CIRCULAR

Amending and supplementing a number of articles of Circular No. 03/2015/TT-BTTTT dated March 6, 2015 of the Minister of Information and Communications detailing and guiding the implementation of a number of articles and clauses of the Government’s Decree No. 60/2014/ND-CP dated June 19, 2014, prescribing printing activities, Circular No. 05/2016/TT-BTTTT dated March 1, 2016 of the Minister of Information and Communications, defining the management and use of international standard book numbers, Circular No. 22/2018/TT-BTTTT dated December 28, 2018 of the Minister of Information and Communications on promulgating Lists of imports and exports in the fields of printing and distribution of publications and Circular No. 09/2013/TT-BTTTT dated April 08, 2013 of the Minister of Information and Communications on providing the List of software, hardware and electronic products (amended and supplemented by Circular No. 20/2021/TT-BTTTT dated December 3, 2021

Pursuant to the Publication Law dated November 20, 2012 (which is amended and supplemented by the Law Amending and Supplementing a Number of Articles of Thirty Seven Laws Related to the Planning Law dated November 20, 2018);

Pursuant to the Law on Foreign Trade Management dated June 12, 2017;

Pursuant to the Government’s Decree No. 195/2013/ND-CP dated November 21, 2013 detailing a number of articles of, and measures for implementing, the Publication Law (which is amended and supplemented by the Government’s Decree No. 150/2018/ND-CP dated November 07, 2018 on amending a number of Decrees concerning business investment conditions, and administrative procedures in the field of information and communications);

Pursuant to the Government’s Decree No. 60/2014/ND-CP dated June 19, 2014, prescribing printing activities (which is amended and supplemented by the Government’s Decree No. 25/2018/ND-CP dated February 28, 2018, amending and supplementing a number of articles of Decree No. 60/2014/ND-CP dated June 19, 2014 of the Government, prescribing printing activities);

Pursuant to the Government’s Decree No. 69/2018/ND-CP dated May 15, 2018, on detailing a number of articles of the Law on Foreign Trade Management;

Pursuant to the Government's Decree No. 72/2022/ND-CP dated October 04, 2022, amending and supplementing a number of articles of the Government’s Decree No. 60/2014/ND-CP dated June 19, 2014, prescribing printing activities, and the Government’s Decree No. 25/2018/ND-CP dated February 28, 2018, amending and supplementing a number of articles of Decree No. 60/2014/ND-CP dated June 19, 2014 of the Government, prescribing printing activities;

Pursuant to the Government’s Decree No. 48/2022/ND-CP dated July 26, 2022 defining the functions, tasks, powers and organizational structure of the Ministry of Information and Communications;

At the proposal of the Director General of the Authority of Publication, Printing and Distribution;

The Minister of Information and Communications promulgates the Circular amending and supplementing a number of articles of Circular No. 03/2015/TT-BTTTT dated March 6, 2015 of the Minister of Information and Communications detailing and guiding the implementation of a number of articles and clauses of the Government’s Decree No. 60/2014/ND-CP dated June 19, 2014, prescribing printing activities, Circular No. 05/2016/TT-BTTTT dated March 1, 2016 of the Minister of Information and Communications, defining the management and use of international standard book numbers, Circular No. 22/2018/TT-BTTTT dated December 28, 2018 of the Minister of Information and Communications on promulgating Lists of imports and exports in the fields of printing and distribution of publications and Circular No. 09/2013/TT-BTTTT dated April 08, 2013 of the Minister of Information and Communications on providing the List of software, hardware and electronic products (amended and supplemented by Circular No. 20/2021/TT-BTTTT dated December 3, 2021 of the Minister of Information and Communications).

Article 1. Amending and supplementing a number of articles of Circular No. 05/2016/TT-BTTTT dated March 1, 2016 of the Minister of Information and Communications, defining the management and use of international standard book numbers (ISBN)

1. To amend and supplement Point d Clause 1 Article 6 as follows:

“d) Year of first publication;”

2. To amend and supplement Clause 2 Article 11 as follows:

“2. Methods of revoking ISBNs: In case of failure to publish books with their titles accompanied by ISBN codes issued in the publication registration certification of the previous year, the publisher must submit in writing those ISBN codes to the Authority of Publication, Printing and Distribution no later than March 31 of each year with the following information:

Article 2. Amending and supplementing Article 1 of Circular No. 22/2018/TT-BTTTT dated December 28, 2018 of the Minister of Information and Communications on promulgating Lists of imports and exports in the fields of printing and distribution of publications

1. To amend and supplement the title and first paragraph of Article 1 as follows:

a) To amend the title of Article 1 as follows:

“Article 1. List of imports in the field of printing and List of imports and exports in the field of distribution of publications”

b) To amend and supplement the first paragraph of Article 1 as follows:

“This Circular defines the List of imports in the field of printing and List of imports and exports in the field of distribution of publications serving the management of import, export, investment activities, application of taxation policies, preferential policies and other activities related to products and goods:”

2. To add Clause 1a before Clause 2 Article 1 as follows:

“1a. List of imports by HS Code and methods of import management in the field of printing shall be as follows:

a) Goods being printing equipment (excluding components and accessories) as prescribed at Point b Clause 1 Article 1 of the Government's Decree No. 72/2022/ND-CP dated October 04, 2022, amending and supplementing a number of articles of the Government’s Decree No. 60/2014/ND-CP dated June 19, 2014, prescribing printing activities, and the Government’s Decree No. 25/2018/ND-CP dated February 28, 2018, amending and supplementing a number of articles of Decree No. 60/2014/ND-CP dated June 19, 2014 of the Government, prescribing printing activities, that are listed and described in the List of imports by HS code in the field of printing as follows:

b) Only goods with 08-digit HS code listed and described as printing equipment in the List of imports in the field of printing specified at Point a of this Clause must apply import declaration procedures prescribed in Clause 6 Article 1 of the Government's Decree No. 72/2022/ND-CP dated October 04, 2022, amending and supplementing a number of articles of the Government’s Decree No. 60/2014/ND-CP dated June 19, 2014, prescribing printing activities, and the Government’s Decree No. 25/2018/ND-CP dated February 28, 2018, amending and supplementing a number of articles of Decree No. 60/2014/ND-CP dated June 19, 2014 of the Government, prescribing printing activities.

