SUMMARY

Task assignment for the Prime Minister and Deputy Prime Ministers

The Decision No. 1527/QD-TTg dated August 01, 2016 on task assignment for the Prime Minister and Deputy Prime Ministers issued by the Prime Minister.

Accordingly, the Prime Minister shall fully perform his/her tasks and exercise his/her powers in accordance with the Constitution and the Law on Organization of the Government; comprehensively lead and administer the work activities of the Government, Government members, heads of government-attached agencies and chairpersons of People’s Committees at all levels; and personally direct and administer major and important affairs and strategic issues in all working fields within the ambit of the Government’s functions, tasks and powers.

A Deputy Prime Minister shall assist the Prime Minister in performing the tasks as assigned by the latter; promptly report to, and ask for opinions of, the Prime Minister on important issues, and proactively coordinate with other Deputy Prime Ministers in settling affairs related to them, and report on divergent opinions, if any, to the Prime Minister.

Within the scope of his/her assigned working fields, a Deputy Prime Minister shall, on behalf of the Prime Minister, have the responsibilities and powers to direct ministries and sectors to formulate development strategies, master plans and plans; and mechanisms, policies and legal documents for promulgation in accordance with their competence or submission to the Government or the Prime Minister; examine and urge the organization of implementation of guidelines, policies and laws and tasks of ministries and agencies; assume the prime responsibility for handling issues that require interdisciplinary coordination, and consider and handle proposals of ministries, sectors and localities within the competence of the Prime Minister as assigned…in the absence of the Prime Minister, the Permanent Deputy Prime Minister or another Deputy Prime Minister authorized by the Prime Minister shall lead the work activities of the Government on behalf of the Prime Minister.

This Decision takes effect on the signing date.

THE PRIME MINISTER

Decision No.1527/QD-TTg dated August 01, 2016 of the Prime Minister on task assignment for the Prime Minister and Deputy Prime Ministers

Pursuant to the 2013 Constitution of the Socialist Republic of Vietnam;

Pursuant to the June 19, 2015 Law on Organization of the Government;

At the proposal of the Minister-Chairperson of the Government Office,

DECIDES:

Article 1.Principles of task assignment and work relationships between the Prime Minister and Deputy Prime Ministers

1. The Prime Minister shall fully perform his/her tasks and exercise his/her powers in accordance with the Constitution and the Law on Organization of the Government; comprehensively lead and administer the work activities of the Government, Government members, heads of government-attached agencies and chairpersons of People’s Committees at all levels; and personally direct and administer major and important affairs and strategic issues in all working fields within the ambit of the Government’s functions, tasks and powers.

The Prime Minister shall assign Deputy Prime Ministers to assist him/her in monitoring, directing and handling regular affairs within his/her competence in each working field of the Government.

2. A Deputy Prime Minister shall assist the Prime Minister in performing the tasks as assigned by the latter; promptly report to, and ask for opinions of, the Prime Minister on important issues, and proactively coordinate with other Deputy Prime Ministers in settling affairs related to them, and report on divergent opinions, if any, to the Prime Minister.

3. Within the scope of his/her assigned working fields, a Deputy Prime Minister shall, on behalf of the Prime Minister, have the responsibilities and powers to:

- Direct ministries and sectors to formulate development strategies, master plans and plans; and mechanisms, policies and legal documents for promulgation in accordance with their competence or submission to the Government or the Prime Minister.

- Examine and urge the organization of implementation of guidelines, policies and laws and tasks of ministries and agencies.

- Assume the prime responsibility for handling issues that require interdisciplinary coordination, and consider and handle proposals of ministries, sectors and localities within the competence of the Prime Minister as assigned.

- Monitor and direct the settlement of internal affairs of ministries and agencies as assigned.

4. In the absence of the Prime Minister, the Permanent Deputy Prime Minister or another Deputy Prime Minister authorized by the Prime Minister shall lead the work activities of the Government on behalf of the Prime Minister.

5. When deeming it necessary or in the absence of a Deputy Prime Minister, the Prime Minister shall personally direct the settlement of affairs assigned to such Deputy Prime Minister or assign another Deputy Prime Minister to do so.

6. Based on the practical conditions, the Prime Minister shall consider and adjust the task assignment for himself/herself and Deputy Prime Ministers to ensure the performance of tasks and exercise of powers of the Government.

