SUMMARY

Before June 30, 2023, medical examination and treatment establishments must make e-prescriptions

On July 12, 2022, the Ministry of Health issues the Circular No. 04/2022/TT-BYT amending and supplementing a number of articles of the Minister of Health’s Circular No. 52/2017/TT-BYT dated December 29, 2017, Circular No. 18/2018/TT-BYT dated August 22, 2018, amending and supplementing a number of articles of Circular No. 52/2017/TT-NHNN, providing for prescription of modern drugs and bio-logical in outpatient treatment and the Minister of Health’s Circular No. 27/2021/TT-BYT dated December 20, 2021, providing regulations on prescribing drugs in electronic form.

Accordingly, medical examination and treatment establishments must make e-prescriptions under this Circular according to the specific roadmap as follows: For hospitals of level 3 and higher, completion before December 31, 2022; For other medical examination and treatment establishments, completion before June 30, 2023. As in previous regulations, such completion deadlines are before June 30, 2022 and December 01, 2022, respectively.

This Circular takes effect from September 15, 2022.

CIRCULAR

Amending and supplementing a number of articles of the Minister of Health’s Circular No. 52/2017/TT-BYT dated December 29, 2017, Circular No. 18/2018/TT-BYT dated August 22, 2018, amending and supplementing a number of articles of Circular No. 52/2017/TT-BYT, providing for prescription of modern drugs and bio-logical in outpatient treatment and the Minister of Health’s Circular No. 27/2021/TT-BYT dated December 20, 2021, providing regulations on prescribing drugs in electronic form

Pursuant to the Law on Pharmacy No. 105/2016/QH13 dated April 06, 2016;

Pursuant to the Government's Decree No. 75/2017/ND-CP dated June 20, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Health;

At the proposal of the Director of the Medical Services Administration and the Director of the Electronic Health Administration;

The Minister of Health hereby promulgates the Circular amending and supplementing a number of articles of the Minister of Health’s Circular No. 52/2017/TT-BYT dated December 29, 2017, Circular No. 18/2018/TT-BYT dated August 22, 2018, amending and supplementing a number of articles of Circular No. 52/2017/TT-BYT, providing for prescription of modern drugs and bio-logical in outpatient treatment and the Minister of Health’s Circular No. 27/2021/TT-BYT dated December 20, 2021, providing regulations on prescribing drugs in electronic form.

 

Article 1. Amending and supplementing a number of articles of the Minister of Health’s Circular No. 52/2017/TT-BYT dated December 29, 2017, Circular No. 18/2018/TT-BYT dated August 22, 2018, amending and supplementing a number of articles of Circular No. 52/2017/TT-BYT, providing for prescription of modern drugs and bio-logical in outpatient treatment (hereinafter referred to as Circular No. 52/2017/TT-BYT, and Circular No. No. 18/2018/TT-BYT), and the Minister of Health’s Circular No. 27/2021/TT-BYT dated December 20, 2021, providing regulations on prescribing drugs in electronic form (hereinafter referred to as Circular No. 27/2021/TT-BYT) as follows:

1. To amend Article 10 of Circular No. 52/2017/TT-BYT as follows:

“Article 10. E-prescribing

Medical examination and treatment establishments shall conduct e-prescribing in accordance with the Minister of Health’s Circular No. 27/2021/TT-BYT dated December 20, 2021, providing regulations on prescribing drugs in electronic form”.

2. To replace prescription forms provided in Appendices II and III to Circular No. 52/2017/TT-BYT and prescription forms promulgated together with Circular No. 18/2018/TT-BYT with prescription forms provided in Appendices to this Circular.

3. To amend Article 6 of Circular No. 27/2021/TT-BYT as follows:

“Article 6. Implementation roadmap

Medical examination and treatment establishments must make e-prescriptions under this Circular according to the specific roadmap as follows:

1. For hospitals of level 3 and higher: Completion before December 31, 2022.

2. For other medical examination and treatment establishments: Completion before June 30, 2023.”

Article 2. Effect

This Circular takes effect from September 15, 2022.

Article 3. Transitional provisions

Medical examination and treatment establishments specified in Clause 2 Article 6 of Circular No. 27/2021/TT-BYT that are using paper prescriptions according to the form provided in Circular No. 52/2017/TT-BYT and Circular No. 18/2018/TT-BYT may continue using their printed paper prescriptions according to the roadmap prescribed in Clause 3 Article 1 of this Circular.

Article 4. Implementation responsibility

Directors of Medical Services Administration, Electronic Health Administration, Chief of the Ministry Office, Chief of Ministry Inspectorate, Directors and Directors General of Departments and Administrations of the Ministry of Health, Heads of units affiliated to the Ministry of Health, relevant organizations and individuals shall implement this Circular/.
