DECISION OF THE MINISTER OF INTERNAL AFFAIRS
ON PROMULGATION OF CRITERIA FOR THE POST OF DEPARTMENT DIRECTOR AND EQUIVALENTS UNDER THE PEOPLE’S COMMITTEE OF PROVINCE OR CENTRALLY ADMINISTERED CITY.
MINISTER OF INTERNAL AFFAIRS
- Pursuant to the Ordinance on Public Servant, 26 December 1998 and the Ordinance Amendment, 29 April 2003;
- Pursuant to the Decree No. 45/2003/ND-CP, 09 May 2003 of the Government on the Mandates, Functions, Authority and Organisation of the Ministry of Internal Affairs,
- At the request of the General Director of the Public and Civil Servant Department;
DECIDES
Article 1. To promulgate with this Decision the “Criteria for the Post of Department Director and Equivalents under the People’s Committee of Province or Centrally Administered City”
Article 2. Ministry, ministry equivalent agency, Government agency shall apply these criteria for the posts of the Department Director and equivalents in those agencies under the People’s Committee of province or centrally administered city.
Article 3. This Decision shall come into effect 15 days since the it is made public in the Gazette.
Article 4. Minister, Head of ministry-equivalent agency, Government agency, Chairman of the People’s Committee of the province and centrally-administered city shall implement this Decision.

CRITERIA FOR THE POST OF DEPARTMENT DIRECTOR AND EQUIVALENTS UNDER THE PEOPLE’S COMMITTEE OF PROVINCE AND CENTRALLY ADMINISTERED CITY.
(promulgated by Decision 82/2004/QD-BNV 17 November 2004 of the Minister of Internal Affairs)
1. Post, Mandate
Director of Department and the equivalents (hereinafter referred to as “Department Director” under the People’s Committee of the province or centrally administered city (hereinafter referred to as “Provincial People’s Committee” is the civil servant at the post of the Head of a Department. He leads, directs, manages and runs the operation of his Department, to assist the Chairman of the People’s Committee in exercising the state administration in the sector of his Department’s speciality in the province.
2. Duties 
2.1. Department Director is responsible to the Chairman of the Provincial People’s Committee and the Line Minister and to the Laws in exercising the state administration in the sector under his Department’s speciality in the province, specifically:
2.1.1  Building the Master Plan and  Development Plan of the sector in the province and submit to the Chairman of the People’s Committee for approval;
2.1.2. Building and submitting to the relevant authorities to issue legal regulations of the local authorities in the relevant sector; Proposing the changes and amendment of the legal regulations, policies in the sector of his Department’s speciality;
2.1.3. Organising, instructing the check and inspection of the implementation of the legal regulations, policies and mechanisms in effect under the mandates and authorities of his Department in the territory of the province;
2.1.4. Partial reviewing, reviewing and appraising the performance by mandates and responsibilities;
2.1.5. Organising the information, statistics works, report, archive in the sector of his Department’s speciality;
2.2 Directing, guiding professional work to the relevant agencies at local level; Managing subordinate agencies;
2.3. Being solely responsible or in cooperation with other relevant bodies to deal with proposals or claims in the areas under his assigned authority;
2.4. Leading or participating in research projects in the areas of the  Department’s speciality;
2.5. Managing civil and public servants in the Department; Effectively managing the financial resources and assets allocated to the Department as per regulations;
2.6. Conducting other jobs assigned by the Chairman of the Provincial People’s Committee;
3. Required Properties
Love for the country; firm commitment to the cause of renewal, national independence and socialism of the Party; devotion of oneself for the service of the people; High sense of responsibility and efficiency of work; Thriftiness, uprightness, self-sacrifice, honesty, criticism and self-criticism; Unity, democracy, heartiness with colleagues and workmates, winning their trust; Close relation with the people and winning of the trust of the local people where he resides; High sense of discipline and making good example of full observation of laws and regulations of the Government, regulations of the Agency; Incorruptibleness and strong will in fighting against corruption.
4. Capabilities
4.1. Being capable of advising, organizing for the implementation of the ideas, intention and policies of the Party and Government n the sector of the Department’s speciality;
4.2. Being capable of researching and developing legal documents and proposing solutions and management methods applicable in the relevant sector to serve the state administration of the Provincial People’s Committee;
4.3. Being capable of running the work, uniting people and organizing the staffs of the Department in implementing the tasks and cooperating with relevant authorities and organizations at different levels to fulfill the assigned tasks.
5. Understanding
5.1. Firm understanding of the ideas, intention policies of the Party and Government in the Sector of the Department’s speciality;
5.2. Firm understanding of the legal documents and regulations i the sector of the Department’s speciality and those legal documents promulgated by the local authorities;
5.3. Deep understanding of management job i the sector of the Department’s speciality; Being experienced in organizing, managing and executing job;
5.4. God understanding of the political, socio-economic situation of the locality, country, other countries in the region and the world.
6. Qualifications
6.1. Professional qualification of principal officer or higher;
6.2. Holding Degree of a University majored in the speciality appropriate to the post;
6.3. Completion of high level political theories;
6.4. Completion of state administration training for principal officers or higher;
6.5. Being good at one foreign language (C level). In the provinces where there are ethnic minority groups, learning and using ethnic group language(s) is encouraged and a priority;
6.6. Being competent in using computer and other office equipments for work.
7. Other conditions
7.1. Having 5 years work experience in the relevant areas, of which 3 years in management post;
7.2. Not being over 55 year old for man and 50 year old for woman to be promoted to the post for the first time;
7.3. In good health condition.
