CIRCULAR
On repealing a number of legal documents promulgated
by the Minister of Health

Pursuant to the Law on Promulgation of Legal Documents dated June 22, 2015; the Law on Amending and Supplementing a Number of Articles of the Law on Promulgation of Legal Documents dated June 18, 2020;
Pursuant to the Government’s Decree No. 34/2016/ND-CP dated May 14, 2016 detailing a number of articles of, and providing measures for implementing, the Law on Promulgation of Legal Documents; the Government’s Decree No. 154/2020/ND-CP dated December 31, 2020 amending and supplementing a number of articles of the Government’s Decree No. 34/2016/ND-CP dated May 14, 2016, detailing a number of articles of, and providing measures for implementing, the Law on Promulgation of Legal Documents;
Pursuant to the Government's Decree No. 95/2022/ND-CP dated November 15, 2022 on defining the functions, tasks, powers and organizational structure of the Ministry of Health;
At the proposal of Directors of Department of Legal Affairs, Department of Medical Equipment and Construction, Maternal and Child Health Department, and Agency of Traditional Medicine Administration,
The Minister of Health issues the Circular on repealing a number of legal documents promulgated by the Minister of Health.
Article 1. To repeal three (03) legal documents promulgated by the Ministry of Health
1. The Minister of Health’s Circular No. 03/2016/TT-BYT dated January 21, 2016 defining medicinal material business.
2. The Minister of Health’s Circular No. 31/2019/TT-BYT dated December 05, 2019, on requirements for fresh milk products in the Program on school milk.
3. The Minister of Health’s Circular No. 14/2020/TT-BYT dated July 10, 2020 providing for medical equipment bidding at public health establishments.
Article 2. Effect
This Circular takes effect on the signing date.
Article 3. Transitional provisions
For medical equipment bidding packages of which contractor selection plans have been approved before the effective date of this Circular, units shall continue to apply the Minister of Health’s Circular No. 14/2020/TT-BYT dated July 10, 2020 providing for medical equipment bidding at public health establishments or adjust relevant contents in accordance with current provisions on bidding.
Article 4. Implementation responsibility
Chief of Ministry Office, Chief of Ministry Inspectorate, Directors of Department of Medical Equipment and Construction, Maternal and Child Health Department, and Agency of Traditional Medicine Administration, Heads of units under the Ministry of Health, Directors of Departments of Health of provinces, cities, and relevant agencies, organizations and individuals shall be responsible for the implementation of this Circular./.
