DECISION
On the establishment of the Vietnam Fund for Vaccination Prevention of Coronavirus Disease 2019[1]
THE PRIME MINISTER
Pursuant to June 19, 2015 Law on Organization of the Government; and the November 22, 2019 Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration;
Pursuant to the November 21, 2007 Law on Prevention and Control of Infectious Diseases;
Pursuant to the Government’s Resolution No. 53/NQ-CP of May 26, 2021, on the establishment of the Vietnam Fund for Vaccination Prevention of Coronavirus Disease 2019;
At the proposal of the Minister of Finance,
DECIDES:
Article 1. To establish the Vietnam Fund for Vaccination Prevention of Coronavirus Disease 2019 (below referred to as the Fund) to receive, manage and use donations, supports and voluntary contributions in cash and in the form of vaccines from domestic and foreign organizations and individuals, and other lawful funding sources for procurement and import of vaccines, research and production of domestic vaccines, and use of Covid-19 vaccines for the population.
The Vietnam Fund for Vaccination Prevention of Coronavirus Disease 2019 (VFVC), as its transaction name in English, shall be managed by the Ministry of Finance.
The Ministry of Finance shall promulgate the Regulation on organization, operation, management and use of the Fund in a public and transparent manner.
Article 2. Legal status of the Fund
1. The Fund is an off-budget state financial fund and operates under the Prime Minister’s decision.
2. The Fund has the legal person status and may open accounts at the State Treasury and commercial banks in accordance with law.
Article 3. Functions of the Fund
The Fund has the functions of managing and coordinating its financial and physical resources to provide donations and supports for the procurement and import of vaccines, research and production of domestic vaccines, and use of Covid-19 vaccines.
Article 4. Organization of the apparatus and operation principles of the Fund
1. The Fund’s management apparatus shall be composed of cadres and civil servants of the Ministry of Finance, who will perform their jobs on a part-time basis under the Minister of Finance’s decisions.
Finance for operation of the Fund’s management apparatus shall be covered by the state budget, not by its revenues.
2. The Fund operates not for profit and uses its funds for proper purposes in accordance with law in a public, transparent, economical and efficient manner.
3. The Fund’s financial activities are subject to examination, inspection and audit by state management agencies in charge of finance and the State Audit Office of Vietnam. The Fund submits to supervision by the Vietnam Fatherland Front and the community.
4. The Fund may deposit its idle funds at commercial banks in order to preserve and develop its funds in a safe manner.
Article 5. Tasks of the Fund
1. To receive, manage and use donations, supports and voluntary contributions in cash and in the form of vaccines from domestic and foreign organizations and individuals and other lawful funding sources to support and finance the procurement and import of vaccines, research and production of domestic vaccines, and use of Covid-19 vaccines.
2. To coordinate with the Vietnam Fatherland Front and related agencies and organizations in mobilizing contributions and donations for the Fund so as to support and finance the procurement and import of vaccines, research and production of domestic vaccines, and use of Covid-19 vaccines under regulations.
Article 6. Revenue sources and spending tasks of the Fund
1. Revenue sources of the Fund include:
- Donations, supports and voluntary contributions in cash, in kind and in the form of vaccines from domestic and foreign organizations and individuals;
- Other lawful funding sources.
2. Spending tasks of the Fund: The Fund shall be used for supporting and financing the procurement and import of vaccines, research and production of domestic vaccines, and use of Covid-19 vaccines for the population.
3. Competence to decide on spending from the Fund:
- The Ministry of Health shall assume the prime responsibility for, and coordinate with the Ministry of Finance in, summing up demands for procurement and import of vaccines, research and production of domestic vaccines, and use of Covid-19 vaccines before submitting them to the Prime Minister for him/her to decide on the use of the Fund’s money for financing and supporting the procurement and import of vaccines, research and production of domestic vaccines, and use of Covid-19 vaccines under regulations.
- The Ministry of Finance shall use the Fund’s money for payment for expenditures approved by the Prime Minister based on payment request dossiers submitted by the Ministry of Health.
Article 7. Reporting, accounting and account-finalization regimes and financial disclosure of the Fund
1. Reporting, accounting and account-finalization regimes, and financial disclosure of the Fund must comply with the Law on Accounting and the Ministry of Finance’s guidance.
2. The Fund shall report on its actual revenues, expenditures, and financial account-finalization for inclusion in socio-economic and state budget reports for submission to the Government and National Assembly; and publicize mobilized money amounts, list of donors and contributors, spending items, money amounts spent and balance of the Fund (if any).
Article 8. Implementation provisions
1. This Decision takes effect on the date of its signing.
2. The Fund shall automatically terminate its operation and dissolve after competent agencies announce the completion of the Covid-19 vaccination for the population. The balance of the Fund (if any) shall be wholly remitted into the central budget for contribution to the procurement of vaccines for the State’s Expanded Program on Immunization.
3. The Standing Body of the Central Committee of Vietnam Fatherland Front shall fully discharge its responsibility for mobilization of resources from organizations and individuals to the Fund; and supervise the Fund to ensure it is managed and used for proper purposes and in an open, transparent and efficient manner.
4. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees, and related organizations and individuals shall implement this Decision.-
