DECISION
Providing the roadmap for application of exhaust emission standards to manufactured, assembled and imported motor vehicles

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;
Pursuant to the Law on Road Traffic Order and Safety dated June 27, 2024;
Pursuant to the Law on Environmental Protection dated November 17, 2020;
At the proposal of the Minister of Transport;
The Government hereby promulgates the Decision providing the roadmap for application of exhaust emission standards to manufactured, assembled and imported motor vehicles.
Article 1. Scope of regulation
1. This Decision provides the roadmap for application of exhaust emission standards to motor vehicles imported, manufactured and assembled in Vietnam, that are fitted with combustion engines.
2. This Decision does not apply to:
a) Motor vehicles under the management of the Ministry of National Defence, and the Ministry of Public Security that are used for national defense and security purposes;
b) Motor vehicles imported or manufactured, assembled in Vietnam for scientific research; research serving production; display, introduction at fairs, trade exhibitions;
c) Motor vehicles manufactured and assembled for export;
d) Motor vehicles imported under the provisions of treaties to which Vietnam is a contracting party, which provide different provisions, shall comply with such treaties;
dd) Motor vehicles designed with special structures not for the purpose of participating in road traffic; three-wheeled motor vehicles, three-wheeled mopeds for the disabled;
e) Automobiles manufactured and assembled from base-model automobiles (from incomplete or complete automobiles) that have been certified for technical safety and environmental protection quality.
Article 2. Subjects of application
This Decision applies to organizations and individuals involved in the import, manufacturing and assembly of motor vehicles that are fitted with combustion engines.
Article 3. Interpretation of terms
1. Emission standards (Tier 2, Tier 3, Tier 4 and Tier 5) applicable to manufactured, assembled and imported brand-new vehicles specified in this Decision are those corresponding to the emission standards (Euro 2, Euro 3, Euro 4 and Euro 5) of the United Nations Economic Commission for Europe (UNECE) and the Directive of the European Commission (EC) on type approval of motor vehicles.
2. Emission standards (Tier 1, Tier 2, Tier 3 and Tier 4) applicable to imported used vehicles specified in this Decision are the limits of pollutant components in exhaust emission prescribed in TCVN 6438:2018 and Amendment 1:2021 TCVN 6438:2018 - “Road vehicles - Maximum permitted limits of exhaust gases”.
3. The emission standard of “zero” (Tier 0) prescribed in this Decision is the level showing the emission from the engine of a motor vehicle not containing pollutants that are limited within the emission standards specified in Clause 1 and Clause 2 of this Article.
Article 4. Roadmap for application of exhaust emission standards
1. The roadmap for application of exhaust emission standards to manufactured, assembled and imported brand-new motor vehicles
a) Tier 5 exhaust emission standard specified in Clause 1 Article 3 of this Decision shall continue to be applied to manufactured, assembled and imported brand-new automobiles from January 1, 2025;
b) Tier 2 exhaust emission standard specified in Clause 1 Article 3 of this Decision shall continue to be applied to manufactured, assembled and imported brand-new two-wheeled mopeds from January 1, 2025, to the end of June 30, 2027;
c) Tier 3 exhaust emission standard specified in Clause 1 Article 3 of this Decision shall continue to be applied to manufactured, assembled and imported brand-new motorcycles from January 1, 2025, to the end of June 30, 2026;
d) Tier 4 exhaust emission standard specified in Clause 1 Article 3 of this Decision shall be applied to manufactured, assembled and imported brand-new two-wheeled mopeds from July 1, 2027;
dd) Tier 4 exhaust emission standard specified in Clause 1 Article 3 of this Decision shall be applied to manufactured, assembled and imported brand-new motorcycles from July 1, 2026;
e) Tier 0 exhaust emission standard specified in Clause 3 Article 3 of this Decision shall be applied to four-wheeled motorized passenger vehicles and four-wheeled motorized cargo vehicles that are newly imported, manufactured and assembled, from January 1, 2026;
g) Tier 0 exhaust emission standard specified in Clause 3 Article 3 of this Decision shall be applied to three-wheeled motor vehicles and three-wheeled mopeds that are newly imported, manufactured and assembled, from January 1, 2026.
