SUMMARY

Strive to reduce the rate of child laborers aged between 5 and 17 to 4.9% in the 2021-2025 period

The Decision No. 782/QD-TTg approving the Program on prevention and reduction of illegal child labor in the 2021-2025 period, with orientations toward 2030 is issued by the Prime Minister on May 27, 2021.

The program sets the objectives as follows: To strive to reduce the rate of child and minor laborers aged between 5 and 17 to 4.9%; All children at risk of being engaged in child labor, child laborers and children trafficked for labor exploitation will receive timely support and intervention and be put under management and monitoring upon the notification; 70% of children will be provided with information and knowledge about the prevention and reduction of child labor; To reduce to the lowest level the rate of child and minor laborers doing heavy, hazardous or dangerous work; etc.

In addition, tasks and solutions of the program include: Improvement of policies and laws on prevention and reduction of child labor; Communication, education and mobilization of the society to increase the awareness of the prevention and reduction of, and responsibility to prevent and reduce child labor; Increase of the prevention and detection, support and intervention on child labor and children at risk of being engaged in child labor in all levels and sectors; Enhancement of the inspection of the observance of laws and policies on prevention of child labor; etc.

This Decision takes effect on the signing date.

DECISION

Approving the Program on prevention and reduction of illegal child labor in the 2021-2025 period, with orientations toward 2030

 THE PRIME MINISTER

 

Pursuant to the June 19, 2015 Law on Organization of the Government; the November 22, 2019 Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration;

Pursuant to April 5, 2016 Law on Children;

Pursuant to the National Assembly’s Resolution No. 121/2020/QH14 of June 19, 2020, on further enhancement of the effectiveness and efficiency of the implementation of policies and laws on child abuse prevention and control;

Pursuant to the Government’s Decree No. 56/2017/ND-CP of May 9, 2017, detailing a number of articles of the Law on Children;

At the proposal of the Minister of Labor, Invalids and Social Affairs:

DECIDES:

 

Article 1. To approve the Program on prevention and reduction of illegal child labor in the 2021-2025 period, with orientations toward 2030 (below referred to as Program) with the following contents:

I. OBJECTIVES AND ORIENTATIONS TOWARD 2030

1. Objectives:

a/ Objective No. 1 aims to prevent, detect, support and intervene illegal child labor (below referred to as child labor) and children at risk of being engaged in child labor.

- To strive to reduce the rate of child and minor laborers aged between 5 and 17 to 4.9%.

- All children at risk of being engaged in child labor, child laborers and children trafficked for labor exploitation will receive timely support and intervention and be put under management and monitoring upon the notification.

- More than 90% of children at risk of being engaged in child labor and child laborers will access general education and be provided with suitable vocational training.

b/ Objective No. 2 aims to communicate about the prevention and reduction of child labor.

- 90% of cadres and teachers of education institutions and children nurturing establishments and 70% parents and caregivers will be provided with information and knowledge about the prevention and reduction of child labor.

- 70% of children will be provided with information and knowledge about the prevention and reduction of child labor.

- 90% of enterprises, cooperatives and households, especially small- and medium-sized enterprises, cooperatives and households in craft villages, will be provided with information and knowledge about the prevention and reduction of child labor.

c/ Objective No. 3 aims to provide training on the prevention and reduction of child labor.

- 90% of provincial and district-level civil servants and public employees and 70% of commune-level civil servants and public employees of the labor, invalids and social affairs sector, and agencies and organizations related to child labor issue shall be provided with training on knowledge and skills on the management, prevention, detection, support and intervention to reduce child labor.

- 90% of enterprises, especially small- and medium-sized enterprises, and cooperatives, 70% of cooperatives and households, especially those in craft villages shall be provided with training on knowledge and skills on the prevention, detection, support and intervention to reduce child labor.

2. Orientations toward 2030: To strive to reduce the rate of child and minor laborers aged between 5 and 17 to 4.5%; to reduce to the lowest level the rate of child and minor laborers doing heavy, hazardous or dangerous work among the total number of child and minor laborers.

II. TASKS AND SOLUTIONS

1. Improvement of policies and laws on prevention and reduction of child labor

To review and improve policies and laws; to study and set criteria for identifying child labor and children protection; to formulate mechanisms for inter-sectoral coordination in prevention and reduction of child labor.

2. Communication, education and mobilization of the society to increase the awareness of the prevention and reduction of, and responsibility to prevent and reduce child labor

To study, formulate and develop communication programs, products and documents, diversify modes of information and dissemination of the prevention and reduction of child labor and education and support for children’s rights suitable to separate localities, communities and ethnic groups.

3. To raise the capacity of all-level authorities, and related agencies, organization and individuals, especially employers, for preventing and reducing child labor. To formulate documents and organize training, re-training and refresher training courses on skills on prevention and reduction of child labor for sourcing teachers of all levels and sectors from central to local levels.

4. To increase the prevention and detection, support and intervention on child labor and children at risk of being engaged in child labor in all levels and sectors, especially at grass-root levels, with focus on agriculture, handicrafts and services and supply chains. To prevent and combat the crime of child trafficking for labor exploitation. To establish, deploy and associate the process and network of prevention, detection, support and intervention on child labor and children at risk of being engaged in child labor with the children protection system. To assist child labor, children at risk of being engaged in child labor and their families in accessing poverty reduction, social welfare, general education and suitable vocational training policies, programs and services. To implement models of prevention and reduction of child labor.

