Amending and supplementing a number of articles of the Government’s Decree No. 20/2021/ND-CP dated March 15, 2021 providing social assistance policies for social protection beneficiaries

Pursuant to the Law on Organization of the Government dated June 19, 2015; Law on Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on Prevention and Control of Infection with Human Immunodeficiency Virus (HIV/AIDS) dated June 29, 2006;

Pursuant to the Law on the Elderly dated November 23, 2009;

Pursuant to the Law on Persons with Disabilities dated June 17, 2010;

Pursuant to the Law on Natural Disaster Prevention and Control dated June 19, 2013; Law Amending and Supplementing a Number of Articles of the Law on Natural Disaster Prevention and Control and the Law on Dykes dated June 17, 2020;

Pursuant to the Law on the State Budget dated June 25, 2015;

Pursuant to the Law on Children dated April 5, 2016;

Pursuant to the National Assembly’s Resolution No. 142/2024/QH15 dated June 29, 2024 on the 7^th session of the XV^th National Assembly;

At the proposal of the Minister of Labor, Invalids and Social Affairs;

The Government promulgates the Decree amending and supplementing a number of articles of the Government’s Decree No. 20/2021/ND-CP dated March 15, 2021 providing social assistance policies for social protection beneficiaries.

Article 1. Amending and supplementing a number of articles of the Government’s Decree No. 20/2021/ND-CP dated March 15, 2021 providing social assistance policies for social protection beneficiaries

1. To amend and supplement Clause 2 Article 4 as follows:

“2. The standard social assistance level applied from July 1, 2024 is VND 500,000/month.

Depending on the balancing capacity of the budget, the rate of increase in consumer prices and the living situation of the social protection beneficiaries, the competent authorities shall consider and increase the standard social assistance level to be suitable; ensuring policy correlation with other subjects.”

2. To amend and supplement Clause 3 Article 4 as follows:

“3. In case of favorable local socio-economic conditions, the provincial-level People’s Committees shall submit the People’s Councils at the same level to decide on:

a) The standard social assistance level and the social assistance levels applied in the localities, which is higher than the standard social assistance level and the social assistance levels prescribed in this Decree;

b) Other disadvantaged subjects, which are not specified in this Decree, to be entitled to social assistance policies.

Article 2. Implementation provisions

1. This Decree takes effect on July 01, 2024.

2. Regimes and policies of social assistance defined in Clause 1 Article 6, Clause 2 Article 11, Clause 1 Article 13, Clauses 1 and 2 Article 14, Clause 1 Article 19, Clauses 1 and 2 Article 20, Clauses 1 and 3 Article 25 and other relevant provisions of the Government’s Decree No. 20/2021/ND-CP dated March 15, 2021 providing social assistance policies for social protection beneficiaries shall apply the standard social assistance level defined in Clause 1 Article 1 of this Decree from July 01, 2024.

3. Beneficiaries of regimes and policies of social assistance under the Government’s Decree No. 20/2021/ND-CP dated March 15, 2021 providing social assistance policies for social protection beneficiaries shall be entitled to regimes and policies of social assistance according to the standard social assistance level defined in this Decree from July 1, 2024.

4. Chairpersons of district-level People's Committees shall direct the authorities to review the list of beneficiaries of the policy and decide the payment according to the standard social assistance level specified in this Decree from July 1, 2024.

5. Heads of social protection establishments and social houses shall synthesize and report to competent agencies to ensure funding and organize the implementation of care and nurture regimes according to the standard social assistance level specified in this Decree from July 01, 2024.

Article 3. Implementation responsibility

Minister of Labor, Invalids and Social Affairs, Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of People’s Committees of provinces and centrally run cities shall be responsible for the implementation of this Decree.
