THE MINISTRY OF LABOR, WAR INVALIDS AND SOCIAL AFFAIRS
Circular No. 02/2017/TT-BLDTBXH dated February 20, 2017 of the Ministry of Labor - Invalids and Social Affairs guiding organization of the action month on occupational safety and hygiene
Pursuant to the Law No. 84/2015/QH dated June 25, 2015on Occupational Safety and Health;
Pursuant to the Decree No. 106/2012/ND-CP of December 20, 2012, defining the functions, tasks, powers and organizational structure of the Ministry of Labor, War Invalids and Social Affairs;
Pursuant to the Decision No. 87/QD-TTg dated January 12, 2016 on organization of month action onoccupational safety and health;
At the proposal of the Director of Occupational Safety Department;
Minister of Labor and Social Affairs promulgates the Circular guiding organization of the action month on occupational safety and hygiene;
Article 1.Scope of adjustment
The Circular guides organization of the action month on occupational safety and hygiene annually.
Article 2.Subject of application
This Circular is applied for state competent agencies on occupational safety and hygiene at all levels; business establishments; organizations, individuals related to occupational safety and hygiene.
Article 3.Theme of the Action Month on occupational safety and hygiene
Annually, the Ministry of Labor, Invalids and Social Affairs shall base on actual situations and status of labor accidents to build the general theme of the Action Month on occupational safety and hygiene. Ministries, sectors, localities and business establishments may select their own themes to be in accordance with economic and social conditions and current situations on occupational safety and hygiene of ministries, sectors, localities,
Theme of the Action Month on occupational safety and hygiene must be short, easy to understand, attached with specific objectives and contain messages that encourage action and raise awareness of complying with the law on occupational safety and hygiene, tend to key issues on occupational safety and hygiene that attract interest of businesses and the community.
Article 4.Content of the Action Month for occupational Safety and Health
Focusing on organization and implementation of specific activities to implement themes of the Action Month for occupational Safety and Health; regulations of the Law on occupational safety and hygiene; objectives on improving working conditions, reduction on labor accidents, occupational disease and developing culture at workplace;
Encouraging on combining activities in the Action Month for occupational safety and hygiene with activities of protecting environment, prevention of climate change, fire prevention, activities of the Worker Month;
The main activities shall be held in the Action Month including:
1. At the Ministry, sector and local:
a) Organize activities on occupational safety and hygiene
- Build and deliver messages to implement themes and contents of the Action Month on occupational safety and hygiene; providing documents and information related to themes, contents of the Action Month to communication agencies; organizing activities on communication and propaganda on newspapers, radio, internet, mobile phone and social networks.
- Build guidelines, documents, communication product sample; print and publish banners; guide on skills and procedures on working safely to laborers;
b) Organize the launching ceremony on the Action Month for occupational safety and hygiene.
The launching ceremony on the Action Month for national occupational safety and hygiene shall be held in a local and the Ministry of Labor, Invalids and Social Affairs shall coordinate with ministries, sectors, localities to organize the launching ceremony;
Ministries, sectors and localities shall organize the launching ceremony or specific activities to support the Action Month in accordance with conditions;
Representatives of the Party, Government, agencies, organizations and associations shall participate in the launching ceremony; representatives of enterprises, laborers, students in the areas shall participate in the ceremony too;
The program of the launching ceremony shall include the main contents as follows: general information on occupational safety and hygiene, labor accidents, occupational diseases; launching and inspiring messages in the Action month for occupational safety and hygiene; commending on occupational safety and hygiene;
c) Examination and inspection on occupational safety and hygiene
Organizing inspection teams to inspect on occupational safety and hygiene. Contents of inspection shall focus on requirements and directions in the theme of the Action Month; regulations on occupational safety and hygiene; sectors and jobs that contain potentials or risk on labor accidents and occupational diseases;
d) Propaganda campaigns on occupational safety and hygiene.
Annually or in each period, sectors and localities shall propaganda campaigns on occupational safety and hygiene in the Action Month to encourage the implementation of the Law on occupational safety and hygiene in agencies, units, business establishments and community.
Contents of campaigns shall tend to objectives and solutions on improvement of working conditions, reduction in labor accidents and occupational diseases; encourage prevention and working disciplines at workplace;
dd) Commending on occupational safety and hygiene
Ministries, sectors, localities shall base on the Law on Emulation and Commendation and actual situations of agencies to commend on occupational safety and hygiene to individuals and agencies that are excellent on occupational safety and hygiene in the Action Month for occupational safety and hygiene;
For forms of commendation on occupational safety and hygiene under the competence of the Ministry of Labor and Social Affairs or propose the Government to commend on occupational safety and hygiene: Ministries, sectors, localities, business establishments shall prepare documents as stipulated and send to the Ministry of Labor - Invalids and Social Affairs (to Department of Occupational Safety) before January 30;
e) Organize special subjects on occupational safety and hygiene
Organize special subjects on occupational safety and hygiene in accordance with specific conditions such as: organizing dialogues on policy, conference on occupational safety and hygiene; organizing consulting activities, training professions and skills on occupational safety; checking heath for laborers;
g) Organizing some other activities such as: encouraging victims and families whose victims are occupationally injured; organizing culture exchange on contents of occupational safety and hygiene; visiting models and significant business establishments in occupational safety and hygiene;
2. For business establishments:
Maintain activities on occupational safety and hygiene as stipulated by the law and focus on the following contents:
a) Build and implement specific programs on occupational safety and hygiene in business establishments;
b) Build and supplement regulations and working procedures on occupational safety and hygiene; examining and reviewing risks on occupational safety and hygiene for equipment, each team to prepare measurements and handle with risks on labor accidents, occupational diseases.
