DECISION
Prescribing the receipt and coordination of foreign relief and assistance resources, and the deployment of Vietnamese forces and means abroad to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations[1]
Pursuant to Law No. 63/2025/QH15 on Organisation of the Government;
Pursuant to Law No. 104/2025/QH15 on the State of Emergency;
At the proposal of the Minister of National Defence;
The Prime Minister promulgates the Decision prescribing the receipt and coordination of foreign relief and assistance resources, and the deployment of Vietnamese forces and means abroad to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations.
Chapter I
GENERAL PROVISIONS
Article 1. Scope of regulation
1. This Decision details Clause 4, Article 8 of Law No. 104/2025/QH15 on the State of Emergency regarding the receipt and coordination of foreign relief and assistance resources in case a state of emergency is declared in Vietnam, and the deployment of Vietnamese forces and means abroad to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations.
2. The receipt, management, and coordination of the use, of international emergency aid for disaster relief and the remediation of the consequences of disasters and epidemics, which are governed by existing legal documents, do not fall within the scope of regulation of this Decision.
Article 2. Subjects of application
1. Donors regulated by this Decision that are foreign organisations and individuals and act in good faith and respect and comply with the laws of Vietnam, including:
a/ International organisations, intergovernmental organisations, and governmental organisations authorised by foreign governments;
b/ Ministries, agencies and organisations under foreign governments, foreign local administrations, and Vietnam-based diplomatic missions of foreign countries that directly provide aid or authorise foreign legal entities to administer aid;
c/ Foreign non-governmental organisations, non-profit organisations, social funds and private foundations established under foreign law;
d/ Foreign individuals, including overseas Vietnamese.
2. Aid recipients that are organisations established in accordance with the laws of Vietnam, having their functions, duties and operations consistent with the objectives and contents of aid provided in case a state of emergency is declared in Vietnam, including:
a/ Ministries and ministerial-level agencies;
b/ The Central Committee of the Vietnam Fatherland Front and provincial-level Vietnam Fatherland Front Committees;
c/ Provincial-level People’s Committees;
d/ Other agencies, organisations and individuals involved in the receipt, management and use of international aid as decided by competent authorities in case a state of emergency is declared in Vietnam.
3. Aid beneficiaries that are agencies, organisations, households, individuals and enterprises affected by a state of emergency.
4. Vietnamese agencies, organisations and individuals that are permitted by competent authorities to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations abroad.
Article 3. Interpretation of terms
In this Decision, the terms below are construed as follows:
1. International aid means non-refundable aid provided by donors on a non-profit basis for carrying out emergency response, consequence remediation, humanitarian assistance and disaster relief operations.
2. Aid owner means an agency or organisation assigned by the aid recipient to receive and manage the aid.
3. Aid-using entity means an agency or organisation assigned by a competent authority to use the aid.
4. Decision on the receipt of international emergency aid for relief and assistance means a written decision issued by a competent agency on the receipt of international aid for relief and consequence remediation during a state of emergency. Such decision must have the following principal contents: name of the aid; donor; aid recipient; aid owner; objectives of the aid; total value of the aid; allocation plan; and implementation responsibilities.
5. Line ministry means a ministry assigned to perform the state management in the sector in which an incident or disaster occurs at a level requiring the declaration of a state of emergency in accordance with law.
6. International agreement on the receipt of aid for relief and assistance means a treaty in accordance with the law on treaties, or an international agreement other than a treaty concluded in the name of the Government or in the name of an agency specified in Clause 2, Article 2 of this Decision.
Chapter II
RECEIPT AND COORDINATION OF FOREIGN RELIEF AND ASSISTANCE RESOURCES
Section 1
RECEIPT OF INTERNATIONAL EMERGENCY AID FOR RELIEF AND ASSISTANCE
Article 4. Principles for the receipt and coordination of foreign relief and assistance resources
1. The receipt and coordination of foreign relief and assistance resources must ensure publicity, transparency, proper purpose, timeliness, effectiveness and proper beneficiaries; be carried out through close and coordinated cooperation among ministries, sectors, localities, organisations and individuals concerned; and promote the application of science and technology, innovation and digital transformation in management and administration, while ensuring data connectivity and sharing among relevant agencies.
2. Unlawfully donated weapons, equipment, means and resources, goods that are prohibited by law from import, aid that adversely affects the environment, public health, political security, or social order and safety, infringes upon the interests of the State and the people, or contributes to the proliferation of weapons of mass destruction shall not be accepted.
