Decree 114/2026/ND-CP amend Decree 87/2024/ND-CP on sanctioning administrative violations in price field

DECREE

Amending and supplementing a number of articles of the Government's Decree No. 87/2024/ND-CP dated July 12, 2024, on sanctioning of administrative violations in the field of price

Pursuant to the Law on Organization of the Government No. 63/2025/QH15;

Pursuant to the Law No. 15/2012/QH13 on Handling of Administrative Violations, which was amended and supplemented by Law No.  67/2020/QH14 and Law No. 88/2025/QH15;

Pursuant to the Law on Inspection No. 84/2025/QH15;

Pursuant to the Law No. 16/2023/QH15 on Price, which was amended and supplemented by the Law No. 140/2025/QH15;

At the proposal of the Minister of Finance;

The Government promulgates the Decree amending and supplementing a number of articles of the Government's Decree No. 87/2024/ND-CP dated July 12, 2024, on sanctioning of administrative violations in the field of price.

Article 1. Amending and supplementing Article 1

To amend the phrase “specialized inspection of prices, examination of the observance of the laws on price and valuation” to “inspection and examination of price and valuation”.

Article 2. Amending and supplementing Article 3

1. To add Clause 9 as follows:

“9. Handling of administrative violations in the electronic environment for the field of price shall be carried out in accordance with the Law on Handling of Administrative Violations and documents detailing the implementation of the Law on Handling of Administrative Violations; and shall be conducted upon satisfaction of conditions on infrastructure, technical systems, and information.”.

2. To add Clause 10 as follows:

“10. Principles for determination of competence to impose sanctions of administrative violation and to apply remedial measures in price management activities shall be implemented in accordance with the Law on Handling of Administrative Violations and documents detailing the implementation of the Law on Handling of Administrative Violations.”.

3. To add Clause 11 as follows:

“11. In case a Decree on sanctioning of administrative violations in another field of state management contains specific provisions on sanctioning of administrative violations in price that differ from those of this Decree, such Decree on sanctioning of administrative violations in that field of state management shall prevail.”.

Article 3. Amending Point b Clause 2 Article 26

“b) Civil servants, public employees and persons of the People's Public Security force and the People’s Army force who are on public duty or performing their tasks as assigned.”.

Article 4. Amending and supplementing Article 27

“Article 27. Competence of the Inspectorates to impose sanctions of administrative violation

1. Inspectors of ministries, ministerial-level agencies: the Ministry of National Defense, the Ministry of Public Security, the State Bank of Vietnam; inspectors of the Vietnam Maritime Inspectorate; inspectors of the Vietnam Civil Aviation Inspectorate shall have the power to impose sanctions of administrative violation in the field of price as follows: Impose a fine of up to VND 15,000,000.

2. Heads of inspection teams of the agencies: the Vietnam Maritime Inspectorate, the Vietnam Civil Aviation Inspectorate, regional State Bank branches, provincial-level Department of Public Security; heads of inspection teams of military regions and of the Hanoi Capital High Command shall have the power to impose sanctions of administrative violation in the field of price as follows:

a) Impose a fine of up to VND 75,000,000;

b) Apply the remedial measures defined in Clause 7 Article 3 of this Decree.

3. Chief Inspector of the Vietnam Maritime Inspectorate; Chief Inspector of the Vietnam Civil Aviation Inspectorate; Chief Inspectors of National Defence of military regions; Chief Inspector of National Defence of the Hanoi Capital High Command; Chief Inspectors of regional State Bank branches; Chief Inspectors of provincial-level Department of Public Security shall have the power to impose sanctions of administrative violation in the field of price as follows:

a) Impose a fine of up to VND 120,000,000;

b) Impose the additional sanction specified at Point b Clause 1 Article 3 and apply the remedial measures specified in Clause 7 Article 3 of this Decree.

4. Chief Inspectors of ministries, ministerial-level agencies: the Ministry of National Defense, the Ministry of Public Security, the State Bank of Vietnam; heads of inspection teams established by Chief Inspectors of ministries, ministerial-level agencies: the Ministry of National Defense, the Ministry of Public Security, the State Bank of Vietnam shall have the power to impose sanctions of administrative violation in the field of price as follows:

a) Impose a fine of up to VND 150,000,000;

b) Impose the additional sanction specified at Point b Clause 1 Article 3 and apply the remedial measures specified in Clause 7 Article 3 of this Decree.”.

