CIRCULAR

Amending and supplementing a number of articles of the Minister of Education and Training’s Circular No. 29/2024/TT-BGDDT dated December 30, 2024, providing for extra classes and extra study

 

Pursuant to the Education Law No. 43/2019/QH14, and the Law Amending and Supplementing a Number of Articles of the Education Law No. 123/2025/QH15;

Pursuant to the Law on Teachers No. 73/2025/QH15;

Pursuant to the Government's Decree No. 37/2025/ND-CP dated February 26, 2025, defining functions, tasks, powers and organizational structure of Ministry of Education and Training;

At the proposal of the Director of the General Education Department;

The Minister of Education and Training hereby promulgates the Circular amending and supplementing a number of articles of the Minister of Education and Training’s Circular No. 29/2024/TT-BGDDT dated December 30, 2024, providing for extra classes and extra study.

 

Article 1. To amend Clause 1, Article 2 as follows:

“1. Extra teaching and extra study mean supplementary teaching and learning activities conducted beyond the duration prescribed in the education plan applicable to subjects and educational activities (hereinafter collectively referred to as subjects) in the general education program, the continuing education program at the lower secondary level, and the continuing education program at the upper secondary level promulgated by the Minister of Education and Training. Educational activities in culture, arts, sports; enhancement of foreign language competence; STEM/STEAM education; digital competence education; artificial intelligence (AI); career guidance education; life skills education; and other educational contents as prescribed, aimed at comprehensive education and meeting the needs, interests and aptitudes of students, which do not fall within the contents of subject programs promulgated by the Minister of Education and Training, shall not fall within the scope of regulation of this Circular and shall be implemented in accordance with other laws.”

Article 2. To amend Point c, Clause 4, Article 5 as follows:

“c) Each subject organized for extra teaching shall not exceed 02 (two) periods/week.  In case students eligible for registration for extra study as prescribed in Clause 1 of this Article have a need for extra study exceeding 02 (two) periods/week, the Director of the Department of Education and Training shall consider and decide to permit adjustment of the duration of extra teaching organization at the request of the Principal or Director or head of the school (hereinafter collectively referred to as the Principal);”

Article 3. To amend Article 6 as follows:

“1. Organizations or individuals organizing extra teaching and extra study activities outside schools and collecting fees from students (hereinafter collectively referred to as extra teaching institutions) shall satisfy the following requirements:

a) To register business in accordance with law;

b) To publicly disclose and regularly update on the website or post at the place where the extra teaching institution is headquartered the subjects organized for extra teaching; duration of extra teaching for each subject by grade level; location, form and time of organizing extra teaching and extra study; list of extra teachers and tuition fee levels before enrollment of extra classes, in order to ensure supervision by students, families and the community (according to Form No. 02 in the Appendix to this Circular).”

2. Persons providing extra teaching outside schools must have good moral qualities and possess professional competence suitable to the subjects taught.

3. Teachers teaching at schools, when participating in extra teaching outside schools, shall comply with the code of conduct for teachers as prescribed, and shall report to the Principal on the subjects, locations, forms of extra teaching, relationship with the entity in whose name the business registration of the extra teaching institution is made, and time of participation in extra teaching before commencement, and shall promptly update any changes to the reported contents, ensuring transparency and prevention of conflicts of interest in extra teaching activities.”

Article 4. To amend Clause 2, Article 8 as follows:

“2. To promulgate local regulations on extra teaching and extra study, including the following principal contents:

a) Responsibilities of commune-level People’s Committees, education-managing agencies and relevant agencies in implementing regulations on extra teaching and extra study;

b) Management and use of funds for organizing extra teaching and extra study;

c) Inspection, examination and handling of violations.”

Article 5. To amend Clause 3, Article 9 as follows:

“3. To organize, or coordinate with relevant agencies in organizing, the inspection of extra teaching and extra study activities within the managed area; to coordinate with competent agencies in conducting inspections of extra teaching and extra study activities within the managed area upon request; to establish and publicly post hotline telephone numbers on the Department of Education and Training's portal or at the headquarter of the Department of Education and Training to receive and handle petitions and feedback regarding extra teaching and extra study activities within the managed area; to handle violations within competence or request competent agencies to handle violations.”

Article 6. To annul Article 10 and Article 11.

Article 7. To amend Article 12 as follows:

“1. To take responsibility for management of extra teaching and extra study activities within the managed area.

2. To guide and inspect the implementation of regulations on extra teaching and extra study within the managed area; to establish and publicly post hotline telephone numbers on the  portal of the commune-level People’s Committee (if any) or at the headquarters of the commune-level People’s Committee to receive and handle petitions and feedback regarding extra teaching and extra study activities within the managed area; to handle violations within competence or propose competent agencies to handle violations.

3. To conduct monitoring and inspection and coordinate with competent agencies in supervising compliance with the law on working hours, overtime hours and law on security and order, safety, environmental sanitation, and fire prevention and fighting by organizations and individuals conducting extra teaching and extra study outside schools in accordance with competence as prescribed by law.”

Article 8. To amend Clause 2 and add Clause 4, Article 13 as follows:

“2. To manage teachers teaching at the school when participating in extra teaching outside schools, ensuring compliance with Clause 3 of Article 6 of this Circular; to concretize regulations on responsibilities and codes of conduct of teachers when participating in extra teaching or managing extra teaching and extra study activities in the code of conduct for teachers promulgated by the school within its competence, in accordance with the law and practical conditions of the school; to coordinate in monitoring and inspecting extra teaching activities outside schools of teachers teaching at the school.”

4. To establish and publicize hotline telephone numbers on the school’s website or post them at the school to receive and handle petitions and feedback regarding unlawful extra teaching activities by teachers of the school; to take responsibility for organizing dissemination of information and guiding teachers in implementing regulations on extra teaching and extra study; to promptly remind, rectify, and handle violations within competence or propose competent agencies to handle violations; to take responsibility before superior management agencies in case of prolonged and complex violations of regulations on extra teaching and extra study within the managed scope.”

Article 9. To add Clause 3, Article 15 as follows:

“3. Inspection and examination of extra teaching and extra study activities shall be conducted in accordance with the principles of publicity, objectivity and proper competence; to promptly detect and handle violations in accordance with the law; to strictly handle cases of intentional violations, repeated violations or acts of coercion or profiteering in extra teaching and extra study activities.”

Article 10. To amend Form No. 03 in the Appendix to Circular No. 29/2024/TT-BGDDT applied to Clause 3 of Article 6 of Circular No. 29/2024/TT-BGDDT as follows:

“To replace the phrase “Department of Education and Training” with the phrase “People’s Committee of commune/ward/special zone” in the title and Note No. 4; to remove the line “…., date... month ... year ...” in the title; to add Item No. 5 as follows: “5. Relationship with the entity in whose name the business registration of the extra teaching establishment is made.”

Article 11. Effect

1. This Circular takes effect from May 15, 2026.

2. Implementation responsibilities

The Chief of Office, Director of the General Education Department, Director of the Vocational Education and Continuing Education Department, Heads of relevant units under the Ministry of Education and Training; Chairperson of People's committees of provinces and centrally-run cities; Directors of provincial-level Departments of Education and Training, and relevant organizations and individuals shall implement this Circular./.