c) Review, organize training sessions on occupational safety and hygiene in accordance with each group as stipulated by the law; provide information and guide laborers how to judge risks on occupational safety and hygiene; testing machines, equipment that are strictly required on occupational safety and hygiene.
d) Check health on occupational diseases and observing working environment
dd) Organize practical activities, demonstrating on dealing with technical problems on occupational safety and hygiene; organizing competition on improving workplace and reducing labor accidents, occupational diseases; signing obligations on occupational safety and hygiene in each groups in accordance with specific conditions of units.
e) Encourage corporations, business establishments to organize the launching ceremony to support the Action Month on occupational safety and hygiene in units; commending individuals and units that are excellent on occupational safety and hygiene; encouraging victims and families whose victims are occupational injured; exchanging culture to propaganda on occupational safety and hygiene in accordance with conditions of establishments;
Article 5. Time of organization
The Action Month for occupational safety and hygiene shall be held annually from 01 to 31 of May;
The launching ceremony for occupational safety and hygiene shall be held annually within 1 day during the First to the fifth of May;
Article 6. Implementation organization
1. Ministry of Labor, Invalids and Social Affairs:
a) Guide implementation of action month on occupational Safety and Health and fire prevention;
b) Assume the prime responsibility of, and coordinate with the Ministry of Health, Vietnam General Confederation of Labor, ministries and sectors to reach an agreement on plans, selection of localities, themes, contents and organization form to launch month of action for occupational Safety and Health and some other national important activities as guided under Clause 1 Article 4 of this Circular.
c) Inspire messages, documents in the Month of Action for occupational safety and hygiene to localities, business establishments and post on the website of Department of occupational safety athttp://www.antoanlaodong.gov.vnand Portal of the Ministry of Labor and Social Affairs athttp://www/molisa.gov.vn; coordinate with communication agencies to propaganda on themes, contents of the Action Month;
d) Summarize results of the Action Month of ministries, sectors, localities in nationwide and report to the Prime Minister.
2. Other ministries, sectors and agencies:
a) Related ministries, sectors shall build and promulgate plans and organize activities to support the Action Month for occupational Safety and Health; coordinate with the Ministry of Labor, Invalids and Social Affairsto hold the launching ceremony for occupational Safety and Health; guide units under its scope of management to support the Action Month; Summarize and judge results of implementation of the Action Month for occupational safety and hygiene.
b) Propose Vietnam General Confederation of Labor, Vietnam Chamber of Commerce and Industry, Vietnam Cooperative Alliance, Vietnam Farmer’s Union to cooperate on organizing the launching ceremony of the Action month for occupational safety and hygiene, building programs, plans and organize and guide units under its management to implement activities in the Action Month; Summarize and judge results of implementation the Action Month for occupational safety and hygiene.
3. People’s Committee at levels
a) Build and promulgate plans and guide implementation the Action Month for occupational Safety and Health at localities;
b) Direct and assign specific tasks to departments, sectors at localities to implement activities to support the Action Month foroccupational Safety and Health to districts, communes; examine and judge the implementation at units under its management;
c) Allocate funds to organize activities to support the Action Month that is in accordance with conditions of localities as guided under Clause 1 Article 4 of this Circular, of which pay attention to deal with key issues that exist on occupational safety and hygiene at localities;
d) Organize activities to propaganda and educate on occupational safety and hygiene in accordance with themes of the Action Month and conditions of localities, especially subjects who are laborers working at localities that are not following with labor contracts; delivering flyers, documents, guidelines on procedures of occupational safety to laborers at public places.
4. Department of Labor, Invalids and Social Affairs at provinces, cities under the central management and District Department of Labor and Social Affairs
a) Assume the prime responsibility of, and coordinate with the provincial board of occupational safety and hygiene and other related agencies to consult the People’s Committee on directing and promulgating plans on implementing the Action Month for occupational safety and hygiene at localities.
b) Build programs, plans and organize activities to support for the Action Month for occupational safety and hygiene at localities.
c) Build documents to guide on communication in the Action Month and publish to the business establishments, laborers;
d) Summarize, report results of implementing the Action Month for occupational safety and hygiene.
5. Corporations, business establishments:
a) Based on contents of operation as stipulated under Clause 2 Article 4 of the Circular building plans, contents of activities and details on cost estimation to implement the Action Month for occupational safety and hygiene in accordance with the actual situation of units;
b) Direct and guide units to organize activities to support the Action Month for occupational safety and hygiene;
c) Summarize, judge and report results of implementation of the Action Month for occupational safety and hygiene to competent agencies;
Article 7. Reporting regime
1. Business establishments, Department of Labor, Invalids and Social Affairs shall report the implementation of action month on occupational safety and hygiene and fire prevention to the provincial Department of Labor, Invalids and Social Affairs before July 15 according to the Form as stipulated under the Appendix of this Circular.
2. Ministries, sectors, corporations, Local Department of Labor, Invalids and Social Affairs shall summarize reports on implementation of occupational safety and hygiene and fire prevention to Ministry of Labor, Invalids and Social Affairs before July 30 according to the Form as stipulated under the Appendix of this Circular.
Article 8. Implementation provisions
This Circular takes effect of April 06, 2017 and replaces organization of national week on occupational safety and hygiene and fire prevention according to the guidelines No. 4280/BCDTLQG-ATLD dated November 30, 2006 on fire prevention.
In the course of implementation, any arising difficulties should be promptly reported to the Ministry of Labor, Invalids and Social Affairs.