3. The receipt and coordination of foreign relief and assistance resources must comply with the laws of Vietnam and commitments made to donors; ensure conformity with international practices and Vietnam’s international commitments; and at the same time firmly uphold national independence, sovereignty and security.
4. Only the aid allocation plan (covering the quantity, place of receipt and allocated value) may be coordinated without altering the objective of the aid and its total value.
5. For international aid constituting state budget revenue, its receipt and coordination must comply with the law on state budget management.
Article 5. Funding for the receipt of foreign relief and assistance resources
Expenditures on rent of warehouses and storage and reception facilities, and transportation and other related costs shall be covered by state budget funds allocated to ministries, sectors and localities, along with other lawful funding sources. The funding sources and responsibility for arranging such funding shall be specified in the decision on aid receipt approved by a competent authority.
Article 6. Process of receipt of relief and assistance resources
1. Preparation for the receipt of aid.
2. Approval of the receipt of aid.
3. Receipt of aid for relief and assistance.
Article 7. Preparation for the receipt of aid
1. Within 1 day counting from the receipt of information from the donor, the aid recipient shall designate one agency to act as the aid owner.
2. The aid owner shall coordinate with the donor to agree on the principal contents of the aid, including: form of aid, value of the aid, quantity and allocated value, method and place of aid receipt, implementation schedule, and other relevant contents.
Article 8. Approval of the receipt of aid
1. Competence to approve the receipt of aid
a/ The Prime Minister has the competence to approve the receipt of aid related to national security, national defence or religion, and aid involving the import of goods falling within the Prime Minister’s competence as prescribed by law;
b/ The heads of the agencies and organisations specified in Clause 2, Article 2 of this Decision have the competence to approve the receipt of aid other than that specified in Point a of this Clause. The President of the Central Committee of the Vietnam Fatherland Front has the competence to approve the receipt of aid for which no managing agency has been identified yet.
2. Procedures for approval of the receipt of aid falling within the competence of the Prime Minister
a/ The aid owner shall send a written document together with the aid receipt dossier to the aid recipient;
b/ The aid recipient shall consult the Ministry of National Defence, the Ministry of Public Security, the Ministry of Foreign Affairs and other relevant agencies. The consulted agencies shall provide their opinions within 1 day from the receipt of the consultation request. The aid recipient shall consider and respond to such opinions, finalise the dossier, and submit it to the Prime Minister within 3 days from the date of receipt of a complete dossier;
c/ The Prime Minister shall consider and decide on the receipt of emergency aid.
3. Procedures for approval of the receipt of aid falling within the competence of the aid recipient
a/ The aid owner shall prepare the draft aid receipt dossier and obtain opinions thereon from relevant agencies through consultation in writing or by other appropriate means. The consulted agencies shall provide their opinions within 1 day from the time of the receipt of the consultation request. The aid owner shall then finalise the aid receipt dossier and submit it to the aid recipient;
b/ The head of the aid recipient shall consider and approve the dossier. When necessary, opinions from relevant agencies and organisations shall be obtained before approval;
c/ The time limit for considering and approving the decision on the receipt of international emergency aid for relief and assistance is 3 days from the date on which the aid recipient receives a complete dossier.
4. A dossier for consulting relevant agencies on the receipt of aid must comprise:
a/ A draft written request for approval of the receipt of aid, with the contents provided in Appendix I to this Decision;
b/ The written aid notification or aid agreement issued by the donor and the list of aid items (accompanied by a Vietnamese translation);
c/ Other documents relating to the aid as prescribed by law.
5. A dossier submitted to a competent authority for approval of the receipt of aid must comprise:
a/ A written request for approval of the receipt of aid, with the contents provided in Appendix I to this Decision;
b/ The written aid notification or aid agreement issued by the donor, and the list of aid items (accompanied by a Vietnamese translation);
c/ A report on the receipt of, and responses to, the opinions of relevant agencies relating to the receipt of aid;
d/ Other documents relating to the aid as prescribed by law.
