CIRCULAR
On the List of insecticidal or germicidal preparations for household and medical use with HS codes determined according to Vietnam’s Nomenclature of exports and imports

Pursuant to the Law on Customs No. 54/2014/QH13 dated June 23, 2014;
Pursuant to the Government’s Decree No. 08/2015/ND-CP dated January 21, 2015, detailing, and providing measures to implement the Customs Law regarding customs procedures and customs inspection, supervision and control;
Pursuant to the Government’s Decree No. 59/2018/ND-CP dated June 26, 2015, amending and supplementing a number of articles of the Government’s Decree No. 08/2015/ND-CP of January 21, 2015, detailing, and providing measures to implement, the Customs Law regarding customs procedures and customs inspection, supervision and control;
Pursuant to the Government’s Decree No. 95/2022/ND-CP dated November 15, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Health;
Pursuant to the Government’s Decree No. 91/2016/ND-CP dated July 1, 2016, on management of insecticidal or germicidal chemicals and preparations for household and medical use;
At the proposal of the Director of the Health Environment Management Agency;
The Minister of Health hereby promulgates the Circular on the List of insecticidal or germicidal preparations for household and medical use with HS codes determined according to Vietnam’s Nomenclature of exports and imports.
Article 1. Scope of regulation
This Circular promulgates the List and principles for application of the List of insecticidal or germicidal preparations for household and medical use with HS codes determined according to Vietnam’s Nomenclature of exports and imports.
Article 2. List promulgation
Enclosed with this Circular is the List of insecticidal or germicidal preparations for household and medical use with HS codes determined according to Vietnam’s Nomenclature of exports and imports to the Minister of Finance's Circular No. 31/2022/TT-BTC dated June 8, 2022, on promulgation of Vietnam’s Nomenclature of exports and imports.
Article 3. Principles for application of the List
1. The products specified in the List to this Circular are managed in accordance with the Government's Decree No. 91/2016/ND-CP dated July 1, 2016, on management of insecticidal and germicidal chemicals and preparations for household and medical use.
2. In case there are differences or inconsistencies in classifying and determining HS codes for commodities on the List promulgated together with this Circular, the determination of HS codes shall comply with the customs law.
3. For insecticidal and germicidal preparations for household and medical use that have neither been listed nor assigned HS codes in the List promulgated together with this Circular, the determination of HS codes shall comply with the customs law. After customs clearance, individual and institutional exporters and importers shall send documents to the Ministry of Health (the Health Environment Management Agency) to serve as a basis for coordinating with the Ministry of Finance to consider unifying, updating and promulgating the supplementary List.
Article 4. Reference provisions
In case the legal documents and provisions referred to in this Circular are amended, supplemented or replaced, the new ones shall prevail.
Article 5. Effect
1. This Circular takes effect from November 15, 2024.
2. The Minister of Health's Circular No. 09/2018/TT-BYT dated April 27, 2018, promulgating the List of insecticidal or germicidal chemicals and preparations for household and medical use which are under the state management of the Ministry of Health and whose HS codes can be identified according to Vietnam’s Nomenclature of exports and imports, ceases to be effective from the effective date of this Circular.
Article 6. Implementation responsibility
The Director of the Health Environment Management Agency, Heads of the units affiliated to and under the Ministry of Health; Health Departments of provinces and centrally run cities, as well as concerned agencies, organizations and individuals shall implement this Circular.
Any difficulties arising in the course of implementation should be reported to the Ministry of Health (the Health Environment Management Agency) for consideration and settlement./.
