CIRCULAR
Prescribing economic and technical specifications of milk products and functional foods for under-6 children which are subject to price valorization and declaration

Pursuant to the Law on Price dated June 19, 2023;
Pursuant to the Government’s Decree No. 85/2024/ND-CP dated July 10, 2024, detailing a number of articles of the Law on Price;
Pursuant to the Government’s Decree No. 95/2022/ND-CP dated November 15, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Health;
At the proposal of the Director of the Vietnam Food Administration;
The Minister of Health hereby promulgates the Circular prescribing economic and technical specifications of milk products and functional foods for under-6 children which are subject to price valorization and declaration.
Article 1. Scope of regulation
This Circular prescribes milk products and functional foods, and economic and technical specifications of milk products and functional foods for under-6 children which are subject to price valorization and declaration.
Article 2. Milk products and functional foods for under-6 children which are subject to price valorization and declaration
1. Milk products for under-6 children which are subject to price valorization and declaration include:
a) Nutritional formula products for children aged up to 36 months stipulated in the National Technical Regulations issued by the Ministry of Health;
b) Milk and nutrition products containing the animal nutrition in form of milk powder or milk liquid published to use for under-6 children but do not comply with the National Technical Regulations issued by the Ministry of Health or line ministries.
2. Functional foods for under-6 children which are subject to price declaration include:
a) Health supplements;
b) Medical food (food for special medical purposes);
c) Dietary supplements;
d) Food for special dietary uses (milk-free).
Article 3. Economic and technical specifications of milk products and functional foods for under-6 children which are subject to price valorization and declaration
Milk products and functional foods for under-6 children which are subject to price valorization and declaration must have the following economic and technical specifications:
1. Product name (detailed name);
2. Product classification;
3. Product form (dosage form/use form);
4. Product declaration registration receipt number or product self-declaration number.
Article 4. Effect
1. This Circular takes effect from January 1, 2025.
2. The Ministry of Health’s Circular No. 30/2013/TT-BYT dated October 4, 2013, promulgating the list of milk products for children under 6 years old, which pertain to goods subject to price stabilization, and the Ministry of Health’s Circular No. 22/2018/TT-BYT dated September 12, 2018, prescribing the list of functional foods for under-6 children which are subject to price declaration, cease to be effective from the effective date of this Circular.
Article 5. Implementation organization
1. Provincial-level People's Committees shall be responsible for organizing the receipt of price declaration in accordance with the law on price, ensuring convenience for declarants.
2. The Vietnam Food Administration under the Ministry of Health shall issue a written request to the agencies assigned to receive price declarations by provincial-level People’s Committees to send the declared prices to the Ministry of Health (via the Vietnam Food Administration) to assess the level of fluctuations in market prices and develop price valorization reports.
3. Organizations and individuals declaring milk products and functional foods for under-6 children in the declaration dossiers and on product labels (including products declared for use by multiple age groups, including children under 6 years old) shall send price declaration documents to the agencies assigned to receive price declarations by the provincial-level People's Committees under Clause 1 Article 17 and Clause 2 Article 18 of the Government's Decree No. 85/2024/ND-CP dated July 10, 2024, detailing a number of articles of the Law on Price.
4. The Vietnam Food Administration under the Ministry of Health shall assume prime responsibility for, and coordinate with relevant units in, guiding and organizing the implementation of this Circular.
Any difficulties arising in the course of implementation should be reported to the Ministry of Health (the Vietnam Food Administration) for consideration and settlement./.
