Circular 24/2024/TT-BCT amend 27/2014/TT-BCT on the transit of goods of Cambodia through Vietnam

CIRCULAR

Amending and supplementing a number of articles of the Circular No. 27/2014/TT-BCT dated September 04, 2014 of the Minister of Industry and Trade defining the transit of goods of the Kingdom of Cambodia through the territory of the Socialist Republic of Vietnam

Pursuant to the Law on Foreign Trade Management dated June 12, 2017;

Pursuant to the Government’s Decree No. 96/2022/ND-CP dated November 29, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade; which is amended and supplemented in the Government's Decree No. 105/2024/NĐ-CP dated August 01, 2024;

Pursuant to the Government’s Decree No. 69/2018/ND-CP dated May 15, 2018 on detailing a number of articles of the Law on Foreign Trade Management;

In implementation of the Goods Transit Agreement between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia dated December 26, 2013;

At the proposal of the Director of the Agency of Foreign Trade;

The Minister of Industry and Trade promulgates the Circular amending and supplementing a number of articles of the Circular No. 27/2014/TT-BCT dated February 10, 2017 of the Minister of Industry and Trade, defining the transit of goods of the Kingdom of Cambodia through the territory of the Socialist Republic of Vietnam.

Article 1. Amending and supplementing a number of articles of the Circular No. 27/2014/TT-BCT dated September 04, 2014 of the Minister of Industry and Trade defining the transit of goods of the Kingdom of Cambodia through the territory of the Socialist Republic of Vietnam

1. To add Clause 10 Article 3 as follows:

“10. The dossiers of request for transit of goods specified in Clause 1, Clause 2, Clause 3, Clause 4 of this Article may be submitted directly or by post or online at the Ministry of Industry and Trade's public service portal”

2. To amend and supplement Article 11 as follows:

“Article 11. Extension of transit time for goods

1. The extension of transit time for goods shall be considered and resolved by the licensing agency, for goods in transit under a permit or by the customs agency, for goods in transit without a permit in accordance with law regulations.  Each extension shall not exceed 30 (thirty) days and at most 03 (three) extensions are allowed.

2. For cases where goods is stored in warehouses in Vietnam, or is damaged, lost, or for cases where means of transport carrying goods in transit is damaged during transit that require additional time for storage, damage or loss repair, the transit time shall be extended corresponding to the necessary time of performing such work.”

3. To amend Clause 4 Article 12 as follows:

“4. In case of force majeure specified in Clause 2 of this Article, the owner of the goods shall submit an dossier of request for consumption of goods in transit online at the Ministry of Industry and Trade's public service portal or send it directly or by post to the Agency of Foreign Trade - Ministry of Industry and Trade(Ministry of Industry and Trade), address: 54 Hai Ba Trung, Hoan Kiem ward, Hanoi, Vietnam. Such a dossier must comprise:

a) Written request for consumption of goods in transit: 01 original (made using the form specified in Appendix V issued together with this Circular).

b) Granted goods transit permit: 01 copy (signed and stamped as a true copy by the owner of the goods), if the goods are transited under the permit.

c) Documents proving force majeure circumstance for goods in transit requested for consumption in Vietnam.”

4. To amend Article 15 as follows:

“Article 15. Organization of implementation

1. The Agency of Foreign Trade (Ministry of Industry and Trade) shall receive and appraise the dossiers specified in Clause 1, Clause 3, Clause 4 Article 3; Clause 4 Article 12 of this Circular and submit them to the leaders of the Ministry of Industry and Trade for consideration and decision.

2. The Department of Foreign Trade of Ho Chi Minh City (Agency of Foreign Trade - Ministry of Industry and Trade) shall receive, appraise dossiers and grant goods transit permits as prescribed in Clause 2 Article 3 of this Circular.”

Article 2. Replacing and repealing a number of words, phrases, articles and appendices of Circular No. 27/2014/TT-BCT dated September 04, 2014 of the Minister of Industry and Trade defining the transit of goods of the Kingdom of Cambodia through the territory of the Socialist Republic of Vietnam

1. To replace the phrase “Appendix 1A” with the phrase “Appendix IA” in Clause 1 and Clause 4 Article 3.

2. To replace Appendix IA, Appendix IB, Appendix IIA, Appendix IIB and Appendix V issued together with Circular No. 27/2014/TT-BCT with Appendix I, Appendix II, Appendix III, Appendix IV, Appendix V issued together with this Circular.

3. To replace the word "Clause" with the word "clause" in the articles and appendices issued together with Circular No. 27/2014/TT-BCT.

4. To replace the phrase “Address: 12 Vo Van Kiet, District 1, Ho Chi Minh City, Vietnam” with the phrase “Address: 12 Nguyen Thi Minh Khai, Da Kao Ward, District 1, Ho Chi Minh City, Vietnam” in Clause 2 Article 3.

5. To repeal the phrase “extension” in Article 1, title of Chapter II.

6. To repeal Article 4, Appendix IIIA, Appendix IIIB, Appendix IIIC, Appendix IVA, Appendix IVB, Appendix IVC.

Article 3. Implementation provisions

This Circular takes effect on December 25, 2024./.