Article 5. Amending and supplementing Article 28

“Article 28. Competence to impose sanctions of administrative violations of heads of agencies performing state management in the field of price

1. Heads of Divisions in charge of crop production, plant protection, animal husbandry, animal health, quality management of agro-forestry-fishery products, irrigation, dykes, and natural disaster prevention and control under provincial-level Departments of Agriculture and Environment; Heads of Divisions of Food Safety; Directors of Regional Radio Frequency Centers; Head of the Northern Maritime and Waterway Branch; Head of the Southern Maritime and Waterway Branch shall have the power to:

a) Impose a fine of up to VND 75,000,000;

b) Impose the additional sanction specified at Point b Clause 1 Article 3 and apply the remedial measures specified in Clause 7 Article 3 of this Decree.

2. Director of the Price Management Department; Director of the Judicial Support Department; Director of the Department of Judicial Administration; Director General of the Department for Roads of Vietnam; Director General of the Vietnam Maritime and Waterway Administration; Director General of the Civil Aviation Authority of Vietnam; Director General of the Vietnam Railway Authority; Director General of the Vietnam Register; Director of the Department of Hydraulic Works Management and Construction; Director General of the Department of Land Administration; Director of the Intellectual Property Office of Vietnam; Director General of the Authority of Radio Frequency Management; Director General of the Vietnam Telecommunications Authority; the Chairperson of the Commission for the Standards, Metrology and Quality of Vietnam; Director of the Vocational Education and Continuing Education Department; Director of the Department of Medical Service Administration; Director General of the Drug Administration of Vietnam; Director General of the Vietnam Food Administration; Director of the Vietnam Population Authority; Director General of the Vietnam Administration of Disease Prevention; Director General of the Industry Agency, Director General of the Electricity Authority; Director General of the Vietnam Chemicals Agency; Director General of the Industrial Safety Techniques and Environment Agency; Director General of the Vietnam E-commerce and Digital Economy Agency; the Chairperson of the Vietnam Competition Commission; Director of the Authority of Press; Director General of the Authority of Broadcasting and Electronic Information; Director of the Authority of Publishing, Printing and Distribution; Director of the Department of Overseas Labour; Director of the Department of Employment; heads of organizations under ministries and ministerial-level agencies assigned to perform inspection tasks within the scope of state management of such ministries and ministerial-level agencies shall have the power to impose sanctions of administrative violation in the field of price as follows:

a) Impose a fine of up to VND 150,000,000;

b) Impose the additional sanction specified at Point b Clause 1 Article 3 and apply the remedial measures specified in Clause 7 Article 3 of this Decree.

3. Heads of inspection teams established by heads of organizations under ministries or ministerial-level agencies performing state management of price and valuation of such ministries or ministerial-level agencies shall have the sanctioning competence specified in Clause 1 of this Article.

Heads of inspection teams established by Ministers or heads of ministerial-level agencies shall have the sanctioning competence specified in Clause 2 of this Article.

4. Chairpersons of People’s Committees of communes, wards and special zones under provinces shall have the power to impose sanctions of administrative violation in the field of price as follows:

a) Impose a fine of up to VND 75,000,000;

b) Impose the additional sanction specified at Point b Clause 1 Article 3 and apply the remedial measures specified in Clause 7 Article 3 of this Decree.

5. Chairpersons of People’s Committees of provinces and centrally-run cities shall have the power to impose sanctions of administrative violation in the field of price as follows:

a) Impose a fine of up to VND 150,000,000;

b) Impose the additional sanction specified at Point b Clause 1 Article 3 and apply the remedial measures specified in Clause 7 Article 3 of this Decree.

6. Directors of provincial-level Departments shall have the power to impose sanctions of administrative violations in the field of price as follows:

a) Impose a fine of up to VND 120,000,000;

b) Impose the additional sanction specified at Point b Clause 1 Article 3 and apply the remedial measures specified in Clause 7 Article 3 of this Decree.”.

Article 6. Amending and supplementing Article 29

“Article 29. Competence of the Market Surveillance Force to impose sanctions of administrative violation

Competent persons of market surveillance agencies shall have the power to impose sanctions of administrative violation as specified in Article 6, Clause 1 Article 7, Article 8, Article 10, Article 11, Article 13, and Article 15 of this Decree, specifically as follows:

1. Market controllers who are on duty shall have the power to impose a fine of up to VND 15,000,000.

2. Heads of market surveillance teams of Market Surveillance Branches under provincial-level Departments of Industry and Trade shall have the power to:

a) Impose a fine of up to VND 45,000,000;

b) Apply the remedial measures specified at Points a, b, c, d, dd, e and t Clause 7 Article 3 of this Decree.

