DECISION
Defining the functions, tasks, powers and organizational structure of Vietnam Maritime Search and Rescue Co-Ordination Centre

THE MINISTER OF TRANSPORT
Pursuant to the Vietnam Maritime Code dated November 25, 2015;
Pursuant to Decree No. 56/2022/ND-CP dated August 24, 2022 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Transport;
Pursuant to Decree No. 30/2017/ND-CP dated March 21, 2017 of the Government stipulating the regulation on response to emergency, acts of god and search and rescue;
Pursuant to Decision No. 06/2014/QD-TTg dated January 20, 2014 of the Prime Minister promulgating the regulations on coordination of search and rescue at sea and in seaport waters;
Pursuant to Decision No. 319/QD-BGTVT dated March 27, 2023 of the Minister of Transport regulating the functions, tasks, powers and organizational structure of the Vietnam Maritime Administration;
At the proposal of the Director General of the Vietnam Maritime Administration in Report No. 3707/TTr-CHHVN dated August 28, 2023;
At the proposal of the Director General of the Department of Personnel and Organization,
DECIDES:
Article 1. Position and function
1. The Vietnam Maritime Search and Rescue Co-Ordination Centre (hereinafter referred to as the Centre) is a humanitarian non-business unit, directly under the Vietnam Maritime Administration, performing the function of assume the prime responsibility for coordination of search and rescue in Vietnam's seas, except for seaport waters, prohibited and restricted areas at sea.
2. The Centre has legal status, has its own seal, opens an account at the State Treasury, and is headquartered in Hanoi city.
3. The Centre has a transaction name written in English: “VIETNAM MARITIME SEARCH AND RESCUE CO-ORDINATION CENTRE”, abbreviated as: VIETNAM MRCC.
Article 2. Tasks and powers
1. Formulate and submit the 5-year and annual plans, programs, projects and schemes in the field of maritime search and rescue to the Director General of the Vietnam Maritime Administration for approval under its authority or to competent authorities for approval.
2. Assume the prime responsibility for or participate in formulating national technical standards, regulations and economic-technical norms on maritime search and rescue and submit them to the Vietnam Maritime Administration according to regulations.
3. Participate in formulating draft legal documents on maritime search and rescue; promulgate specialized administrative documents and professional documents on maritime search and rescue under the Centre's authority.
4. Organize the implementation of legal documents, plans, standards, technical regulations, and economic-technical norms on maritime search and rescue.
5. Propagate and disseminate laws related to search and rescue at sea to relevant organizations and individuals in the fields of search and rescue and traffic safety at sea according to the plan approved by the Ministry of Transport, approved by the Vietnam Maritime Administration.
6. Assume the prime responsibility for and participate in coordinating search and rescue
a) Develop the mechanism of search and rescue coordination at sea, submit it to the Vietnam Maritime Administration, report to the competent authority for approval and organize the implementation after approval;
b) Develop a plan on coordination of search and rescue at sea and proactively organize its implementation; submit to the competent authorities for consideration and organize implementation after approval for at-sea search and rescue coordination cases in excess of the Centre's response capacity;
c) Develop and submit the annual plan to respond to natural disasters at sea, and the plan on arrangement of permanent specialized search and rescue vehicles in the key areas to be ready to participate in search and rescue coordination and implementation organization to the Vietnam Maritime Administration for approval.
d) Directly command and manage the Centre's search and rescue forces; assume the prime responsibility for the coordination of search and rescue in Vietnam's seas, except for seaport waters, prohibited and restricted areas at sea; in case in excess of the response capacity, the Centre shall report to and follow the direction of the National Committee for Incident and Disaster Response and Search and Rescue;
dd) Within their area of responsibility, have the right to mobilize and command people, vehicles, and equipment of organizations and individuals to participate in search and rescue at sea;
e) Organize the search and rescue coordination drills for the Centre's search and rescue forces and other search and rescue forces according to the approved search and rescue coordination plan.
g) Participate in coordinating maritime search and rescue with other countries and international organizations in accordance with Vietnamese law and treaties to which the Socialist Republic of Vietnam is a party;
h) Participate in coordinating with other search and rescue forces to conduct search and rescue in seaport waters, prohibited areas and restricted areas at sea under the management of its governing body;
i) Organize a 24-hour daily duty to receive information, process and promptly respond to distress situations occurring in seas under Vietnam's search and rescue responsibility;
k) Organize and carry out statistics and tracking of people, vehicles, and equipment of relevant forces in the sea area with the incident occurrence to serve search and rescue.
7. Organize and manage machinery, equipment, and specialized vehicles for search and rescue to ensure technical requirements and readiness to perform assigned tasks.