Article 2.Task assignment for the Prime Minister and Deputy Prime Ministers

1. Prime Minister Nguyen Xuan Phuc, Secretary of the Government’s Party Caucus Committee

a/ To comprehensively lead and manage all activities within the ambit of the Government’s functions, tasks and powers.

b/ To personally direct and administer the following working fields:

- National and regional socio-economic development strategies, master plans and plans (including land use master plans and plans).

- National financial, credit and monetary strategies and policies.

- State budget expenditures and use of state budget reserves, the financial reserve fund, the foreign exchange reserve fund and other funds of the State; release of national reserves; issuance of government debentures and bonds; and annual money supply plans.

- Strategies for climate change response.

- National defense, security and foreign relations strategies and assurance of national defense and security.

- Establishment of institutions; apparatus organization and personnel work; state administrative boundaries; and general issues on ethnic affairs, religions, and emulation and commendation.

- Unexpected and important tasks and breakthrough solutions in all fields.

- Coordination between the Government and Party agencies, the National Assembly, the President, the Central Committee of the Vietnam Fatherland Front and socio-political organizations.

c/ To monitor and direct the Ministry of National Defense, the Ministry of Public Security, the Vietnam News Agency, Vietnam Television, the Voice of Vietnam and the Ho Chi Minh Mausoleum Management Board;

d/ To personally act as Head of the State Steering Committee for the East Sea and Islands, Head of the National Steering Committee for International Integration, Chairman of the Central Emulation and Commendation Council, Chairman of the National Council for Education and Human Resources Development, and chairman of other national committees and councils, and head of other steering committees.

2. Deputy Prime Minister TruongHoaBinh, Deputy Secretary of the Government’s Party Caucus Committee

a/ To act as Permanent Deputy Prime Minister;

b/ To assist the Prime Minister in monitoring and directing the following working fields:

- Administrative reform.

- Smuggling and trade fraud prevention and combat.

- Corruption prevention and combat; and inspection, and settlement of complaints and denunciations.

- Assurance of traffic order and safety.

- Crime prevention and combat.

- Special amnesty.

- Judicial reform.

- Settlement of regular issues on ethnic affairs, religions, and emulation and commendation.

- Coordination between the Government and the Supreme People’s Court and the Supreme People’s Procuracy.

c/ To assist the Prime Minister in monitoring and directing the Ministry of Home Affairs, the Ministry of Justice, the Government Inspectorate, the Committee for Ethnic Minority Affairs, the Government Office and the Ho Chi Minh National Academy of Politics;

d/ To act as Head of the Government’s Steering Committee for Administrative Reform; Head of the National Steering Committee for Combating Smuggling, Trade Fraud and Counterfeit Goods; Chairman of the National Traffic Safety Committee; Chairman of the National Civil Aviation Security Committee; Head of the National Steering Committee for Crime Prevention and Combat; and chairman of other national committees and councils and head of other steering committees in relevant fields;

dd/ To direct the affairs of the Government on behalf of the Prime Minister in the absence of the Prime Minister and as authorized by the Prime Minister;

e/ To perform other tasks as assigned and authorized by the Prime Minister.

3. Deputy Prime Minister and Minister of Foreign Affairs PhamBinhMinh, member of the Government’s Party Caucus Committee

a/ To personally act as Deputy Prime Minister and Minister of Foreign Affairs;

b/ To assist the Prime Minister in monitoring and directing the following working fields:

- Diplomacy and external relations (including the Party’s external affairs and State’s and people-to-people diplomacy).

- Official development assistance (ODA) and mobilization of concessional loans.

- Foreign non-governmental aid and international non-governmental organizations.

- International integration; and monitoring and directing the negotiation and implementation of multilateral and bilateral international commitments (except the working fields specified at Point a, Clause 4 of this Article).

- Relations between Vietnam and international and regional organizations.

- Border and East Sea and island issues.

- Overseas Vietnamese affairs and issues relating to foreigners in Vietnam.

- Human rights affairs.

c/ To act as Chairman of the Vietnam-Cambodia Intergovernmental Committee, person in charge of the Vietnam-Laos Intergovernmental Committee, Head of the State Steering Committee for Land Border Demarcation and Border Marker Planting, Head of the Steering Committee for Human Rights, and chairman of other national councils and head of other steering committees in relevant fields;

d/ To perform other tasks as assigned and authorized by the Prime Minister.

