RESOLUTION

On the recognition of the period of compulsory social insurance premium payment by business household owners who participated in social insurance before the effective date of the Law on Social Insurance No. 41/2024/QH15

THE NATIONAL ASSEMBLY STANDING COMMITTEE

Pursuant to the Constitution of the Socialist Republic of Vietnam;

Pursuant to the Law on Organization of the National Assembly No. 57/2014/QH13, which had a number of articles amended and supplemented under Law No. 65/2020/QH14 and Law No. 62/2025/QH15;

Pursuant to the National Assembly's Resolution No. 142/2024/QH15 dated June 29, 2024, on the 7^th session of the XV^th National Assembly;

After consideration of the Government’s Submission No. 177/TTr-CP dated April 9, 2025; and Appraisal Report No. 436/BC-UBVHXH15 dated May 15, 2025, of the Committee for Culture and Society;

RESOLVES:

Article 1. Recognition of the period of compulsory social insurance premium payment by business household owners

1. The period during which business household owners paid compulsory social insurance premiums before July 1, 2025, shall be recognized as the basis for settlement of social insurance benefits in accordance with the law on social insurance.

2. Business household owners who satisfied the conditions of eligibility for social insurance benefits before the effective date of this Resolution shall be entitled to receive social insurance benefits from the date on which they satisfies the eligibility conditions as prescribed.

Article 2. Implementation organization

1. The Government is assigned to:

a) Direct and guide the implementation of this Resolution; take initiative in resolving arising obstacles in the implementation process; and ensure the entitlement of business household owners in the settlement of social insurance benefits;

b) Report the implementation results of this Resolution in the report on the implementation of social insurance policies and regimes and the management and use of the social insurance fund as prescribed by the Law on Social Insurance.

2. The Ethnic Council and Committees of the National Assembly, National Assembly delegations, National Assembly deputies, and the Central Committee of the Vietnam Fatherland Front shall, within the ambit of their duties and powers, supervise the implementation of this Resolution.

Article 3. Effect

This Resolution takes effect from July 1, 2025.
