Circular 02/2024/TT-BCT amend Circular 31/2015/TT-BCT implementation of the Rules of Origin provided in AANZFTA

CIRCULAR

Amending and supplementing a number of articles of the Minister of Industry and Trade’s Circular No. 31/2015/TT-BCT of September 24, 2015, on the implementation of the Rules of Origin provided in the Agreement Establishing the ASEAN-Australia-New Zealand Free Trade Area^[1]

Pursuant to the Government’s Decree No. 96/2022/ND-CP of November 29, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 31/2018/ND-CP of March 8, 2018, detailing the Law on Foreign Trade Management regarding goods origin;

Implementing the Agreement Establishing the ASEAN-Australia-New Zealand Free Trade Area concluded on February 27, 2009, at the 14^th Summit in Thailand between the member states of the Association of Southeast Asian Nations with Australia and New Zealand;

Implementing the First Protocol to Amend the Agreement Establishing the ASEAN-Australia-New Zealand Free Trade Area concluded on August 26, 2014, within the framework of the 46^th ASEAN Economic Ministers’ Meeting in Myanmar;

Based on the Report of the Joint Committee for Implementation of the Agreement Establishing the ASEAN-Australia-New Zealand Free Trade Area, sent to the 28^th ASEAN-Australia-New Zealand Economic Ministers – Closer Economic Relations Consultation on August 22, 2023, in Semarang, Indonesia;

At the proposal of the Director General of the Agency of Foreign Trade;

The Minister of Industry and Trade promulgates the Circular amending and supplementing a number of articles of the Minister of Industry and Trade’s Circular No. 31/2015/TT-BCT of September 24, 2015, on the implementation of the Rules of Origin provided in Agreement Establishing the ASEAN-Australia-New Zealand Free Trade Area.

Article 1. To amend and supplement Article 2 of the Minister of Industry and Trade’s Circular No. 31/2015/TT-BCT of September 24, 2015, on the implementation of the Rules of Origin provided in the Agreement Establishing the ASEAN-Australia-New Zealand Free Trade Area (below referred to as Circular No. 31/2015/TT-BCT).

To amend and supplement Article 2 as follows:

“Article 2. Procedures for issuance and inspection of certificates of origin, Form AANZ

Procedures for issuance and inspection of Vietnam’s certificates of origin, Form AANZ, are provided in:

1. Appendix III to this Circular;

2. The Government’s Decree No. 31/2018/ND-CP of March 8, 2018, detailing the Law on Foreign Trade Management regarding goods origin, and the Minister of Industry and Trade’s Circular No. 05/2018/TT-BCT of April 3, 2018, on goods origin.”.

Article 2. To replace Appendix II - Product Specific Rules to Circular No. 31/2015/TT-BCT

To replace Appendix II provided in Clause 2, Article 1 of Circular No. 31/2015/TT-BCT, which has been replaced by the Appendix to Circular No. 42/2018/TT-BCT of November 12, 2018, amending and supplementing a number of articles of Circular No. 31/2015/TT-BCT, with the Appendix to this Circular.

Article 3. Implementation provisions

1. This Circular takes effect on March 1, 2024.

2. This Circular annuls the Minister of Industry and Trade’s Circular No. 42/2018/TT-BCT of November 12, 2018, amending and supplementing a number of articles of the Minister of Industry and Trade’s Circular No. 31/2015/TT-BCT of September 24, 2015, on the implementation of the Rules of Origin provided in the Agreement Establishing the ASEAN-Australia-New Zealand Free Trade Area.-