4. Deputy Prime Minister Vuong Dinh Hue, member of the Government’s Party Caucus Committee

a/ To assist the Prime Minister in monitoring and directing the following working fields:

- General economic affairs, including planning; finance, pricing; monetary-banking; capital market, stock market; financial investment sources; state reserves; and macroeconomic forecasts and policies.

- Reorganization and renewal of state enterprises.

- International economic integration; and monitoring and directing the negotiation and implementation of multilateral and bilateral economic agreements.

- Salary and social insurance policies; hunger eradication and poverty reduction.

- Development of types of enterprises.

- Cooperative economy and cooperatives.

b/ To assist the Prime Minister in monitoring and directing the Ministry of Planning and Investment, the Ministry of Finance, the State Bank of Vietnam, the National Financial Supervisory Commission, Vietnam Social Security, the Vietnam Development Bank, the Vietnam Bank for Social Policies, the State Capital Investment Corporation, and Deposit Insurance of Vietnam;

c/ To act as Chairman of the National Advisory Council for Financial and Monetary Policies; Head of the State Steering Committee for Salary Reform; Head of the Steering Committee for Enterprise Renewal and Development; Head of the Steering Committee for National Target Programs on New-Countryside Building and Sustainable Poverty Reduction; and chairman of other national councils and head of other steering committees in relevant fields;

d/ To perform other tasks as assigned and authorized by the Prime Minister.

5. Deputy Prime Minister Vu Due Dam, member of the Government’s Party Caucus Committee

a/ To assist the Prime Minister in monitoring and directing the following working fields:

- Education and training and vocational training.

- Science and technology.

- Labor, employment and social affairs.

- Information and communications.

- Culture; tourism; and physical training and sports.

- Health, population, family and children.

b/ To assist the Prime Minister in monitoring and directing the Ministry of Education and Training; the Ministry of Labor, War Invalids and Social Affairs; the Ministry of Information and Communications; the Ministry of Science and Technology; the Ministry of Health; the Ministry of Culture, Sports and Tourism; the Vietnam Academy of Science and Technology; the Vietnam Academy of Social Sciences; Vietnam National University of Hanoi; and Vietnam National University of Ho Chi Minh City;

c/ To act as Chairman of the Central Council for National Defense and Security Education; Chairman of the National Council for Sustainable Development and Competitiveness Improvement; Head of the State Steering Committee for Tourism; Head of the Central Interdisciplinary Steering Committee for Food Hygiene and Safety; Chairman of the National Committee for AIDS, Drug and Prostitution Prevention and Control; and chairman of other national councils and head of other steering committees in relevant fields;

d/ To perform other tasks as assigned and authorized by the Prime Minister.

6. Deputy Prime MinisterTrinh DinhDung, member of the Government’s Party Caucus Committee

a/ To assist the Prime Minister in personally monitoring and directing the following working fields:

- Industry, agriculture and rural development, trade - import and export, construction, transport, and natural resources and environment.

- Foreign direct investment (FDI) and offshore investment.

- Assurance of energy supply and energy conservation.

- National key works and capital construction investment projects as decentralized under the Law on Investment and the Law on Public Investment.

- Economic zones, industrial parks and export processing zones.

- Flood and storm prevention and control and search and rescue.

b/ To assist the Prime Minister in monitoring and directing the Ministry of Agriculture and Rural Development; the Ministry of Industry and Trade; the Ministry of Construction; the Ministry of Transport; and the Ministry of Natural Resources and Environment;

c/ To act as Chairman of the National Council on Water Resources; Head of the State Steering Committee for Key Petroleum Projects; Head of the Steering Committee for Coordinating Development of Key Economic Regions; Head of the Steering Committee for the National Target Program on Climate Change Response; Head of the Central Steering Committee for Housing Policies and Real Estate Market; and chairman of other national councils and head of other steering committees in relevant fields;

d/ To perform other tasks as assigned and authorized by the Prime Minister.

Article 3.This Decision takes effect on the signing date; all previous provisions which are contrary to this Decision are annulled.

Government members, heads of government-attached agencies, and chairpersons of provincial-level People’s Councils and People’s Committees shall implement this Decision.-