8. Participate in international cooperation on search and rescue at sea in accordance with Vietnamese law, bilateral and multilateral agreements and treaties to which the Socialist Republic of Vietnam is a party; be Vietnam's national focal point agency in charge of coordinating and participating in cooperation of search and rescue at sea with ASEAN.
9. Participate with functional forces in ensuring maritime safety and maritime security and contribute to protecting Vietnam's sovereignty over seas and islands when requested; participate in fire prevention and fighting, and prevent environmental pollution at sea when requested by competent authorities.
10. Organize professional training and further training in search and rescue operations for the relevant organizations and individuals.
11. Organize the management of the apparatus, public employees, employees and use approved payroll according to regulations; implement salary regimes and other benefits, rewards and disciplinary policies for public employees and employees; organize training and further training public employees and employees under the Centre's management in accordance with laws, build the organizational structure, job positions, and structure of public employee ranks of the Centre to submit to competent authorities for approval.
12. Public employees and employees of the Centre directly participating in search and rescue activities must use working clothes according to regulations.
13. The Centre can use fund from the state budget and other legal revenue sources to carry out assigned tasks; manage finances and allocated assets in accordance with laws.
14. Carry out research and application of science and technology in the field of search and rescue at sea; formulate and implement programs and projects with application of science and technology; build an information database to serve management and exploitation in the field of search and rescue at sea.
15. Directly interact with the relevant domestic and foreign organizations and individuals to carry out the assigned functions, tasks and powers in accordance with laws.
16. Organize reception of citizens, resolve complaints, denunciations, feedbacks, and recommendations from organizations and citizens; prevent and combat corruption, negativity, practice thrift, combat waste and handle violations of the law by organizations and individuals under the authority of the Centre.
17. Participate in building and organizing the implementation of the overall administrative reform program of the Vietnam Maritime Administration.
18. Implement statistical and reporting regimes as prescribed.
19. Perform other tasks and powers assigned by the competent authorities.
Article 3. Organizational structure
1. Organizations assisting the Director General
a) The Rescue Co-ordination Department;
b) The Technical - Materials Department;
c) The General Planning Department;
d) The Organization and Administration Department
dd) The Finance - Accounting Department
2. Regional Maritime Search and Rescue Co-ordination Centre
The Regional Maritime Search and Rescue Co-ordination Centre is a dependent accounting unit of the Centre, can use its own seal, and can open an account at the State Treasury, including:
a) Region-I Maritime Search and Rescue Co-ordination Centre;
b) Region-II Maritime Search and Rescue Co-ordination Centre;
c) Region-III Maritime Search and Rescue Co-ordination Centre;
d) Region-IV Maritime Search and Rescue Co-ordination Centre;
The Minister of Transport decides to establish, reorganize and dissolve the Regional Maritime Search and Rescue Co-ordination Centre under the Vietnam Maritime Search and Rescue Co-ordination Centre at the request of the Director General of Vietnam Maritime Administration.
The Director General of the Vietnam Maritime Administration shall specify the functions, tasks, powers, organizational structure and maritime search and rescue responsibility areas of the Regional Maritime Search and Rescue Co-ordination Centers at the request of the Centre's Director General.
3. The Maritime Search and Rescue Co-ordination Station
The Director General of the Vietnam Maritime Administration shall decide to establish, reorganize and dissolve the Maritime Search and Rescue Co-ordination Stations under the Regional Maritime Search and Rescue Co-ordination Centre at the request of the Centre's Director General and after receiving approval from the Ministry of Transport.
4. The Centre's Director General shall stipulate the functions, tasks, and powers of the organizations specified in Clauses 1 and 3 of this Article.
Article 4. Leaders
1. The Centre’s Director General shall be the head, taking responsibilities to the Director General of the Vietnam Maritime Administration and the law for all activities of the Centre; Deputy Directors General shall assist the Director General of the Centre, take responsibilities to the Director General and the law for the tasks assigned by the Director General. The number of Deputy Directors General shall comply with the provisions of law.
2. The Centre's Director General is appointed and dismissed by the Director General of the Vietnam Maritime Administration in accordance with laws.
3. The Centre's Deputy General Directors and the Centre’s Chief Accountant are appointed and dismissed by the Director General of the Vietnam Maritime Administration at the request of the Centre's Director General and in accordance with laws.
Article 5. Effect and enforcement
1. This Decision takes effect from the date of signing and replaces Decision No. 2727/QD-BGTVT dated July 30, 2015 of the Minister of Transport defining the functions, tasks, powers and organizational structure of the Vietnam Maritime Search and Rescue Co-Ordination Centre.
2. The Chief of the Ministry Office, the Chief Inspector of the Ministry, the Directors General of relevant Departments, the Director General of the Vietnam Maritime Administration, the Director General of the Vietnam Maritime Search and Rescue Co-Ordination Centre, the Heads of relevant agencies, units and individuals are responsible for implementing this Decision./.
