CIRCULAR
ON PROMULGATING THE LIST OF PERMISSIBLE AND BANNED PLANT PROTECTION DRUGS IN VIETNAM
Pursuant to the Government’s Decree No. 15/2017/ND-CP dated February 17, 2017 on defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Law on Plant Protection and Quarantine No. 41/2013/QH13 dated November 25, 2013;
At the proposal of the Director of Plant Protection Department;
The Minister of Agriculture and Rural Development hereby promulgates the List of permissible and banned plant protection drugs in Vietnam.
Article 1. To promulgate together with this Circular
1. A List of plant protection drugs permitted for use in Vietnam, Appendix I enclosed to this Circular, including:
a) Drugs used in agriculture:
- Insecticides: 850 active ingredients with 1757 trade names.
- Fungicides: 563 active ingredients with 1191 trade names.
- Herbicides: 235 active ingredients with 659 trade names.
- Rodenticides: 8 active ingredients with 26 trade names.
- Growth regulators: 52 active ingredients with 148 trade names.
- Insect baits: 8 active ingredients with 8 trade names.
- Snail pesticides: 33 active ingredients with 153 trade names.
- Supporting substances: 5 active ingredients with 6 trade names.
b) Termiticides: 15 active ingredients with 25 trade names.
c) Forest product preservatives: 7 active ingredients with 8 trade names.
d) Storage disinfectants: 4 active ingredients with 10 trade names.
dd) Agrochemicals for golf courses:
- Fungicides: 2 active ingredients with 2 trade names.
- Herbicides: 1 active ingredients with 1 trade names.
- Growth regulators: 1 active ingredients with 1 trade names.
e) Agrochemicals for seeds:
- Pesticides: 9 active ingredients with 14 trade names.
- Fungicides: 10 active ingredients with 11 trade names.
g) Harvested agricultural product preservatives:
- 01 active ingredients with 01 trade names.
2. A List of plant protection drugs banned from use in Vietnam, Appendix II enclosed to this Circular, including:
a) Insecticides and forest product preservatives: 23 active ingredients.
b) Fungicides: 6 active ingredients.
c) Rodenticides: 1 active ingredients.
d) Herbicides: 1 active ingredients.
3. The table of HS codes of plant protection drugs permitted for use and banned from use in Vietnam shall comply with Section 25 and Section 26 of the Appendix I attached to the Circular No. 15/2018/TT-BNNPTNT dated October 29, 2018 of the Minister of Agriculture and Rural Development on promulgating the List of goods under the management of the Ministry of Agriculture and Rural Development and relevant amending and supplementing documents.
Article 2. Transitional clauses
Plant protection drugs containing the active ingredients: Chlorpyrifos Ethyl and Fipronil shall only be manufactured and imported until February 12, 2020; only be traded and used until February 12, 2021.
Article 3. Effect
1. This Circular takes effect on November 05, 2019.
2. This Circular replaces the following Circulars:
a) Circular No. 03/2018/TT-BNNPTNT dated February 09, 2018 of the Minister of Agriculture and Rural Development on providing the List of permissible and banned plant protection drugs in Vietnam;
b) Circular No. 13/2018/TT-BNNPTNT dated October 08, 2018 of the Minister of Agriculture and Rural Development on amending and supplementing a number of articles of the Circular No. 03/2018/TT-BNNPTNT dated February 09, 2018 of the Minister of Agriculture and Rural Development on providing the List of permissible and banned plant protection drugs in Vietnam.
Article 4. Implementation responsibilities
1. The Chief of Ministry Office, Director General of the Plant Protection Department, Heads of affiliated units of Ministry, Directors of the Departments of Agriculture and Rural Development of provinces and centrally-run cities, relevant organizations and individuals shall be responsible for the implementation of this Circular.
2. Any difficulty and problem arising in the course of implementation should be promptly reported to the Ministry of Agriculture and Rural Development (via the Plant Protection Department) for consideration and settlement./.
