CIRCULAR

REGULATING ON

Pursuant to Decree No.189/2007/ND-CP dated December 27, 2007 of the Government on functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to Resolution No.59/NQ-CP dated December 17, 2010 of the Government on the simplification of administrative procedures under the management functions of the Ministry of Industry and Trade;

Minister of Industry and Trade amends, supplements and annuls a number of Articles regulating on administrative procedures in Decision No.24/2002/QĐ-BCN, dated June 17, 2002 by the Minister of Industry, issuing the Regulation on criteria of motorcycle-manufacturing or assembling enterprises, and in the Decision no.115/2004/QD-BCN, dated October 27, 2004 by the Minister of Industry, issuing the Regulation on criteria of automobile-manufacturing or assembling enterprises, as follows:

Article 1. To amend point a, clause 6 in the Regulation on criteria of motorcycles-manufacturing or assembling enterprises, issued together with Decision No.24/2002/QD-BCN, dated June 07, 2002 by the Minister of Industry, as follows:

Annul the phrase "and submit to the Ministry’s leaders for signing written certifications for enterprises. For the new enterprises, the Industry Ministry shall report to the Prime Minister before issuing written certifications.”

Article 2. To annul clause 2, Article 9 of the "Regulation on criteria of automobiles-manufacturing or assembling enterprises” issued together with Decision No.115/2004/QD-BCN, dated October 27, 2004 by the Minister of Industry on promulgating the Regulation on criteria of automobiles-manufacturing enterprises.

Article 3. Effect

This Circular takes effect from May 15, 2011.

Article 4. Responsibility for implementation

The Chief of the Ministry Office, the Chief inspector, the General Director of Heavy Industry Department, the heads of the units directly under the Ministry, Departments of Industry and Trade of the provinces and centrally-managed cities, and related organizations and individuals shall implement this Circular./.
