic of Vietnam; to guide and examine provincial-level Công Báo agencies concerning the publication and distribution of electronic Công Báo; to monitor, urge and evaluate, hold periodic review meetings, and carry out preliminary and final reviews of the state management and the implementation of legal provisions on Công Báo; and to manage and operate the electronic Công Báo system;

k/ To manage and operate the Government Portal; and to provide professional guidance on connecting and integrating information with the portals of ministries, sectors and provincial-level People’s Committees.

5. To ensure physical, technical and logistical conditions serving the Government’s and the Prime Minister’s activities under the Party’s and the State’s regulations.

6. To formulate and promulgate legal documents and other documents under its competence in accordance with law.

7. To self-examine legal documents, examine and dispose of unlawful documents under its competence in accordance with law.

8. To receive and promptly process documents submitted by ministries, sectors, provincial-level People’s Committees and related agencies, organisations and individuals to the Executive Committee of the Government CPV Organisation, the Executive Bureau of the Government CPV Committee, the Government  or the Prime Minister in accordance with law and under the Prime Minister’s directions; to distribute and manage documents of the Executive Committee of the Government CPV Organisation, the Executive Bureau of the Government CPV Committee, the Government  or the Prime Minister; to build, manage and operate the electronic document storage system at the Office of the Government in accordance with the regulations on cybersecurity, data security, cipher, protection of state secrete, and relevant laws.

9. To strictly and effectively carry out examination and supervision; to receive citizens and settle complaints and denunciations; to prevent and combat corruption, practice thrift and combat waste in accordance with law.

10. To review and provide professional guidance on clerical work for offices of ministries, sectors and provincial-level People’s Committees.

11. Regarding civil servants

a/ The Office of the Government’s civil servants must possess firm political stance, good ethical qualities and high professional qualifications, and be knowledgeable about the sectors and fields they are assigned to take charge of or supervise; to adopt mechanisms to encourage and protect dynamic and innovative cadres and civil servants who dare to think, dare to act and dare to take responsibility for the common interest; and to adopt specific salary and allowance mechanisms and particular preferential regimes and policies under regulations;

b/ The Office of the Government may enjoy the priority over the transfer, rotation and secondment of civil servants from ministries, sectors, agencies or localities to the Office of the Government and vice versa. Ministries, sectors, agencies and localities shall prioritise the arragement, transfer, rotation and secondment of civil servants or receipt of civil servants on secondment at the request of the Office of the Government.

12. To manage its organisational apparatus and payrolls of civil servants, number of employees and working positions; to decide on the recruitment, employment and management of, and implement other regimes and policies for, its cadres, civil servants and public employees within its competente.

13. To decide on, and organise the implementation of, its programmes and plans on administrative reform, application of information technology, digital transformation, and digital government according to objectives and contents of the general programme on state administrative reform and in accordance with law.

14. To manage finances, assets and other resources assigned to it; to manage scientific research activities; to undertake international cooperation in accordance with law.

15. To perform other tasks and exercise other powers as assigned by the Executive Committee of the Government CPV Organisation, the Government or the Prime Minister or in accordance with law.

Article 3. Organisational structure

The organisational structure of the Office of the Government consists of the following units:

1. The General Affairs Department.

2. The Legal Department.

3. The Department of General Economics.

4. The Department for Industry.

5. The Department for Agriculture.

6. The Department for Science, Education and Cultural-Social Affairs.

7. The International Relations Department.

8. The Internal Affairs Department.

9. The Department for Organisation of Public Duties.

10. The Department for Inspection Monitoring (below referred to as Department I).

11. The Department for the National Assembly, Localities and Mass Organisations Affairs.

12. The Secretariat-Editorial Department.

13. The Administrative Affairs Department.

14. The Personnel and Organisation Department.

15. The Digitial Transformation Directorate.

16. The Administration-Finance Directorate.

17. The Government Information and Communications Authority.

The units within the organisational structure of the Office of the Government are administrative organisations whose functions, tasks, powers and organisational structures are defined by the Minister, Chairman of the Office of the Government.

The Government Information and Communications Authority is a type-1 agency which may use the official seal bearing the national emblem.

The Administrative Affairs Department may have 3 divisions.

The Minister, Chairman of the Office of the Government shall submit the list of public non-business units under the Office of the Government to the Prime Minister for promulgation.

Article 4. Transitional provisions

1. The Vietnam Government Portal (specified in the Government’s Decree defining the functions, tasks, powers and organisational structure of the Office of the Government) may continue to perform its assigned functions, tasks and powers in accordance with current regulations until the Decision defining the functions, tasks, powers and organisational structures of the Government Information and Communications Authority promulgated by the Minister, Chairman of the Office of the Government, takes effect.

Article 5. Effect and implementation responsibility

1. This Decree takes effect on June 1, 2026.

2. This Decree replaces the Government’s Decree No. 36/2025/ND-CP of February 25, 2025, defining the functions, tasks, powers and organisational structure of the Office of the Government, and the Government’s Decree No. 369/2025/ND-CP of December 31, 2025, amending and supplementing a number of articles of Decree No. 36/2025/ND-CP of February 25, 2025.

3. The Minister, Chairman of the Office of the Government, ministers, heads of ministerial-level agencies, heads of government-attached agencies, and chairpersons of provincial-level People’s Committees shall implement this Decree.-
