DECISION
On perfecting the functions, tasks, organizational structure and operations of the Industrial Relations Committee

THE PRIME MINISTER
Pursuant to the Law on Organization of the Government dated June 19, 2015; Law on Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;
Pursuant to Directive No. 37-CT/TW dated September 03, 2019 of the Secretariat on strengthening the direction of building of harmonious, stable and progressive industrial relations in the new situation;
At the proposal of the Minister of Labor, Invalids and Social Affairs.
DECIDES:
Article 1. Perfecting the Industrial Relations Committee
Perfecting the functions, tasks, organizational structure and operations of the Industrial Relations Committee (hereinafter referred to as the Committee) to advise the Prime Minister and relevant agencies and organizations about mechanisms, policies and solutions to build and develop harmonious, stable and progressive industrial relations.
Article 2. Tasks of the Committee
1. To advise the Prime Minister and relevant agencies and organizations on directions, mechanisms, policies and measures to direct and administer the implementation of guidelines, mechanisms and policies on industrial relations; solutions to build and develop harmonious, stable and progressive industrial relations.
2. To study, propose, recommend, and consult with relevant agencies and organizations on, solutions to effectively implement the Party's guidelines and the State's policies and laws on industrial relations; measures to deal with complex problems arising in industrial relations.
3. To develop and publish periodical and irregular reports on industrial relations.
4. To support provinces and centrally-run cities to research, establish and operate a tripartite mechanism on industrial relations in conformity with specific requirements and conditions of each locality.
5. To perform other duties related to industrial relations at the request of the Prime Minister.
Article 3. Organizational structure of the Committee
1. The Committee consists of 09 members, including:
a) The Chairperson of the Committee is the Minister of Labor, Invalids and Social Affairs;
b) 03 Deputy Chairpersons of the Committee, including: The Deputy Minister of Labor, Invalids and Social Affairs; Deputy Chairperson of the Vietnam General Confederation of Labor; Deputy Chairperson of the Vietnam Chamber of Commerce and Industry;
c) The remaining members of the Committee, including: 01 representative of the Ministry of Labor, Invalids and Social Affairs; 02 representatives of the Vietnam General Confederation of Labor; 01 representative of the Vietnam Cooperative Alliance and 01 representative of the Vietnam Association of Small and Medium Enterprises.
2. The Committee has the Technical Department and Assistance Department, in which:
a) The Technical Department shall be responsible for assisting the Committee in preparing professional and technical reports related to the Committee's tasks. The Chairperson of the Committee shall establish a Technical Department. Its members consist of persons of the agencies and organizations participating in the Committee and related agencies and organizations;
b) The Assistance Department shall be responsible for performing the administrative work of the Committee. The Committee uses the specialized unit of the apparatus of the Ministry of Labor, Invalids and Social Affairs as its Assistance Department.
3. The members of the Committee, its Technical Department and Assistance Department shall work on a part-time basis.
Article 4. Working regime and operation funds of the Committee
1. The Committee shall work on a collegial basis, vote by the majority rule in accordance with the Committee's Working Regulations.
2. The Committee has its own seal managed at the Ministry of Labor, Invalids and Social Affairs in accordance with law regulations.
3. The Committee's operation funds shall be allocated by the state budget, included in the annual state budget current expenditure estimates of the Ministry of Labor, Invalids and Social Affairs and other lawful funding sources according to law regulations.
Article 5. Responsibility of implementation
1. The Ministry of Labor, Invalids and Social Affairs, the Vietnam General Confederation of Labor, the Vietnam Chamber of Commerce and Industry, the Vietnam Cooperative Alliance and the Vietnam Association of Small and Medium Enterprises shall be responsible for:
a) Designating their persons to be members of the Committee, members of the Technical Department and send lists to the Committee for synthesis; notifying in writing the Committee in case there is a change in personnel joining the Committee, the Technical Department;
b) Through the members of the Committee, proactively proposing contents to make the annual programs and plans of the Committee; preparing professional contents for making reports.
2. The Chairperson of the Committee shall be responsible for:
a) Deciding on the list of members of the Committee, deciding on the establishment of the Technical Department;
b) Promulgating the Committee's Working Regulations;
c) Issuing the Committee’s annual program and plan and direct and administer the Committee's activities according to this Decision and the Committee's Working Regulations.
Article 6. Effect
1. This Decision takes effect on the signing date.
2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, the chairperson of Industrial Relations Committee, and other relevant organizations and individuals shall be responsible for the implementation of this Decision./.