In case of modification of the regulations on HS codes, the new regulations on HS codes corresponding to printing equipment listed and described in the List of imports in the field of printing specified at Point a of this Clause shall apply.”

3. To amend and supplement Clause 2 Article 1 as follows:

“2. List of goods by HS code and methods of management for imports and exports in the field of distribution of publications is defined in Appendix 02 issued together with this Circular.”

Article 3. Replacing, repealing a number of articles, clauses, points, phrases of Circular No. 03/2015/TT-BTTTT dated March 6, 2015 of the Minister of Information and Communications detailing and guiding the implementation of a number of articles and clauses of the Government’s Decree No. 60/2014/ND-CP dated June 19, 2014, prescribing printing activities, Circular No. 05/2016/TT-BTTTT dated March 1, 2016 of the Minister of Information and Communications, defining the management and use of international standard book numbers, Circular No. 22/2018/TT-BTTTT dated December 28, 2018 of the Minister of Information and Communications on promulgating Lists of imports and exports in the fields of printing and distribution of publications

1. To replace a number of phrases in Appendix No. 02 issued together with Circular No. 22/2018/TT-BTTTT dated December 28, 2018 of the Minister of Information and Communications on promulgating Lists of imports and exports in the fields of printing and distribution of publications as follows:

a) To replace the phrase “Circular No. 65/2017/TT-BTC dated June 27, 2017 of the Ministry of Finance” with the phrase “Circular No. 31/2022/TT-BTC dated June 8, 2022 of the Minister of Finance” in Section I.1 of List of goods by HS code and methods of management for imports and exports in the field of distribution of publications.

b) To replace the phrase “Circular No. 23/2014/TT-BTTTT dated December 29, 2014 of the Minister of Information and Communications, detailing and guiding the implementation of a number of articles of the Publication Law and the Government’s Decree No. 195/2013/ND-CP dated November 21, 2013 detailing a number of articles of, and measures for implementing, the Publication Law” with the phrase “Circular No. 01/2020/TT-BTTTT dated February 7, 2020 of the Minister of Information and Communications, detailing and guiding the implementation of a number of articles of the Publication Law and the Government’s Decree No. 195/2013/ND-CP dated November 21, 2013 detailing a number of articles of, and measures for implementing, the Publication Law (which is amended and supplemented by Circular No. 23/2023/TT-BTTTT dated December 31, 2023 of the Minister of Information and Communications)” in Section I.2 and Section I.3.”

2. To repeal Article 2 and Article 6 of Circular No. 03/2015/TT-BTTTT dated March 6, 2015 of the Minister of Information and Communications detailing and guiding the implementation of a number of articles and clauses of the Government’s Decree No. 60/2014/ND-CP dated June 19, 2014, prescribing printing activities.

3. To repeal Article 3; Points h, i, k and m, Clause 1, Article 6; the phrase “bottom right-hand corner” at Point a, Clause 1, Article 7; Point c, Clause 1, Article 7 of Circular No. 05/2016/TT-BTTTT dated March 1, 2016 of the Minister of Information and Communications, defining the management and use of international standard book numbers.

Article 4. Amending, supplementing and repealing a number of products in 2.1.2 of Appendix No. 02 of the List of hardware and electronic products issued together with Circular No. 09/2013/TT-BTTTT dated April 08, 2013 of the Minister of Information and Communications on providing the List of software, hardware and electronic products (amended and supplemented by Circular No. 20/2021/TT-BTTTT dated December 3, 2021 of the Minister of Information and Communications) 

1. To amend and supplement the names of some products in product group 2.1.2 in the List of hardware and electronic products:

a) From “Laser printers” to “Laser printers, except for multi-color ones with a print speed of 60 sheets per minute (A4 paper size) or fewer or with a print size of A3 or smaller” at No. 6;

b) From “Ink-jet printers” to “Ink-jet printers, except for multi-color ones with a print speed of 60 sheets per minute (A4 paper size) or fewer or with a print size of A3 or smaller” at No. 8;

c) From “(Black and white or color) single- and multi-function photocopiers” to “(Black and white) single- and multi-function photocopiers” at No. 9.

2. To repeal a number of products in product group 2.1.2 in the List of hardware and electronic products:

a) “Offset printing machinery, reel-fed”, at No. 01;

b) “Offset printing machinery, sheet-fed, office type”, at No. 02;  

c) “Other offset printing machinery”, at No. 03;

d) “Embossing machines, reel-fed, except for embossing machines using soft molds”, at No. 04;

dd) “Embossing machines using soft molds”, at No. 05;

e) “Automatic plate exposure machines”, at No. 12;

g) “CTP plate making machines”, at No. 13.

Article 5. Implementation provisions

1. This Circular takes effect on November 07, 2024.

2. For dossiers for declaration of import of printing equipment, import of non-commercial publications, registration of import of commercial publications sent to competent agencies for settlement before the effective date of this Circular, but the deadline for settlement of such procedures is the same day or after the effective date of this Circular, the relevant provisions of this Circular shall not apply.

Any problem arising in the process of implementing this Circular should be reported in writing to the Ministry of Information and Communications (through the Authority of Publication, Printing and Distribution) for consideration and settlement./.
