Circular 44/2023/TT-BCT amending Circular 05/2018/TT-BCT on goods origin

CIRCULAR

Amending and supplementing a number of articles of the Minister of Industry and Trade’s Circular No. 05/2018/TT-BCT of April 3, 2018, on goods origin^[1]

Pursuant to the Government’s Decree No. 96/2022/ND-CP of November 29, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 31/2018/ND-CP of March 8, 2018, detailing the Law on Foreign Trade Management regarding goods origin;

At the proposal of the Director General of the Agency of Foreign Trade,

The Minister of Industry and Trade promulgates the Circular amending and supplementing a number of articles of the Minister of Industry and Trade’s Circular No. 05/2018/TT-BCT of April 3, 2018, on goods origin (below referred to as Circular No. 05/2018/TT-BCT).

Article 1. To supplement or replace a number of articles of Circular No. 05/2018/TT-BCT

1. To replace Appendix I (Product Specific Rules) provided in Clause 2, Article 6 of Circular No. 05/2018/TT-BCT with Appendix I to this Circular.

2. To replace Appendix II (Declaration of exported goods meeting “WO” criteria, using domestically purchased raw materials without value-added invoices) provided at Point a, Clause 1, Article 7 of Circular No. 05/2018/TT-BCT with Appendix II to this Circular.

3. To replace the phrase “Points g thru l, Clause 1, Article 7 of this Circular” in Clause 1, Article 9 of Circular No. 05/2018/TT-BCT with the phrase “Points g thru l, Clause 1, Article 8 of this Circular”.

Article 2. Implementation provisions

1. This Circular takes effect on February 15, 2024.

2. In case the legal documents referred to in this Circular are amended, supplemented or replaced, the amending, supplementing or replacing documents shall prevail.-
