CIRCULAR
Promulgating the List of imported and exported medical equipment with commodity codes determined according to Vietnam’s Nomenclature of exports and imports

Pursuant to the Law on Customs dated June 23, 2014;
Pursuant to the Government’s Decree No. 08/2015/ND-CP dated January 21, 2015, detailing, and providing measures to implement the Customs Law regarding customs procedures and customs inspection, supervision and control;
Pursuant to the Government’s Decree No. 59/2018/ND-CP dated June 26, 2015, on amending and supplementing a number of articles of the Government’s Decree No. 08/2015/ND-CP of January 21, 2015, detailing, and providing measures to implement, the Customs Law regarding customs procedures and customs inspection, supervision and control;
Pursuant to the Government’s Decree No. 98/2021/ND-CP dated November 8, 2021, on the management of medical devices;
Pursuant to the Government’s Decree No. 07/2023/ND-CP dated March 2, 2023, amending and supplementing a number of articles of the Government’s Decree No. 98/2021/ND-CP of November 8, 2021, on management of medical devices;
Pursuant to the Government’s Decree No. 96/2023/ND-CP dated December 30, 2023, detailing a number of articles of the Law on Medical Examination and Treatment;
Pursuant to the Government’s Decree No. 95/2022/ND-CP dated November 15, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Health;
At the proposal of the Director of the Department of Medical Equipment and Works,
The Minister of Health hereby promulgates the Circular on the List of imported and exported medical equipment with commodity codes determined according to Vietnam’s Nomenclature of exports and imports.
Article 1. Scope of regulation
This Circular promulgates the List and principles for application of the List of imported and exported medical equipment with commodity codes (hereinafter referred to as HS codes) determined according to Vietnam’s Nomenclature of exports and imports to the Minister of Finance's Circular No. 31/2022/TT-BTC dated June 8, 2022, promulgating Vietnam’s Nomenclature of exports and imports.
Article 2. List promulgation
The List of imported and exported medical equipment with HS codes determined according to Vietnam’s Nomenclature of exports and imports is promulgated together with this Circular.
Article 3. Principles of List application
1. In case there are differences or inconsistencies in classifying and determining HS codes for commodities on the List promulgated together with this Circular, the determination of HS codes shall comply with the customs law.
2. For imported and exported medical equipment that has neither been listed nor assigned HS codes in the List promulgated together with this Circular, the determination of HS codes shall comply with the customs law. After customs clearance, individual and institutional exporters and importers shall send documents to the Ministry of Health (the Department of Medical Equipment and Works) to serve as a basis for coordinating with the Ministry of Finance to consider unifying, updating and promulgating the supplementary List.
3. The List of medical equipment with HS codes promulgated together with this Circular shall be used as a basis for organizations and individuals to export and import medical equipment into Vietnam.
4. The List includes commodities that are medical equipment, managed under the Government's Decree No. 98/2021/ND-CP dated November 8, 2021, on the management of medical devices (amended and supplemented under the Government’s Decree No. 07/2023/ND-CP dated March 2, 2023) and other legal documents on medical equipment.
Article 4. Effect
1. This Circular takes effect from November 16, 2024.
2. The Minister of Health's Circular No. 14/2018/TT-BYT dated May 15, 2028, promulgating the List of imported and exported medical equipment with commodity codes determined according to Vietnam’s Nomenclature of exports and imports, ceases to be effective from the effective date of this Circular.
Article 5. Responsibility for implementation
The Director of the Department of Medical Equipment and Works; Heads of affiliated units of the Ministry of Health; Director of Health Department of provinces and central-affiliated cities, Heads of health agencies of Ministries, sectors, and related agencies, organizations and individuals shall implement this Circular.
Any difficulties arising in the course of implementation should be reported to the Ministry of Health (the Department of Medical Equipment and Works) for consideration and settlement./.
