DECISION

Issuing the list, and prescribing the management and use, of special-use supplies, vehicles and equipment for natural disaster prevention and control^[1]

Pursuant to the June 19, 2015 Law on Organization of the Government; and the November 22, 2019 Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration;

Pursuant to the June 19, 2013 Law on Natural Disaster Prevention and Control; and the June 17, 2020 Law Amending and Supplementing a Number of Articles of the Law on Natural Disaster Prevention and Control and the Law on Dikes;

Pursuant to the June 21, 2017 Law on Management and Use of Public Assets;

At the proposal of the Minister of Agriculture and Rural Development;

The Prime Minister promulgates the Decision issuing the list, and prescribing the management and use, of special-use supplies, vehicles and equipment for natural disaster prevention and control.

Article 1. Scope of regulation

1. This Decision issues the list, and prescribes the management and use, of special-use supplies, vehicles and equipment for natural disaster prevention and control of the State.

2. Supplies, vehicles and equipment for natural disaster prevention and control, which are not referred to in this Decision, shall be managed and used in accordance with the current law.

Article 2. Subjects of application

This Decision applies to agencies, organizations and individuals involved in the management and use of special-use supplies, vehicles and equipment for natural disaster prevention and control of the State.

Article 3. List of special-use supplies, vehicles and equipment for natural disaster prevention and control

1. Special-use supplies, vehicles and equipment for natural disaster prevention and control means supplies, vehicles and equipment with special structures, specifications and functions, which are directly used for performance natural disaster prevention and control tasks of agencies and organizations.

2. The list of special-use supplies, vehicles and equipment for natural disaster prevention and control is provided in the Appendix to this Decision.

Article 4. Funding sources for formation of special-use supplies, vehicles and equipment for natural disaster prevention and control

Funds for formation of special-use supplies, vehicles and equipment for natural disaster prevention and control come from the state budget and other lawful funding sources as prescribed by law.

Article 5. Management and use of special-use supplies, vehicles and equipment for natural disaster prevention and control

1. Special-use supplies, vehicles and equipment for natural disaster prevention and control shall be managed and used in accordance with the law on management and use of public assets. Agencies, organizations and individuals assigned to manage and use special-use supplies, vehicles and equipment for natural disaster prevention and control shall, within the ambit of their assigned functions and tasks, use such supplies, vehicles and equipment to perform natural disaster prevention and control tasks in accordance with law.

2. Special-use supplies, vehicles and equipment for natural disaster prevention and control shall be used for prevention of, response to, and remediation of consequences of, natural disasters; they may also be used for performance of other tasks of organizations and agencies under regulations on their management and use promulgated by competent persons provided that they are always available when natural disasters occur.

3. Based on reality, agencies and organizations shall provide training, refresher training and guidance on the use of special-use supplies, vehicles and equipment for natural disaster prevention and control as suitable to technical requirements and use purposes.

4. In the process of using, conserving and storing special-use supplies, vehicles and equipment for natural disaster prevention and control, agencies, organizations and individuals assigned to manage and use such supplies, vehicles and equipment shall check their technical conditions, and carry out maintenance and repair thereof, and report to competent authorities for consideration and decision cases of loss, damage or shrinkage of such supplies, vehicles and equipment in the course of task performance.

5. Priority rights shall be granted for special-use vehicles and equipment for natural disaster prevention and control which are used for performance of natural disaster prevention and control tasks in accordance with law.

6. The natural disaster preparedness and search and rescue commanding committees at all levels shall, according to their competence, direct or advise competent persons to direct and administer the mobilization of special-use supplies, vehicles and equipment for natural disaster prevention and control as suitable to natural disasters.

7. Annually, the natural disaster preparedness and search and rescue commanding committees at all levels shall direct the monitoring and summarization of information on actual state of special-use supplies, vehicles and equipment for natural disaster prevention and control of agencies and organizations in their localities to serve their direction and administration work  in natural disaster prevention and control and report thereon to the natural disaster preparedness and search and rescue commanding committees of superior levels.

8. Annually, the Permanent Office of the National Steering Committee for Natural Disaster Prevention and Control shall assume the prime responsibility for, and coordinate with the Office of the National Committee for Incident and Natural Disaster Response and Search and Rescue in, monitoring and summarizing information on actual state of special-use supplies, vehicles and equipment for natural disaster prevention and control from the natural disaster preparedness and search and rescue commanding committees of provincial-level localities, ministries and sectors to serve the direction and administration of natural disaster prevention and control nationwide and report thereon to the head of the National Steering Committee for Natural Disaster Prevention and Control.

9. Heads of agencies and organizations assigned to manage and use special-use supplies, vehicles and equipment for natural disaster prevention and control shall issue regulations on, and organize, the management and use of special-use supplies, vehicles and equipment for natural disaster prevention and control in accordance with law.

Article 6. Responsibilities of agencies and organizations

1. Ministries, central agencies and localities shall:

a/ Issue standards and norms for use of special-use supplies, vehicles and equipment for natural disaster prevention and control of agencies and organizations under their management in accordance with the law on management and use of public assets;

b/ Proactively allocate funds for, and approve, and organize the implementation of, plans on, procurement of special-use supplies, vehicles, and equipment for natural disaster prevention and control of the agencies and organizations under their management according to the latter’s assigned functions and tasks in accordance with law;

c/ Direct the monitoring and summarization of information on actual state of special-use supplies, vehicles, and equipment for natural disaster prevention and control of agencies and organizations under their management to serve the annual direction and administration of natural disaster prevention and control and report thereon to the natural disaster preparedness and search and rescue commanding committees of superior levels;

d/ Annually, the natural disaster preparedness and search and rescue commanding committees of provincial-level localities, ministries and sectors shall send reports on actual state of special-use supplies, vehicles and equipment for natural disaster prevention and control of agencies and organizations under their management to the National Steering Committee for Natural Disaster Prevention and Control and the National Committee for Incident and Natural Disaster Response and Search and Rescue for summarization.

2. Before March 31 every year, the Permanent Office of the National Steering Committee for Natural Disaster Prevention and Control shall summarize information on actual state of special-use supplies, vehicles and equipment for natural disaster prevention and control of ministries, sectors and localities to serve the direction and administration of natural disaster prevention and control of the National Steering Committee for Natural Disaster Prevention and Control.

3. The Ministry of Agriculture and Rural Development - a permanent agency of the National Steering Committee for Natural Disaster Prevention and Control shall:

a/ Summarize proposals of ministries, sectors and localities for reporting to the Prime Minister adjustments and supplementations to the list of special-use supplies, vehicles, and equipment for natural disaster prevention and control;

b/ Issue standards and norms for use and allocation of funds for, and approve, and organize the implementation of, plans on, procurement of special-use supplies, vehicles, and equipment for natural disaster prevention and control to serve the direction and administration work of the National Steering Committee for Natural Disaster Prevention and Control according to its functions and tasks and law.

4. Agencies assigned to perform the permanent tasks of natural disaster prevention and control and search and rescue of ministries, sectors and localities shall formulate plans on procurement of special-use supplies, vehicles and equipment for natural disaster prevention and control for submission to competent authorities for approval in accordance with law.

Article 7. Effect

This Decision takes effect on July 20, 2021.

Article 8. Implementation responsibility

Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees, and the head of the National Steering Committee for Natural Disaster Prevention and Control shall implement this Decision.-