Article 9. Receipt of aid
1. After the aid receipt dossier has been approved by a competent authority, the aid owner shall:
a/ Notify the donor of the competent authority’s decision approving the receipt of aid;
b/ Request the aid recipient to issue a written notification to relevant ministries, sectors and localities for coordination in the receipt of aid;
c/ Carry out specialised inspection procedures and customs clearance procedures in accordance with law, for aid in the form of goods;
d/ Open an account for receiving aid (in case no such account has been opened yet), or notify the donor of the aid receipt account (in case such an account already exists) for the receipt of relief and assistance funds, for monetary aid for relief and assistance. Aid provided in foreign currency shall be transferred to a foreign currency account opened at a licensed credit institution or sold to a licensed credit institution in accordance with law.
2. On the basis of the decision approving the receipt of aid, the aid owner shall assume the prime responsibility for, and coordinate with relevant agencies in, receiving and disbursing the aid.
Section 2
COORDINATION OF FOREIGN RELIEF AND ASSISTANCE RESOURCES
Article 10. Receipt and coordination of foreign forces and means participating in emergency response and consequence remediation operations in relation to a disaster-related state of emergency in Vietnam
1. Ministers shall, within the ambit of their assigned state management responsibilities for the relevant sectors and fields, assume the prime responsibility for advising and proposing to the Prime Minister the direction of the receipt and coordination of foreign forces and means participating in emergency response, consequence remediation, humanitarian assistance and disaster relief operations in Vietnam.
2. The approval for foreign forces and means to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations in Vietnam must comply with the Government’s Decree No. 95/2010/ND-CP of September 16, 2010, on the licensing and coordination of activities involving foreign search and rescue forces in Vietnam.
Article 11. Conclusion of treaties between the Vietnamese side and foreign aid partners for the receipt of aid
In case a donor requests the conclusion of a treaty concerning non-refundable, non-profit aid for relief, assistance, emergency response and consequence remediation in relation to a disaster-related state of emergency in Vietnam, the procedures for the conclusion, amendment, supplementation and extension of such treaty must comply with the law on treaties.
Article 12. Conclusion of international agreements between the Vietnamese side and foreign aid partners for the receipt of aid
1. In case a donor requests the conclusion of an international agreement in the name of the Government concerning the donor’s non-refundable, non-profit aid for relief, assistance, emergency response, and consequence remediation in relation to a disaster-related state of emergency in Vietnam, the procedures for the conclusion, amendment, supplementation and extension of such agreement are as follows:
a/ The aid recipient shall prepare the draft agreement, consult the donor, and simultaneously obtain opinions from the Ministry of Foreign Affairs, the Ministry of Justice and other relevant agencies on the draft agreement. The consulted agencies shall provide written opinions within 1 day from the date of receipt of the consultation request. The aid recipient shall finalise the draft agreement and submit it to the Prime Minister for approval of its conclusion;
b/ Based on the Prime Minister’s decision, the person authorised by the Prime Minister shall sign the agreement with the donor;
c/ The dossier for consultation must comprise: a draft request to the Prime Minister; the draft agreement; the donor’s notification and list of aid items (accompanied by a Vietnamese translation); and other documents relating to the aid (if any).
2. In case a donor requests the conclusion of an international agreement in the name of one of the agencies specified in Clause 2, Article 2 of this Decision concerning the donor’s non-refundable, non-profit aid, the procedures for the conclusion, amendment, supplementation and extension of such agreement are as follows:
a/ The aid recipient shall prepare the draft agreement, consult the donor, and simultaneously obtain opinions from the Ministry of Foreign Affairs, the Ministry of Justice and other relevant agencies on the draft agreement. The consulted agencies shall provide written opinions within 1 day from the date of receipt of the consultation request. The aid recipient shall finalise the draft agreement and designate the signatory;
b/ The dossier for consultation must comprise: the draft agreement; the donor’s notification and list of aid items (accompanied by a Vietnamese translation); and other documents relating to the aid (if any).
Article 13. Opening of aid receipt accounts
Pursuant to the aid agreement or management requirements, the aid recipient may open an account at the State Treasury or a commercial bank for the receipt of monetary aid.
Article 14. Preparation of a financial plan for aid
Based on relief and assistance needs and the treaty or international agreement (if any), the aid owner shall coordinate with ministries, central sectors and localities in preparing estimates of aid revenues and expenditures, and shall report them to the aid recipient for submission to a competent authority for approval.
Article 15. Management of aid
1. For monetary aid
a/ Expenditure shall be made in accordance with the financial plan approved by the competent authority;
b/ Expenditure control shall be carried out in accordance with the law on state budget management;
c/ Monthly, or whenever aid is received, the aid recipient shall prepare documentation for recording state budget revenues and expenditures relating to the aid in accordance with the state budget index.