2. The roadmap for application of exhaust emission standards to imported used motor vehicles
a) Tier 4 exhaust emission standard specified in Clause 2 Article 3 of this Decision shall be applied to imported used automobiles from January 1, 2025;
b) Tier 0 exhaust emission standard specified in Clause 3 Article 3 of this Decision shall be applied to imported used four-wheeled motorized passenger vehicles and four-wheeled motorized cargo vehicles from January 1, 2026.
Article 5. Implementation organization
1. The Ministry of Transport shall:
a) Assume the prime responsibility for implementing this Decision; act as a focal point to conduct the inspection and supervision of the compliance with exhaust emission standards applicable to motor vehicles specified in this Decision by importing facilities, manufacturing and assembling facilities;
b) Formulating and promulgating the National Technical Regulations on exhaust emission standards appropriate to the roadmap specified in this Decision according to its tasks and law provisions;
c) Based on the Prime Minister’s Decision No. 876/QD-TTg dated July 22, 2022, approving the Action Program on Green Energy Transition, Reduction of Carbon and Methane Emissions in the Transport Sector, and actual conditions, continue to study and additionally formulate regulations on improving exhaust emission standards applicable to motor vehicles, and submit them to the Prime Minister for the latter to consider and make decisions. Ensure consistency and synchronism in implementing policies on green energy transition, and application of exhaust emission standards for motor vehicles.
2. The Ministry of Science and Technology shall
Study and review national technical regulations on gasoline, diesel fuel, and biofuel for amendment and supplementation according to the roadmap for application of exhaust emission standards specified in this Decision.
3. The Ministry of Industry and Trade shall
a) Assume the prime responsibility for, and coordinate with concerned ministries and sectors in, assuring the production, import and supply of motor vehicle fuel of a quality up to national technical regulations on gasoline, diesel fuel, and biofuel;
b) Coordinate with the Ministry of Transport to inspect and supervise the manufacturing and assembling facilities’ compliance with the exhaust emission standards specified in this Decision.
4. The Ministry of Finance shall
Coordinate with the Ministry of Transport to inspect and supervise the importing facilities’ compliance with the exhaust emission standards specified in this Decision.
5. Ministries, People’s Committees of provinces and centrally run cities shall
a) Coordinate with the Ministry of Transport in organizing the dissemination of the roadmap for application of exhaust emission standards for motor vehicles;
b) Direct their professional units to coordinate with the Ministry of Science and Technology in controlling the quality of fuels circulated on the market;
c) Based on socio-economic conditions and environmental protection requirements in localities, People's Committees of provinces and centrally run cities may prescribe a stricter roadmap for application of exhaust emission standards than that specified in this Decision in accordance with the Law on Environmental Protection, and the Law on Standards and Technical Regulations.
Article 6. Transitional provisions
1. For types of manufactured and assembled motor vehicles
a) Types of manufactured and assembled motor vehicles of which the certificate of technical safety and environmental protection quality has been granted before the time of application of the exhaust emission standards under Points a, b and c Clause 1 Article 4 of this Decision, shall continue to be manufactured and assembled according to the validity period of the granted certificate;
b) Types of manufactured and assembled motor vehicles of which the certificate of technical safety and environmental protection quality has been granted before the time of application of the exhaust emission standards under Points d, dd, e and g Clause 1 Article 4 of this Decision, shall continue to be manufactured and assembled according to the validity period of the granted certificate, or after 12 months from the date the exhaust emission standards take effect, whichever occurs earlier.
2. For imported motor vehicles having the customs declarations opened; arriving at Vietnam's border gates before the time of application of the exhaust emission standards according to the roadmap specified in this Decision shall continue to apply the exhaust emission standards in force at the time of opening the imported vehicles’ customs declarations; or the time the imported vehicles arrive Vietnam's border gates or ports.
Article 7. Effect and implementation responsibility
1. This Decision takes effect from January 1, 2025.
2. To repeal the following provisions:
a) The Prime Minister’s Decision No. 249/2005/QD-TTg dated October 10, 2005, setting the roadmap for application of emission standards to road motor vehicles;
a) The Prime Minister’s Decision No. 49/2011/QD-TTg dated October 10, 2005, providing the roadmap for application of exhaust emission standards to manufactured, assembled and imported brand-new cars and motorbikes;
c) The Prime Minister’s Decision No. 16/2019/QD-TTg dated March 28, 2019, prescribing the roadmap for application of exhaust emission standards for in-use automobiles and imported used automobiles.
3. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of People’s Committees of provinces and centrally run cities, and related organizations and individuals shall implement this Decision./.
