DECISION

Issuing the list, and prescribing the management and use, of special-use supplies, vehicles and equipment for natural disaster prevention and control^[1]

Pursuant to the June 19, 2015 Law on Organization of the Government; and the November 22, 2019 Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration;

Pursuant to the June 19, 2013 Law on Natural Disaster Prevention and Control; and the June 17, 2020 Law Amending and Supplementing a Number of Articles of the Law on Natural Disaster Prevention and Control and the Law on Dikes;

Pursuant to the June 21, 2017 Law on Management and Use of Public Assets;

At the proposal of the Minister of Agriculture and Rural Development;

The Prime Minister promulgates the Decision issuing the list, and prescribing the management and use, of special-use supplies, vehicles and equipment for natural disaster prevention and control.

Article 1. Scope of regulation

1. This Decision issues the list, and prescribes the management and use, of special-use supplies, vehicles and equipment for natural disaster prevention and control of the State.

2. Supplies, vehicles and equipment for natural disaster prevention and control, which are not referred to in this Decision, shall be managed and used in accordance with the current law.

Article 2. Subjects of application

This Decision applies to agencies, organizations and individuals involved in the management and use of special-use supplies, vehicles and equipment for natural disaster prevention and control of the State.

Article 3. List of special-use supplies, vehicles and equipment for natural disaster prevention and control

1. Special-use supplies, vehicles and equipment for natural disaster prevention and control means supplies, vehicles and equipment with special structures, specifications and functions, which are directly used for performance natural disaster prevention and control tasks of agencies and organizations.

2. The list of special-use supplies, vehicles and equipment for natural disaster prevention and control is provided in the Appendix to this Decision.

Article 4. Funding sources for formation of special-use supplies, vehicles and equipment for natural disaster prevention and control

Funds for formation of special-use supplies, vehicles and equipment for natural disaster prevention and control come from the state budget and other lawful funding sources as prescribed by law.

Article 5. Management and use of special-use supplies, vehicles and equipment for natural disaster prevention and control

1. Special-use supplies, vehicles and equipment for natural disaster prevention and control shall be managed and used in accordance with the law on management and use of public assets. Agencies, organizations and individuals assigned to manage and use special-use supplies, vehicles and equipment for natural disaster prevention and control shall, within the ambit of their assigned functions and tasks, use such supplies, vehicles and equipment to perform natural disaster prevention and control tasks in accordance with law.

2. Special-use supplies, vehicles and equipment for natural disaster prevention and control shall be used for prevention of, response to, and remediation of consequences of, natural disasters; they may also be used for performance of other tasks of organizations and agencies under regulations on their management and use promulgated by competent persons provided that they are always available when natural disasters occur.

3. Based on reality, agencies and organizations shall provide training, refresher training and guidance on the use of special-use supplies, vehicles and equipment for natural disaster prevention and control as suitable to technical requirements and use purposes.
