DECREE
PRESCRIBING THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE GENERAL DEPARTMENT OF STATISTICS
THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decree No. 30/2003/ND-CP dated April 1, 2003 of the Government prescribing the functions, tasks, powers and organizational structures of the Government-attached agencies;
At the proposals of the General Director of Statistics and the Minister of the Interior,
DECREES:
Article 1. Position and functions
The General Department of Statistics is a Government-attached agency, which performs several tasks and exercises several powers of State management over statistics; organizes statistical activities and provides socio-economic statistical information to agencies, organizations and individuals according to law provisions; performs the State management over public services and performs some specific tasks and exercises some specific powers in representing the owner of the State capital portions at State-invested enterprises under its management as prescribed by law.
Article 2. Tasks and powers
The General Department of Statistics shall have to perform the tasks and exercise the powers of the Government-attached agencies performing the State management over branches and domains as defined in the Government's Decree No. 30/2003/ND-CP dated April 1, 2003 prescribing the functions, tasks, powers and organizational structures of the Government-attached agencies as well as the following specific tasks and powers:
1. To assume the prime responsibility or participate in the elaboration of bills, draft ordinances and other legal documents on statistics as assigned by the Government or the Prime Minister.
2. To submit to the Government or the Prime Minister strategies, plannings, long-term, five-year and annual plans on statistics as well as its important projects.
3. To submit to the Government for prescription the regulations on the competence to issue statistical classification indexes (except for statistical classification indexes of the court and procuracy sectors).
4. To submit to the Prime Minister for promulgation the system of national statistical norms, the basic statistical report regime and synthetic statistical report regime, long-term and annual programs on national statistical surveys and general statistical surveys as prescribed by law. .
5. To submit to the minister assigned by the Prime Minister to sign for promulgation legal documents on statistics according to law provisions.
6. To direct, inspect and be answerable for the implementation of legal documents, strategies, plannings, programs and plans on statistics as well as the system of national statistical norms after they are approved; to propagate, disseminate and educate statistical legislation and information.
7. To provide the ministries, the ministerial-level agencies, the agencies attached to the Government, the People's Supreme Court, the People's Supreme Procuracy and the provincial/municipal People's Committees with professional direction and guidance on statistical reports, statistical surveys and statistical classification, which falls under its competence.
8. To conduct professional expertise of the reporting regimes and methods of statistical surveys of the ministries, the ministerial-level agencies, the agencies attached to the Government, the People's Supreme Court, the People's Supreme Procuracy and the provincial/municipal People's Committees.
9. To collect socio-economic statistical information, build and manage the national database on socio-economic statistical information according to law provisions.
10. To report to the Government or the Prime Minister the monthly, quarterly and annual synthetic statistics on socio-economic situation, the implementation of national target programs and the extents of fulfillment of the norms of the State's plans; and the reports analyzing and forecasting the annual socio-economic development situation.
11. To assist the Government in performing the uniform management over the publicization of socio-economic statistical information according to law provisions.
12. To publicize statistical information belonging to the system of national statistical norms; to provide socio-economic statistical information to agencies, organizations and individuals according to law provisions; to be answerable for the reliability of the publicized and supplied data and information.
13. To compile and publish the statistical yearbooks and other statistical products of the Socialist Republic of Vietnam as well as foreign statistical data; to make the international comparison on statistics.
14. To manage construction and investment projects under its competence according to law provisions.
15. To enter into international cooperation in the field of statistics according to law provisions.
16. To organize and direct the implementation of plans on statistical research and the application of scientific and technological advances to the system of concentrated statistical organizations.
17. To decide on undertakings and measures and direct the operation of public services within the system of concentrated statistical organizations according to law provisions; to manage and direct the operation of non-business organizations under its management.
18. To perform some specific tasks and exercise some specific powers in representing the owner of the State capital portions at State-invested enterprises under its management as prescribed by law.
19. To inspect, examine and settle complaints and denunciations, to combat corruption and negative acts and handle violations on statistics according to its competence.
20. To decide on, and direct the implementation of, its administrative reform program according to the objectives and contents of the State's administrative reform program already approved by the Prime Minister.
21. To manage its organizational apparatus and payroll; to direct the implementation of wage regime as well as regimes and policies on preferential treatment, commendation, reward and disciplines toward the State officials and employees under its management; to provide professional training and fostering on statistics to officials and employees under its management.
22. To manage the assigned finance and properties and organize the implementation of allocated budget according to law provisions.
Article 3. Organizational system of the General Department of Statistics
The General Department of Statistics is organized according to hierarchical system, including:
1. At the central level, the General Department of Statistics;
2. In the provinces and centrally-run cities, there are the Statistics Departments under the General Department of Statistics;
3. In the rural and urban districts, provincial capitals and towns, there are the Statistics Bureaus under the provincial/municipal Statistics Departments.
Article 4. The organizational structure of the General Department of Statistics
a) Organizations assisting the General Director in performing the State management tasks and powers:
1. The Department for National Account System;
2. The Department for Statistical Regimes and Methodology;
3. The Department for Synthetic Statistics;
4. The Department for Industrial and Construction Statistics;
5. The Department for Agricultural, Forestry and Fishery Statistics;
6. The Department for Trade, Service and Price Statistics;
7. The Department for Population and Labor Statistics;
8. The Department for Social and Environmental Statistics;
9. The Department for International Cooperation;
10. The Department for Organization and Personnel;
11. The Department for Planning and Finance;
12. The Inspectorate;
13. The Office.
b) Non-business units under the General Department of Statistics:
1. The Institute for Statistical Research;
2. The Statistical Informatics Center;
3. The Statistical Data Center;
4. The Fact and Figure magazine.
The General Director of Statistics shall be assigned to organize and arrange other existing non-business units according to law provisions.
Article 5. Implementation effect
This Decree takes effect 15 days after its publication in the Official Gazette and replaces the Government's Decree No. 23/CP dated March 23, 1994 on the functions, tasks, powers and organizational structure of the General Department of Statistics.
Article 6. Implementation responsibility
The General Director of Statistics, the ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government and the presidents of the provincial/municipal People's Committees shall have to implement this Decree.