3. Directors of Market Surveillance Branches under provincial-level Departments of Industry and Trade, and heads of market surveillance divisions under the Agency for Domestic Market Surveillance and Development shall have the power to:

a) Impose a fine of up to VND 75,000,000;

b) Apply the remedial measures specified at Points a, b, c, d, dd, e and t Clause 7 Article 3 of this Decree.

4. The Director of the Agency for Domestic Market Surveillance and Development shall have the power to:

a) Impose a fine of up to VND 150,000,000;

b) Apply the remedial measures specified at Points a, b, c, d, dd, e and t Clause 7 Article 3 of this Decree.”.

Article 7. Amending and supplementing Article 30

“Article 30. Competence of administrative violation sanctioning of the People’s Public Security Forces

1. People’s Public Security officers who are on duty shall have the power to impose a fine of up to VND 15,000,000.

2. Heads of company-level mobile police units shall have the power to:

a) Impose a fine of up to VND 30,000,000;

b) Apply the remedial measures defined in Clause 7 Article 3 of this Decree.

3. Chiefs of police stations, heads of battalion-level mobile police units, heads of marine squads, station chiefs and team heads shall have the power to:

a) Impose a fine of up to VND 45,000,000;

b) Impose the additional sanction specified at Point b Clause 1 Article 3 and apply the remedial measures specified in Clause 7 Article 3 of this Decree.

4. Chiefs of commune-level police offices shall have the power to:

a) Impose a fine of up to VND 75,000,000;

b) Impose the additional sanction specified at Point b Clause 1 Article 3 and apply the remedial measures specified in Clause 7 Article 3 of this Decree.