2. For aid in the form of goods
a/ Based on the relevant supporting documents and the actual receipt and delivery of the goods, the entity managing and using the aid shall complete the procedures for recording state budget revenues and expenditures;
b/ Expenditure control and the recording of state budget revenues and expenditures shall be carried out;
c/ Customs dossiers and customs procedures for imported aid goods must comply with the law on customs.
Article 16. Tax policy applicable to aid goods
1. Taxes, charges and fees applicable to aid goods must comply with the laws on taxes, charges and fees.
2. Procedures and dossiers for tax exemption or refund in respect of aid goods must comply with the laws on tax administration and customs.
Article 17. State inspection and specialised inspection of imported aid goods
Imported aid goods shall be exempted from state inspection and specialised inspection upon importation. Categories of goods subject to special control shall be determined by line ministers.
Article 18. Recording, accounting and final settlement
1. The recording, accounting and final settlement of aid constituting state budget revenue must comply with the law on state budget management.
2. The recording, accounting and final settlement of aid not constituting state budget revenue must comply with the law on accounting and the organisation and operation charter of the aid recipient.
Article 19. Audit of aid reports
Aid constituting state budget revenue is subject to audit in accordance with the law on auditing.
Article 20. Reporting regime
1. The aid-using entity shall report to the aid owner on the receipt and use of aid within 5 days after completion of the aid disbursement, and shall make extraordinary reports at the request of the aid owner.
2. The aid owner shall report to the aid recipient on the receipt, management and use of the aid within 5 days from the date of receipt of the report from the aid-using entity.
3. In case the aid recipient is a provincial-level Vietnam Fatherland Front Committee or People’s Committee, it shall provide information to, and coordinate with, the relevant line ministry regarding the receipt and allocation of relief and assistance within 3 days from the date of issuance of the decision on the receipt of international emergency aid for relief and assistance.
4. In case the aid recipient is a relevant line ministry, it shall report to the Government and the Prime Minister on the receipt and allocation of relief and assistance within 3 days from the date of issuance of the relevant decision.
5. The relevant line ministry shall summarise and report to the Government and the Prime Minister on the receipt and implementation of aid upon request.
6. The reporting regime prescribed in this Article shall be implemented through digital platforms, shared information systems or other appropriate information technology applications to ensure timely and accurate reporting and to effectively support direction and administration work.
7. The aid recipient shall disclose information on the receipt, allocation and use of aid on its portal or by other appropriate means in accordance with law, except information classified as state secrets.
Chapter III
DEPLOYMENT OF VIETNAMESE FORCES AND MEANS ABROAD TO PARTICIPATE IN EMERGENCY RESPONSE, CONSEQUENCE REMEDIATION, HUMANITARIAN ASSISTANCE AND DISASTER RELIEF OPERATIONS
Article 21. Vietnamese forces and means deployed abroad to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations
1. Standing forces
a/ The Ministry of National Defence: Urban Search and Rescue Team; Environmental Consequence Remediation Team; Search and Rescue Canine Team; Maritime Search and Rescue Vessel Team; Submarine Rescue Centre; Field Hospital and Military Medical Team.
b/ The Ministry of Public Security: Firefighting and Rescue Team; Search and Rescue Canine Team; Emergency Medical Response Team.
2. Other forces
The relevant line ministry and provincial-level People’s Committees shall organise and deploy experts and subordinate forces to participate in international humanitarian assistance and disaster relief operations at the request of competent agencies.
3. Vietnamese forces participating in international emergency response, consequence remediation, humanitarian assistance and disaster relief operations are entitled to receive training in foreign languages and professional knowledge and skills relevant to international humanitarian assistance and disaster relief operations. Training courses and exercises shall be organised at least once annually.
4. Eligibility standards
Vietnamese forces participating in humanitarian assistance and disaster relief operations must possess good moral qualities, be physically fit to work in harsh environments, and be under 45 years of age (except the commanding officer); in special cases, exceptions shall be decided by a competent authority.
5. Equipment, means and uniforms
a/ Equipment and specialised means must be modern, compact, lightweight, standardised and multifunctional, capable of being carried and rapidly deployed, and suitable for the type of disaster concerned and the assistance requested by the host country;
b/ Uniforms worn while performing duties abroad must comply with the regulations issued by the relevant line ministry.
