CIRCULAR
Guiding the adjustment of monthly allowance levels applicable to officials of communes, wards and townships having resigned the work under the Decision No. 130-CP dated June 20, 1975 of the Government Council and Decision No. 111-HDBT dated October 13, 1981 of Council of Ministers from January 01, 2022

Pursuant to the Government’s Decree No. 34/2017/ND-CP dated April 03, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Home Affairs;
Pursuant to Clause 2 Article 4 of the Government’s Decree No. 108/2021/ND-CP dated December 07, 2021, prescribing the adjustment of pension, social insurance allowance and monthly allowance;
At the proposal of the Director of the Wage Department;
The Minister of Home Affairs promulgates the Circular guiding the adjustment of monthly allowance levels applicable to officials of communes, wards and townships having resigned the work under the Decision No. 130-CP dated June 20, 1975 of the Government Council and Decision No. 111-HDBT dated October 13, 1981 of Council of Ministers from January 01, 2022.
Article 1. Subjects of application
Subjects of application of this Circular are officials of communes, wards and townships that have resigned the work and are enjoying the monthly allowance in accordance with the Decision No. 130-CP dated June 20, 1975 of the Government Council and Decision No. 111-HDBT dated October 13, 1981 of Council of Ministers (hereinafter referred to as commune-level elderly officials having resigned the work).
Article 2. Adjustment of monthly allowance levels
From January 01, 2022, monthly allowance levels for commune-level elderly officials having resigned the work as specified in Article 2 of the Government’s Decree No. 108/2021/ND-CP dated December 07, 2021, prescribing the adjustment of pension, social insurance allowance and monthly allowance shall be adjusted as follows:
1. The amount of monthly allowances shall increase by 7.4% compared to the allowance amount of December 2021 according to the formula as follows:
The amount of monthly allowance from January 01, 2022 | = | The allowance amount of December 2021 | x 1.074 |
In which: The allowance amount of December 2021 is the amount specified in Clause 2 Article 2 of the Circular No. 09/2019/TT-BNV dated June 14, 2019 of the Minister of Home Affairs guiding the adjustment of monthly allowance levels applicable to commune-level officials having resigned the work under the Decision No. 130-CP dated June 20, 1975 of the Government Council and Decision No. 111-HDBT dated October 13, 1981 of the Council of Ministers from July 01, 2019.
2. After the adjustment specified in Clause 1 of this Article, the amount of monthly allowance for commune-level elderly officials having resigned the work that is less than VND 2,500,000/person/month shall be additionally increased as follows:
a) Those whose monthly allowance is less than VND 2,300,000 shall receive an additional VND 200,000/person/month;
b) Those whose monthly allowance is from VND 2,300,000 to less than VND 2,500,000 shall receive a monthly allowance of VND 2,500,000/person/month.
3. Based on Clauses 1 and 2 of this Article, the amount of monthly allowances payable to commune-level elderly officials having resigned the work from January 01, 2022 (after the rounding) shall be as follows:
a) For officials that were Secretaries of Party Committees, Chairpersons of People’s Committees of communes: VND 2,473,000/month;
b) For officials that were Deputy Secretaries, Deputy Chairpersons, standing members of Party Committees, Secretaries of People’s Committees, Secretaries of People’s Councils of communes, Heads of commune-level military commands, Chiefs of Commune Polices: VND 2,400,000/month;
c) For others: VND 2,237,000/month.
Article 3. Organization of implementation
1. People's Committees of provinces and centrally-run cities shall organize the payment of monthly allowance from January 01, 2022 in accordance with the guidance in this Circular for subjects under their management.
2. Sources of funding for adjustments to monthly allowance levels for the commune-level elderly officials having resigned the work shall comply with Clause 1 Article 3 of the Government’s Decree No. 108/2021/ND-CP dated December 07, 2021, prescribing the adjustment of pension, social insurance allowance and monthly allowance.
Article 4. Effect
1. This Circular takes effect on March 15, 2022.
2. The regimes specified in this Circular shall be applied from January 01, 2022.
3. This Circular replaces the Circular No. 09/2019/TT-BNV dated June 14, 2019 of the Minister of Home Affairs guiding the adjustment of monthly allowance levels applicable to commune-level officials having resigned the work under the Decision No. 130-CP dated June 20, 1975 of the Government Council and Decision No. 111-HDBT dated October 13, 1981 of Council of Ministers from July 01, 2019.
Any problem arising in the course of implementation should be promptly reported to the Ministry of Home Affairs for research and handling./.
