CIRCULAR
Defining the List of products and goods of medium risk level and high risk level under the state management of the Ministry of Home Affairs
Pursuant to the Law No. 84/2015/QH13 on Occupational Safety and Health;
Pursuant to the Law No. 05/2007/QH12 on Product and Goods Quality, which was amended and supplemented by the Law No. 78/2025/QH15;
Pursuant to the Law No. 68/2006/QH11 on Standards and Technical Regulations, which was amended and supplemented by Law No. 35/2018/QH15 and Law No. 70/2025/QH15;
Pursuant to the Government’s Decree No. 37/2026/ND-CP detailing a number of articles, and providing measures to organize and guide the implementation, of the Law on Product and Goods Quality;
Pursuant to the Government’s Decree No. 22/2026/ND-CP detailing a number of articles, and providing measures to organize and guide the implementation, of the Law on Standards and Technical Regulations;
Pursuant to the Government’s Decree No. 276/2026/ND-CP defining the functions, tasks, powers and organizational structure of the Ministry of Home Affairs;
At the proposal of the Director of the Department of Employment;
The Minister of Home Affairs hereby promulgates the Circular defining the List of products and goods of medium risk level and high risk level under the state management of the Ministry of Home Affairs.
Article 1. Scope of regulation
This Circular defines the List of products and goods of medium risk level and high risk level (hereinafter referred to as the List of medium-risk and high-risk products and goods) under the state management of the Ministry of Home Affairs with HS codes and corresponding quality management requirements.
Article 2. Subject of application
This Circular applies to:
1. Domestic and foreign organizations and individuals operating in the territory of Vietnam that manufacture, import, export, trade in or use products and goods under the state management of the Ministry of Home Affairs.
2. Organizations and individuals involved in activities of assessment of conformity of the quality of products and goods under the state management of the Ministry of Home Affairs.
3. State management agencies in charge of the quality of products and goods under the management of the Ministry of Home Affairs and other relevant organizations and individuals.
Article 3. List of medium-risk and high-risk products and goods under the state management of the Ministry of Home Affairs
1. Promulgating together with this Circular the List of medium- and high-risk products and goods under the state management of the Ministry of Home Affairs and their HS codes.
2. The list of high-risk products and goods and the corresponding quality management requirements for high-risk products and goods are specified in Section I of the List of medium-risk and high-risk products and goods issued together with this Circular.
3. The list of medium-risk products and goods and the corresponding quality management requirements for medium-risk products and goods are specified in Section II of the List of medium-risk and high-risk products and goods issued together with this Circular.
Article 4. Principles of management of medium-risk and high-risk products and goods
1. The quality management of products and goods on the List of medium-risk and high-risk products and goods shall be carried out in accordance with law regulations on product and goods quality, standards and technical regulations; regulations on certification of technical regulation conformity, declaration of technical regulation conformity and quality inspection of products and goods; and the corresponding national technical regulations.
2. Products and goods on the List issued together with this Circular that are concurrently subject to application of two or more national technical regulations shall fully satisfy the corresponding national technical regulations; undergo conformity assessment, certification of technical regulation conformity, declaration of technical regulation conformity according to the risk levels and corresponding quality management requirements specified in the List issued together with this Circular, the corresponding national technical regulations and law regulations on product and goods quality and on standards and technical regulations; and ensure that conformity assessment contents for the same technical requirement already assessed under the corresponding national technical regulations are not duplicated.
Article 5. Responsibilities of state management of product and goods quality
1. The Department of Employment is the central-level agency for inspection of product and goods quality and performs the state management function of the Ministry of Home Affairs regarding product and goods quality.
2. Local agencies for inspection of product and goods quality are People’s Committees at all levels and specialized agencies under the People’s Committees of provinces and cities as decided by the People’s Committees, which perform the state management function regarding the quality of products and goods under the state management of the Ministry of Home Affairs at the localities and conduct inspections of product and goods quality within their respective areas under their management in accordance with law regulations;
Importing organizations and individuals shall register for state inspection of the quality of imported products and goods with the People’s Committees at all levels or specialized agencies under the People’s Committees of provinces and cities that are assigned to receive and process administrative procedures for inspection of the quality of imported goods.
Article 6. Transitional provision
1. Technical regulation conformity certificates and notices on receipt of technical regulation conformity declarations granted for products and goods within the scope of regulation of this Circular before the effective date of this Circular shall remain valid until the expiry of the validity periods specified in the technical regulation conformity certificates and notices on receipt of technical regulation conformity declarations.