6. Funding for the deployment of Vietnamese forces abroad to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations shall be included in the annual state budget estimates of ministries, central sectors and localities, together with other lawful funding sources in accordance with the law on the state budget and current legal documents.
Article 22. Competence to decide on the deployment and withdrawal of Vietnamese forces and means participating in humanitarian assistance and disaster relief operations
1. Deployment of Vietnamese forces and means participating in humanitarian assistance and disaster relief operations
On the basis of Vietnam’s diplomatic relations and the assistance needs of the disaster-affected country, the relevant line ministry shall assume the prime responsibility for, and coordinate with relevant ministries, central sectors and localities in, preparing a proposal for the deployment of Vietnamese forces and means to participate in humanitarian assistance and disaster relief operations in adherence to the following principles:
a/ In case the proposal involves the deployment abroad of forces of the Army and the Public Security forces to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations, the Ministry of National Defence shall assume the responsibility for, and coordinate with the Ministry of Public Security and other relevant ministries and sectors in, submitting the proposal to the Permanent Member of the Secretariat of the Party Central Committee for consideration and decision;
b/ In case the proposal involves the deployment abroad of the Public Security forces (without forces or means of the Ministry of National Defence) to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations, the Ministry of Public Security shall assume the responsibility for, and coordinate with relevant central ministries and agencies in, submitting the proposal to the Permanent Member of the Secretariat of the Party Central Committee for consideration and decision;
c/ In case the proposal does not involve the deployment of armed forces to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations, the ministry, central sector or locality assigned the commanding responsibility shall report and submit the proposal to the Prime Minister for consideration and decision.
2. Withdrawal of Vietnamese forces and means participating in emergency response, consequence remediation, humanitarian assistance and disaster relief operations
a/ In case forces or means of the Ministry of National Defence and the Ministry of Public Security are deployed abroad to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations, the Chief of Mission shall report to the Minister of National Defence, who shall submit a proposal to the Permanent Member of the Secretariat of the Party Central Committee for consideration and decision on the withdrawal of the forces and means to Vietnam;
b/ In case forces or means of the Ministry of Public Security (without forces or means of the Ministry of National Defence) are deployed abroad to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations, the Chief of Mission shall report to the Minister of Public Security, who shall submit a proposal to the Permanent Member of the Secretariat of the Party Central Committee for consideration and decision on the withdrawal of the forces and means to Vietnam;
c/ In case no armed forces are deployed abroad to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations, the Chief of Mission shall report to the head of the ministry, central sector or locality assigned the prime responsibility for submitting a proposal to the Prime Minister for consideration and decision on the withdrawal of the forces and means to Vietnam.
3. A dossier proposing the deployment of Vietnamese forces and means abroad to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations must comprise:
a/ A written request for the deployment of Vietnamese forces and means abroad to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations (which must have the following principal contents: necessity of the deployment; proposed duration and location; and composition of forces and means);
b/ Other relevant documents.
4. Within 1 day from the date on which the competent authority approves the deployment policy, a notification of the deployment of Vietnamese forces and means abroad to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations shall be promptly sent to relevant ministries, central sectors and localities. Such notification must contain the following principal contents:
a/ The commencement date and the expected completion date;
b/ The location of the operations;
c/ The list and composition of the mission, including the Chief of Mission, Deputy Chiefs of Mission, and other members;
d/ The list of equipment, technical means, supplies and essentials.
Article 23. Direction, command, management and administration of Vietnamese forces and means deployed abroad to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations
1. Vietnamese forces and means deployed abroad to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations shall operate under a unified organisational structure and the command of the Chief of Mission.
2. Principles for determining the Chief of Mission for Vietnamese forces and means deployed abroad to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations:
a/ In case forces of the Ministry of National Defence and other forces jointly participate in the operations, the Ministry of National Defence shall appoint the Chief of Mission;
b/ In case forces of the Ministry of Public Security and other forces are jointly participate in the operations, but without forces of the Ministry of National Defence, the Ministry of Public Security shall appoint the Chief of Mission;
c/ In case no armed forces participate in the operations, the ministry, central sector or locality assigned the prime responsibility shall appoint the Chief of Mission.
