DECISION
ON THE INTENSIVE CONTROL OF TRIFLURALIN RESIDUES IN TRA, BASA CATFISH INTENDED FOR EXPORT TO JAPAN
THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to the Decrees No. 01/2008/ND-CP of January 3, 2008 defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development; No. 75/2009/ND-CP of September 10, 2009 amending Article 3 of the Decree No. 01/2008/ND-CP of January 3, 2008 defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Ordinance on Food Hygiene and Safety of July 26, 2003; the Decree No. 163/2004/ND-CP of September 7, 2004 detailing some provisions of the Ordinance on Food Hygiene and Safety.
Considering the request of the Director General of the National Agro-Forestry-Fisheries Quality Assurance Department,
Pursuant to the Ordinance on Food Hygiene and Safety of July 26, 2003; the Decree No. 163/2004/ND-CP of September 7, 2004 detailing some provisions of the Ordinance on Food Hygiene and Safety.
Considering the request of the Director General of the National Agro-Forestry-Fisheries Quality Assurance Department,
DECIDES
Article 1. To perform inspection and analysis for Trifluralin in 100% of shipments of tra, basa catfish intended for export to Japan.
Article 2. The National Agro-Forestry-Fisheries Quality Assurance Department (NAFIQAD) is responsible for:
Disseminating and guiding to tra, basa catfish processors the control of Trifluralin residues in processing chain.
Performing inspection and analysis for Trifluralin residues in tra, basa catfish shipments intended for export to Japan in compliance with the Circular No. 78/2009/TT-BNNPTNT of December 10, 2009 of the Ministry of Agriculture and Rural Development; and issuing health certificates for shipments with satisfactory results as required by Japanese regulations.
Applying, after the coming into force of this Decision, the export suspension of tra, basa catfish to Japan towards processors notified of Trifluralin residues by Japanese competent authorities. The export suspension shall be only lifted when the involved processors have investigated contamination cause, carried out effectively corrective actions and exported 05 consecutive shipments of tra, basa catfish with testing result of no Trifluralin detected.
Co-ordinating with the General Department of Vietnam Customs to control tra, basa catfish shipments intended for export to Japan in compliance with the Decision.
Making reports and proposing to the Minister the cancellation or amendment of the Decision in case Trifluralin contamination in exported tra, basa catfish is under control or when Japanese competent authorities decide to lift the intensive control order applied to Vietnam tra, basa catfish.
Article 3. This Decision takes effect since the date of signature.
Article 4. The Chief of the Ministry’s Office, the Director General of the National Agro-Forestry-Fisheries Quality Assurance Department, the Directors of Departments of Agriculture and Rural Development in provinces/cities under Central Authority, Heads of involved units and tra, basa catfish processing establishments for export to Japan are responsible for the implementation of this Decision.
