SUMMARY

To promulgate the List of insecticidal and germicidal chemicals and preparations

On April 27, 2018, the Ministry of Health promulgates the Circular No. 09/2018/TT-BYT on promulgating the List of insecticidal and germicidal chemicals and preparations for household and medical use which are under the state management of the ministry of health and whose HS codes can be identified according to Vietnam’s nomenclature of exports and imports.

Accordingly, the List of insecticidal and germicidal chemicals and preparations for household and medical use includes: Insecticidal incense for household and medical use such as Packaged mosquito coil, Packaged mosquito incense which is different from the mosquito coil, and Mosquito repellent mat (with or without electrical device);

Pursuant to the Government s Decree No. 75/2017/ND-CP dated June 20, 2017 on defining functions, tasks, powers and organizational structures of the Minister of Health;

Pursuant to the Government’s Decree No. 91/2016/ND-CP dated July 01, 2016 on management of insecticidal and germicidal chemicals and preparations for household and medical use;

At the request of the Director of Health Environment Management Agency – Ministry of Health;

The Minister of Health promulgates the Circular on promulgating the List of Insecticidal and Germicidal Chemicals and Preparations for household and medical use which are under the state management of the Ministry of Health and whose HS codes can be identified according to Vietnam’s Nomenclature of Exports and Imports.

Article 1. Promulgation of the list

Enclosed with this Circular is the List of Insecticidal and Germicidal Chemicals and Preparations for household and medical use which are under the state management of the Ministry of Health and whose HS codes can be assigned according to Vietnam’s Nomenclature of Exports and Imports. Such list is enclosed with the Circular No. 65/2017/TT-BTC dated June 27, 2017 of the Minister of Finance.

Article 2. Product quality management

1. The products specified in the List enclosed with this Circular are managed in accordance with the regulations in the Government s Decree No. 91/2016/ND-CP dated July 01, 2016 on management of insecticidal and germicidal chemicals and preparations for household and medical use.

2. While importing the products specified in the List which do not have assigned HS codes, the importer must provide full information about such products, their ingredients, effectiveness and technical documents (if any) for the customs authority. Also, they must assume responsibility for the declared contents and will use the imported products for declared purposes.

3. If the products do not have assigned HS codes and problems and differences arise while determining the HS codes specified in the enclosed List and Vietnam’s Nomenclature of Exports and Imports, the Ministry of Finance (the General Department of Customs) shall take charge and cooperate with the Ministry of Health (Agency of Administration of Environmental Health) in order to consider assigning their HS codes.

Article 3. Transitional provisions

For the products of which the customs procedures are completed before this Circular takes effect, the importer shall assign their HS codes according to the regulations in the Circular No. 12/2016/TT-BYT dated May 15, 2016 of the Ministry of Health.

Article 4. Terms of reference

If the legislative documents and the regulations specified in this Circular are amended or replaced, the new legislative documents shall be implemented.

Article 5. Implementation

1. This Circular takes effect on June 12, 2018.

2. The Circular 12/2016/TT-BYT dated May 15, 2016 of the Ministry of Health will expire from the date on which this Circular comes into effect.

3. The Agency of Administration of Environmental Health, Heads of the units affiliated to and under the Ministry of Health; the Health Departments of provinces and central-affiliated cities, as well as the related agencies, organizations and individuals shall implement this Circular.

During the implementation process, if any difficulty or problem arises, the agencies, organizations and individuals shall provide feedbacks to the Agency of Administration of Environmental Health (Ministry of Health) for consideration and decision-making./.