3. In case forces of the Ministry of National Defence are deployed abroad to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations, the Ministry of National Defence shall ensure supplies, essentials and logistical support for Vietnamese forces. The Office of the resident or concurrently accredited Vietnamese Defence Attaché in the disaster-affected country shall assign forces to provide support under the command and administration of the Chief of Mission and shall liaise with the competent military authorities of the host country and participate in providing supplies, essentials and logistical support as assigned by the Chief of Mission. In case no forces of the Ministry of National Defence participate in the operations, the ministry, central sector or locality assigned the prime responsibility shall designate a subordinate agency or organisation to ensure supplies, essentials and logistical support for Vietnamese forces.
4. The Chief of Mission has the following responsibilities:
a/ To be accountable to the Party, the State, and the head of the ministry, central sector or locality assigned the prime responsibility, for all aspects of the activities of the Vietnamese mission participating in emergency response, consequence remediation, humanitarian assistance and disaster relief operations;
b/ To perform unified command, management and administration over Vietnamese forces and means participating in emergency response, consequence remediation, humanitarian assistance and disaster relief operations;
c/ To promptly report and propose measures for handling complex and sensitive situations and, in cases of emergency, propose the withdrawal of Vietnamese forces and means to Vietnam;
d/ To summarise and submit reports on the results of the mission of Vietnamese forces and means deployed abroad to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations to the Office of the National Civil Defence Steering Committee for summarisation and reporting to the Prime Minister, the Head of the National Civil Defence Steering Committee, and other relevant agencies.
Article 24. Review, evaluation and drawing of experiences from the deployment of Vietnamese forces and means abroad to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations
Following each deployment abroad for emergency response, consequence remediation, humanitarian assistance and disaster relief operations, the ministry, central sector or locality assigned the prime responsibility shall conduct a review and evaluation, draw experiences, and commend organisations and individuals in accordance with law; and shall advise and submit proposals to the Prime Minister for convening a conference to review, evaluate, draw experiences, and commend organisations and individuals in accordance with law.
Article 25. Issuance of official statements, provision of information and communications concerning Vietnam’s emergency response, consequence remediation, humanitarian assistance and disaster relief operations abroad
1. Upon approval of the policy to deploy Vietnamese forces and means abroad for emergency response, consequence remediation, humanitarian assistance and disaster relief operations, the Ministry of Foreign Affairs shall assume the prime responsibility for making the official announcement of such policy on the basis of the competent authority’s decision.
2. During the implementation of Vietnam’s emergency response, consequence remediation, humanitarian assistance and disaster relief operations abroad, the issuance of official statements and the provision of information to the press and the media shall be made by the Chief of Mission under the direction of the ministry, central sector or locality assigned the prime responsibility in accordance with law.
3. Information relating to national defence, security, sensitive foreign affairs matters, casualties, or other serious incidents shall be exchanged and agreed upon with the Ministry of Foreign Affairs and competent agencies before any official statement is made or information is provided to the media.
4. Agencies, organisations and individuals participating in emergency response, consequence remediation, humanitarian assistance and disaster relief operations shall provide timely and accurate information to the agency assuming the prime responsibility, and shall not make unauthorised statements or provide information beyond their competence or in a manner that adversely affects foreign relations or national interests.
Chapter IV
ORGANISATION OF IMPLEMENTATION
Article 26. Responsibilities of the Ministry of National Defence
1. To assume the prime responsibility for, and coordinate with relevant agencies in, appraising and receiving aid related to national defence.
2. To grant permits for foreign military ships, vessels and aircraft and unmanned aircraft transporting aid into Vietnam in accordance with law.
3. To assume the prime responsibility for, and coordinate with relevant ministries, central sectors and localities in, managing and controlling forces on board foreign military ships, vessels and aircraft transporting aid into Vietnam.
4. To invest in specialised and modern equipment and organise training and exercises for forces under its management performing tasks relating to prevention, emergency response, consequence remediation, humanitarian assistance and disaster relief.
Article 27. Responsibilities of the Ministry of Public Security
1. To assume the prime responsibility for, and coordinate with relevant agencies in, inspecting aid involving national security or state secrets falling within its scope of management upon request.
2. To assume the prime responsibility for, and coordinate with relevant ministries, central sectors and localities in, carrying out inspection and handling violations of law in the management and use of international emergency aid for relief and consequence remediation in emergency cases in accordance with law.
3. To invest in specialised and modern equipment and organise training and exercises for forces under its management performing tasks relating to prevention, emergency response, consequence remediation, humanitarian assistance and disaster relief.
Article 28. Responsibilities of the Ministry of Health
1. To direct its units to carry out specialised inspections as expeditiously as possible for aid goods falling within its scope of management in accordance with law.