5. Heads of border-gate police offices of international airports; heads of professional divisions of the Department of Homeland Security, including: Head of the General Advisory Division, Head of the Catholic Security Division, Head of the Division for Security of Other Religions, Head of the Ethnic Minority Security Division, Head of Anti-Subversion Division, Head of Counter-Terrorism Division, Head of the Social Security Division; heads of professional divisions of the Internal Political Security Department, including: Head of the Division for Internal Protection of Central-level Party Agencies and State Authorities, Head of the Division for Security of Judiciary, Legislative bodies, and Central-level Socio-Political Organizations, Head of the Press and Publication Security Division, Head of the Health and Education Security Division, Head of the Culture, Sports, and Social Affairs Security Division, Head of the Posts, Telecommunications, and Information Technology Security Division; Head of the Division for State Management of State Secrets Protection; Heads of professional divisions of the Economic Security Department, including: Head of the Industry and Trade Security Division, Head of the Monetary Security Division, Head of the Transport and Construction Security Division, Head of the Finance and Investment Security Division, Head of the Agriculture, Forestry, and Fishery Security Division, Head of the Science, Technology, and Resources and Environment Security Division; Heads of professional divisions under the Police Department for Investigation of Drug-Related Crimes, including: Head of the Division for Prevention and Investigation of Crimes related to Illegal Trading and Transportation of Narcotic Substances, Head of the Division for Prevention and Investigation of Crimes in the Field of Organizing and Harboring for Illegal Use of Narcotic Substances, Head of the Division for Prevention and Investigation of Crimes related to Illegal Production of Narcotic Substances, Head of the Division for Prevention and Investigation of Crimes in Legal Drug-related Activities; Heads of professional divisions under the Police Department for Administrative Management of Social Order, including: heads of Divisions for Guidance and Management of Weapons, Explosive Materials, Support Tools, and Firecrackers, heads of Divisions for Guidance and Management of Sectors and Trades Subject to Conditional Business Investment Related to Security and Order and Seals, Director of the National Population Data Center; heads of professional divisions of the Traffic Police Department, including: Head of the Division for Guidance on Communications, Investigation, and Handling of Traffic Accidents, Head of the Division for Guidance, Registration, and Inspection of Vehicles, Head of the Division for Guidance, Training, Testing, and Management of Driving Licenses, Head of the Division for Guidance on Patrol and Control of Road and Railway Traffic, Head of the Division for Guidance on Traffic Control and Escort, Head of the Division for Guidance on Patrol, Control, and Crime Prevention on Inland Waterways, Commanders of Waterway Police Squadrons; Heads of professional divisions under the Fire and Rescue Police Department, including: Head of the Fire Prevention Division, Head of the Fire Safety Appraisal and Approval Division, Head of the Division for Firefighting, Rescue and Salvage, Head of the Division for Science and Technology Management and Inspection of Equipment for Fire Prevention, Firefighting, Rescue and Salvage; Heads of professional divisions under the Department of Cybersecurity and High-Tech Crimes, including:  Head of the Division for Prevention and Control of Crimes using Cyberspace to undermine Economic Management Order, Head of the Division for Prevention and Control of Crimes using Cyberspace to undermine Social Order, Head of the Cyberinformation Security Division, Head of the Division for Protection of National Information Network System Security, Head of the Division for Cyberinformation Surveillance and Prevention of Activities using Cyberspace to undermine National Security; Heads of professional divisions under the Immigration Department, including: Heads of Divisions for Management of Entry, Exit, and Residence of Foreigners, Heads of Divisions for Management of Exit and Entry of Vietnamese Citizens, Director of the National Aviation Security Center; Heads of professional divisions under the National Data Center, including:  Head of the General Advisory Division, Head of the Application Administration Division, Head of the Data Administration Division, Head of the System Security and Safety Division, Head of the IT System Administration and Operation Division, Head of the Data Center Infrastructure Administration and Operation Division; Heads of professional divisions under the Department of Professional Records and Archives, including: Director of the Professional Information and Data Center of the Ministry of Public Security, Director of the Professional Information Reception and Processing Center, Head of the Informatics and Professional Records Database Management Division; Heads of regiment-level Mobile Police units; Heads of Divisions under provincial-level Police Departments, including:  Heads of the Homeland Security Divisions, Heads of the Internal Political Security Divisions, Heads of the Police Divisions for Administrative Management of Social Order, Head of the Police Divisions for Investigation of Social Order-related Crimes, Heads of the Police Divisions for Investigation of Corruption, Economic, Smuggling, and Environmental Crimes, Heads of the Police Divisions for Investigation of Drug-related Crimes, Heads of the Traffic Police Divisions, Heads of the Mobile Police Divisions, Heads of the Police Divisions for Execution of Criminal Judgments and Judicial Support, Heads of the Fire and Rescue Police Divisions, Heads of the Cybersecurity and High-Tech Crime Divisions, Heads of the Economic Security Divisions, Heads of the External Security Divisions, Head of the Divisions of Professional Records and Archives, Chiefs of the Offices of the provincial-level Investigation Police Agencies, and Head of the Immigration Department under provincial-level Police Departments shall have the power to:

a) Impose a fine of up to VND 120,000,000;

b) Impose the additional sanction specified at Point b Clause 1 Article 3 and apply the remedial measures specified in Clause 7 Article 3 of this Decree.

6. Directors of provincial-level Public Security Departments shall have the power to:

a) Impose a fine of up to VND 150,000,000;

b) Impose the additional sanction specified at Point b Clause 1 Article 3 and apply the remedial measures specified in Clause 7 Article 3 of this Decree.

7. The Director of the Internal Political Security Department, Director of the Economic Security Department, Chief of the Office of the Investigation Police Agency under the Ministry of Public Security, Director of the Police Department for Administrative Management of Social Order, Director of the Police Department of Social Order-related Crime Investigation, Director of the Police Department for Investigation of Corruption, Economic and Smuggling Crimes, Director of the Police Department for Drug-Related Crimes, Director of the Traffic Police Department, Director of the Fire and Rescue Police Department, Director of the Environmental Crime Prevention and Combat Police Department, Director of the Department of Cybersecurity and Hi-Tech Crime Prevention and Combat, Director of the Department of Homeland Security, Director of the Police Department for Custody, Temporary Detention and of Criminal Judgment Execution in the Community, Commander of the Mobile Police Department, Director of the National Data Center, and Director of the Department of Professional Records and Archives shall have the power to:

a) Impose a fine of up to VND 150,000,000;

b) Impose the additional sanction specified at Point b Clause 1 Article 3 and apply the remedial measures specified in Clause 7 Article 3 of this Decree.”.

Article 8. Implementation provisions

1. This Decree takes effect on May 20, 2026.

2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of People’s Committees of provinces and centrally-run cities, and related organizations and individuals shall implement this Decree./.