5. To promote international cooperation in prevention and reduction of child labor in order to exchange experiences and mobilize domestic and international resources. To mobilize the participation of social organizations, enterprises and individuals in the prevention and reduction of child labor.

6. To enhance the inspection of the observance of laws and policies on prevention of child labor. To strictly and timely handle cases of employing child laborers. To create a database to monitor and evaluate the implementation of the Program, periodically conduct national child labor surveys.

III. FUNDS FOR IMPLEMENTATION

Funds for implementation of the Program comprise:

1. The state budget arranged in the annual state budget expenditure estimates of ministries, sectors and localities according to the current budget decentralization; other related programs, projects and schemes as prescribed by law.

2. International aid and donations and mobilization from the society and community. Other lawful sources (if any).

Article 2. Organization of implementation

1. The Ministry of Labor, Invalids and Social Affairs shall be an agency in charge of:

- Formulating, guiding and organizing the implementation of the Program’s tasks and solutions.

- Reviewing, modifying and supplementing according to its competence or proposing competent agencies to modify and supplement to improve policies and laws on prevention and reduction of child labor. Setting and guiding and deploying criteria for identifying child labor and protecting children.

- Formulating mechanisms for inter-sectoral coordination; a support and intervention process and model to prevent and reduce child labor.

- Organizing inspection of the implementation of policies and laws on prevention and reduction of child labor.

- Monitoring, evaluating, preliminarily reviewing and summing up the implementation of the Program and formulating the Program for the next period. Creating a child labor database, criteria for making statistics of monitoring and evaluation of child labor. Conducting national child labor surveys.

2. The Ministry of Education and Training shall

Assume the prime responsibility for preventing and reducing child labor according to its functions and tasks. Provide students and teachers with information, knowledge and skills on child labor prevention. Assist children at risk of being engaged in child labor and child laborers in accessing general education and deploy models of prevention and reduction of child labor according to functions and tasks.

3. The Ministry of Public Security shall

Assume the prime responsibility for prevention and combat of children traffickers for labor exploitation. Tighten inspection, timely detect and strictly handle violations of laws regarding employment of child laborers. Coordinate with concerned agencies, organizations and units in protecting trafficked children and assisting them in integrating into the community.

4. The Ministry of Agriculture and Rural Development shall

Promote the dissemination to raise the awareness of prevention and reduction of child labor in agriculture. Tighten the inspection and examination of the observance of child labor laws in the assigned field.

5. The Ministry of Information and Communications shall

Direct press agencies and grass-root information systems to organize the dissemination and communication about the prevention and reduction of child labor.

6. The Ministry of Finance shall

Assume the prime responsibility for arranging current expenditures for the Program implementation from the annual state budget estimates of ministries, sectors and localities under regulations and sum them up for submission to competent authorities.

7. Ministries and sectors shall, based on their functions, assigned tasks and delegated powers, formulate and include the plan to implement the Program in their annual socio-economic development plans.

8. Provincial-level People’s Committees shall

- Organize the implementation of the Program in the localities. Carry out tasks and solutions and deploy models suitable to practical conditions of localities, especially in areas and trades where children is engaged in child labor, child labor exists or the likelihood of child laborers occurs.

- Take initiative in allocating budgets and resources or include funds for related programs and schemes in the localities to implement the Program.

- Inspect and examine the observance of laws and policies on prevention and reduction of child labor on a periodical or extraordinary basis; strictly and timely handle cases of employing child laborers.

- Periodically report the Program implementation results to the Ministry of Labor, Invalids and Social Affairs.

9. To propose the Vietnam Chamber of Commerce and Industry assume the prime responsibility for implementing and guide enterprises and employers to implement the Program to ensure the observance of child labor provisions.

10. To propose the Vietnam General Confederation of Labor organize the communication, education and giving advice on child labor laws and policies to cadres, trade union members, minors and children engaged in child labor.

11. To propose the Vietnam Cooperative Alliance assume the prime responsibility for implementing the Program to employers and employees in cooperatives, cooperative federations, cooperative groups to ensure the implementation of child labor provisions; to provide guidance on deployment of the models of prevention and reduction of child labor in areas where cooperatives and craft villages exist.

12. To propose the Vietnam Fatherland Front Central Committee, Ho Chi Minh Communist Youth Union Central Committee, Vietnam Women’s Union Central Committee, Vietnam Farmer’s Union Central Committee and Vietnam War Veterans Association Central Committee and other member organizations of the Vietnam Fatherland Front, the Vietnam Association for Protection of Child Rights and social organizations:

- Communicate, educate and give advices on child labor laws and policies.

- The Vietnam Women’s Union Central Committee and Vietnam Farmer’s Union Central Committee shall increase the provision of guidance to all-level associations on mobilization of families, especially poor households and households living just above the poverty line, areas with particularly difficult socio-economic condition, agricultural areas  and localities where children are engaged in child labor, child labor exists or the likelihood of child laborers occurs, not to let their children drop out or illegally work.

Article 3. This Decision takes effect on the date of its signing.

Article 4. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees, and heads of related agencies and organizations shall implement this Decision.