2. To provide opinions on the receipt of aid in accordance with regulations.
3. To invest in specialised and modern equipment and organise training and exercises for forces under its management performing tasks relating to prevention, emergency response, consequence remediation, humanitarian assistance and disaster relief.
Article 29. Responsibilities of the Ministry of Foreign Affairs
1. To assume the prime responsibility for advising the Prime Minister on requesting foreign countries and international organisations to provide support for forces and means responding to and remediating the consequences of a state of emergency within the territory of Vietnam.
2. To direct Vietnamese diplomatic missions abroad to provide information on humanitarian assistance and disaster relief needs in host countries and promptly report such information to Vietnam; to provide diplomatic support and assistance to Vietnamese forces and means participating in emergency response, consequence remediation, humanitarian assistance and disaster relief operations.
3. To assume the prime responsibility for, and coordinate with the Ministry of National Defence, the Ministry of Public Security and relevant ministries, central sectors and localities in, promoting bilateral and multilateral international cooperation in emergency response, consequence remediation, humanitarian assistance and disaster relief.
4. To assume the prime responsibility for, and coordinate with relevant ministries, central sectors and localities in, carrying out diplomatic procedures for foreign forces and means entering Vietnam to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations.
Article 30. Responsibilities of the Ministry of Construction
To direct agencies and enterprises under its management to support and facilitate the deployment of Vietnamese forces and means abroad and the entry of foreign forces and means into Vietnam for emergency response, consequence remediation, humanitarian assistance and disaster relief operations.
Article 31. Responsibilities of the Ministry of Science and Technology
1. To assume the prime responsibility for advising on, guiding and organising the application of science and technology in the receipt, management and coordination of international relief resources; to promulgate and supervise the application of standards and technical regulations; to develop databases and digital platforms and ensure information security; to promote technology acquisition and transfer and international cooperation in emergency response, consequence remediation, and disaster relief.
2. To provide guidance on ensuring standards and safety for equipment; to promote the application of science and technology in command, administration and deployment; to strengthen international cooperation, information exchange, and the receipt of technical assistance serving emergency response, consequence remediation, humanitarian assistance and disaster relief.
Article 32. Responsibilities of the Ministry of Industry and Trade
1. To assume the prime responsibility for, and coordinate with others in, the supply of essential goods for overseas relief operations; to guide and regulate the circulation and distribution of goods; to coordinate quality and origin inspections; to facilitate import procedures for the prompt receipt of relief resources.
2. To coordinate with ministries deploying forces and means abroad to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief in ensuring commercial logistics and the supply of materials, goods and fuel.
Article 33. Responsibilities of the Ministry of Finance
1. To provide guidance and support regarding procedures to ensure the prompt customs clearance of aid goods.
2. To inspect compliance with financial management regulations by aid owners and aid-using entities.
3. To provide opinions on the receipt of aid in accordance with regulations.
4. To perform the state financial management of aid constituting state budget revenue.
Article 34. Responsibilities of ministries, central sectors and People’s Committees at all levels
1. Within the ambit of their assigned functions, duties and geographical areas of responsibility, to receive, manage, coordinate and effectively use foreign relief and assistance resources in accordance with law.
2. To monitor and inspect the receipt, allocation, management and use of aid to ensure publicity, transparency, proper allocation and proper beneficiaries, and promptly detect and handle, or recommend the handling of, violations in accordance with law.
3. To assume the prime responsibility for or coordinate in implementing plans for mobilising Vietnamese forces and means to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations.
4. To coordinate in ensuring the necessary logistical, technical, financial, security, safety and other conditions for forces and means participating in emergency response, consequence remediation, humanitarian assistance and disaster relief operations within their assigned functions, duties and geographical areas of responsibility.
5. To fully comply with the reporting regime prescribed by law regarding the receipt and coordination of foreign relief and assistance resources and the deployment of Vietnamese forces and means abroad to participate in emergency response, consequence remediation, humanitarian assistance and disaster relief operations.
6. People’s Committees at all levels shall coordinate with the Vietnam Fatherland Front Committees at the same level in allocating aid to ensure timely humanitarian assistance and disaster relief in their localities.
Article 35. Effect
This Decision takes effect on July 13, 2026.
Article 36. Implementation responsibility
Ministers, heads of ministerial-level agencies, Chairpersons of People’s Committees at all levels, and relevant organisations and individuals shall implement this Decision.-