2. The handling of dossiers of registration for certification of technical regulation conformity that were received before July 01, 2026 but have not yet been completely processed shall comply with the law regulations applicable at the time of receipt of the dossiers.
3. Conformity assessment organizations that have been designated to conduct conformity assessment of group-2 products and goods under the management of the Ministry of Home Affairs and whose designation decisions remain valid may continue to conduct conformity assessment in accordance with this Circular until the expiry of the validity periods of the designation decisions.
4. During the adjustment and upgrading of the Vietnam National Single Window to conform to the List of medium-risk and high-risk products and goods issued together with this Circular, organizations and individuals importing products and goods on the List shall register for state inspection of the quality of imported goods on the national public service portal or in accordance with the instructions of inspection agencies. The receipt and processing of dossiers and notification of results of state inspection of the quality of imported goods shall be carried out in accordance with the Government’s Decree No. 37/2026/ND-CP dated January 23, 2026 and relevant law regulations; ensuring no disruption to lawful import activities of organizations and individuals.
Article 7. Effect
1. This Circular takes effect on the signing date.
2. From the effective date of this Circular, the following documents cease to be effective:
a) Circular No. 01/2021/TT-BLDTBXH dated June 3, 2021 of the Ministry of Labor, Invalids and Social Affairs, providing the List of potentially unsafe products and goods subject to the state management by the Ministry of Labor, Invalids and Social Affairs;
b) Circular No. 26/2018/TT-BLDTBXH dated December 25, 2018 of the Minister of Labor, Invalids and Social Affairs, prescribing quality management of products and goods likely to become unsafe under the state management by the Ministry of Labor, Invalids and Social Affairs;
c) Circular No. 13/2024/TT-BLDTBXH dated December 05, 2024 of the Minister of Labor, Invalids and Social Affairs, amending and supplementing a number of articles of the Circular No. 26/2018/TT-BLDTBXH dated December 25, 2018 of the Minister of Labor, Invalids and Social Affairs, prescribing quality management of products and goods likely to become unsafe under the state management by the Ministry of Labor, Invalids and Social Affairs;
d) Article 16 of Circular No. 09/2025/TT-BNV dated June 18, 2025 of the Minister of Home Affairs, delineation of authority and decentralization of state management tasks in the field of Home Affairs.
3. In case the legal normative documents or technical regulations mentioned in this Circular are amended, supplemented or replaced, the new ones shall apply.
4. In case national technical regulations for products and goods on the List issued together with this Circular that were promulgated before the effective date of this Circular contain different provisions on quality management measures, the provisions of this Circular shall apply.
5. In case national technical regulations are newly promulgated, amend, supplement, or replace the national technical regulations specified in the List of medium-risk and high-risk products and goods; or national technical regulations are newly promulgated for additional application to products and goods on the List issued together with this Circular, the provisions of the documents promulgating such national technical regulations shall apply from the effective date of the national technical regulations.
6. For products and goods specified in the List issued together with this Circular that have not yet been listed or assigned HS codes, or in case of differences or inconsistency in their classification and assignment of HS codes, the assignment of HS codes shall be carried out in accordance with law regulations on customs.
Article 8. Organization of implementation
1. The Department of Employment, the Ministry of Home Affairs shall assume the prime responsibility for, and coordinate with relevant agencies in, based on the actual situation and management requirements, including the emergence of new products and technologies and domestic and international warnings about risks of products and goods, reviewing and submitting to the Minister of Home Affairs for consideration the updating and supplementation of the List of medium-risk and high-risk products and goods within its management scope, ensuring publicity, transparency and conformity with law regulations;
The Department of Employment shall assume the prime responsibility for, and coordinate with agencies and units under the Ministry of Home Affairs in, reviewing the national technical regulations corresponding to products and goods on the List issued together with this Circular; and propose the promulgation of new national technical regulations or amendment, supplementation or replacement of national technical regulations according to an appropriate roadmap, ensuring quality management requirements corresponding to the risk levels of products and goods.
2. People’s Committees of provinces and centrally run cities shall organize the implementation of communication and dissemination and provide guidance to manufacturing and trading organizations and individuals in their localities on the implementation of this Circular; direct specialized agencies and relevant agencies to manage and inspect the quality of products and goods on the List of medium-risk and high-risk products and goods in accordance with law regulations; consolidate difficulties and problems arising during implementation and promptly report on them and make recommendations to the Ministry of Home Affairs for consideration, guidance or amendment and supplementation of the List in conformity with management practices.
3. Any problems arising in the course of implementation of this Circular should be promptly reported to the Ministry of Home Affairs for research and handling./.
