SUMMARY

Permit the use of unused drugs for COVID-19 prevention to serve medical examination, treatment

On August 18, 2023, the Government issues Resolution No. 129/NQ-CP on transfer of drugs, supplies and biological products purchased by state budget fund for Covid-19 prevention and control to revenues of medical examination and treatment services. To be specific:

1. Permit medical examination and treatment facilities to use unused drugs, supplies, and biological products purchased by the state budget for COVID-19 prevention and control to serve medical examination and treatment for the purpose of minimizing waste.

2. For drugs, supplies and biological products purchased by the state budget for COVID-19 prevention and control that are on the list drugs, supplies and products covered by the health insurance fund:

- For patients with health insurance cards: Medical examination and treatment facilities are only allowed to pay and collect from the patients’ co-payment equal to the buying price under the bidding law which is not higher than the price paid by the social security agencies to medical examination and treatment facilities.

- For people without health insurance cards: Medical examination and treatment facilities are only allowed to collect from patients an amount equal to the buying price under the bidding law which is not higher than the price paid by the social security agencies to medical examination and treatment facilities.

3. For drugs, supplies, and biological products purchased by the state budget for COVID-19 prevention and control not included in the list of drugs, supplies, and biological products covered by the health insurance fund: Medical examination and treatment facilities are only allowed to collect from patients an amount equal to the buying price in accordance with the bidding law.

This Resolution takes effect from the date of its signing until December 31, 2023.

RESOLUTION

On transfer of drugs, supplies and biological products purchased by state budget fund for Covid-19 prevention and control to revenues of medical examination and treatment services

THE GOVERNMENT

 

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to Resolution No. 30/2021/QH15 dated July 28, 2021, of the XVth National Assembly at its 1st session;

Pursuant to Resolution No. 80/2023/QH15 dated January 9, 2023, of the XVth National Assembly at its 2nd session;

Pursuant to Resolution No. 99/2023/QH15 dated June 24, 2023, of the XVth National Assembly at its 5th session;

Pursuant to the Government’s Decree No. 39/2022/ND-CP dated June 18, 2022, promulgating the working regulation of the Government;

At the proposal of the Minister of Health and unanimous opinion of the Government Members.

 

RESOLVES:

 

Due to the recent outbreak of COVID-19, some localities and medical facilities had purchased drugs, supplies, and biological products with the quantity higher than actual needs by the state budget for emergency and treatment of COVID-19 patients. However, the situation of the COVID-19 epidemic is under control, so the use of drugs, supplies, and biological products for COVID-19 prevention and control is no longer necessary. Therefore, the Government resolves:

Article 1. To permit medical examination and treatment facilities to use unused drugs, supplies, and biological products purchased by the state budget for COVID-19 prevention and control to serve medical examination and treatment for the purpose of minimizing waste.

Article 2. Principles of payment and remittance into the budget

1. Principles of payment when using for medical examination and treatment

a) For drugs, supplies and biological products purchased by the state budget for COVID-19 prevention and control that are on the list drugs, supplies and products covered by the health insurance fund:

- For patients with health insurance cards: Medical examination and treatment facilities are only allowed to pay and collect from the patients’ co-payment equal to the buying price under the bidding law which is not higher than the price paid by the social security agencies to medical examination and treatment facilities from the effective date of this Resolution.

- For people without health insurance cards: Medical examination and treatment facilities are only allowed to collect from patients an amount equal to the buying price under the bidding law which is not higher than the price paid by the social security agencies to medical examination and treatment facilities from the effective date of this Resolution.

From the effective date of this Resolution, medical examination and treatment facilities failing have prices paid by the health insurance fund shall base on the prices paid by the health insurance fund to other medical examination and treatment facilities in the same province/centrally-run city. In case the prices paid by the health insurance fund for other medical facilities in the same province/centrally-run city are unavailable, they may base on the buying price in accordance with the law on bidding.

b) For drugs, supplies, and biological products purchased by the state budget for COVID-19 prevention and control not included in the list of drugs, supplies, and biological products covered by the health insurance fund: Medical examination and treatment facilities are only allowed to collect from patients an amount equal to the buying price in accordance with the bidding law.

2. The amount collected by medical examination and treatment facilities shall be remitted into the state budget in accordance with the law on state budget.

Article 3. Implementation organization

1. The Ministry of Health, People's Committees of provinces and centrally-run cities shall:

a) Direct medical examination and treatment facilities to proactively review the quantity of unused drugs, supplies and biological products purchased by the state budget to prioritize serving the work of epidemic prevention and control and transfer to use between medical examination and treatment facilities for COVID-19 prevention and control for the purpose of minimizing waste.

b) Guide medical examination and treatment facilities to coordinate with the social security agencies in making payment and settlement according to regulations and remit the collected amount to the state budget.

c) Direct provincial-level Departments of Health and competent agencies to inspect and supervise the implementation related to prices, payment and settlement in an effective manner in accordance with laws, avoiding negativity, loss, or waste.

2. Vietnam Social Security shall direct social security agencies of provinces and centrally-run cities to coordinate with provincial-level Departments of Health and medical examination and treatment facilities to implement this Resolution.

Article 4. Implementation provisions and responsibilities

1. This Resolution takes effect from the date of its signing until December 31, 2023.

2. Ministers, Heads of ministerial-level agencies, Heads of Government-attached agencies, Chairpersons of People's Committees of provinces and centrally-run cities shall implement this Resolution.
