CIRCULAR

Promulgating the List of prohibited chemicals and the List of hazardous chemicals subject to information disclosure in insecticidal and germicidal preparations for household and medical use

Pursuant to the Law on Chemicals No. 69/2025/QH15;

Pursuant to the Government’s Decree No. 42/2025/ND-CP defining the functions, tasks, powers and organizational structure of the Ministry of Health;

Pursuant to the Government's Decree No. 26/2026/ND-CP detailing, and guiding the implementation of, a number of articles of the Law on Chemicals regarding management of chemical activities and hazardous chemicals in products and goods;

At the proposal of the Director of the Agency for Disease Control;

The Minister hereby promulgates the Circular promulgating the List of prohibited chemicals and the List of hazardous chemicals subject to information disclosure in insecticidal and germicidal preparations for household and medical use.

Article 1. Scope of regulation

This Circular details and provides guidance for Clause 4 Article 15 and Clause 2 Article 31 of the Law on Chemicals, including the List of prohibited chemicals and the List of hazardous chemicals subject to information disclosure in insecticidal and germicidal preparations for household and medical use.

Article 2. Principles for chemical classification

Compliance with Article 7 of the Ministry of Industry and Trade’s Circular No. 01/2026/TT-BCT detailing and guiding the implementation of a number of articles of the Law on Chemicals and the Government’s Decree No. 26/2026/ND-CP detailing, and guiding the implementation of, a number of articles of the Law on Chemicals regarding management of chemical activities and hazardous chemicals in products and goods.

Article 3. Lists promulgated together with this Circular

1. Prohibited chemicals in insecticidal and germicidal preparations for household and medical use are provided in Appendix I to this Circular.

2. Hazardous chemicals subject to information disclosure in insecticidal and germicidal preparations for household and medical use are provided in Appendix II to this Circular.

Article 4. Effect

1. This Circular takes effect from May 15, 2026.

2. The Minister of Health’s Circular No. 11/2020/TT-BYT dated June 19, 2020, on promulgating the List of prohibited and restricted active ingredients in insecticidal and germicidal preparations for household and medical use, cease to be effective from the effective date of this Circular.

Article 5. Transitional provisions

For insecticidal and germicidal preparations for household and medical use containing hazardous chemicals listed in Appendix II to this Circular that have been granted valid circulation registration numbers before the effective date of this Circular, organizations and individuals producing or importing such preparations shall carry out information disclosure in accordance with Article 32 of the Law on Chemicals No. 69/2025/QH15 and Article 29 of the Government's Decree No. 26/2026/ND-CP detailing, and guiding the implementation of, a number of articles of the Law on Chemicals regarding management of chemical activities and hazardous chemicals in products and goods.

Article 6. Implementation responsibility

1. Based on practical requirements and management practices, the Agency for Disease Control shall propose to the Minister of Health for consideration and decision on amendments and supplements to the List of prohibited chemicals and the list of hazardous chemicals subject to information disclosure in insecticidal and germicidal preparations for household and medical use (if any).

2. Within 10 days from the date of issuance of a new circulation registration number for an insecticidal or germicidal preparation for household and medical use containing chemicals not included in the List provided in Appendix II to this Circular, the Department of Health of the province or centrally-run city shall submit a written report to the Ministry of Health (the Agency for Disease Control), enclosed with a copy of the dossier for new circulation registration of the preparation.

3. Organizations and individuals producing or importing insecticidal and germicidal preparations for household and medical use containing hazardous chemicals listed in Appendix II to this Circular shall carry out information disclosure in accordance with Article 32 of the Law on Chemicals No. 69/2025/QH15 and Article 29 of Decree No. 26/2026/ND-CP.

Any difficulties arising in the course of implementation should be promptly reported to the Ministry of Health (via the Agency for Disease Control) for consideration, amendment and supplement or timely guidance.
