Circular 01/2024/TT-BNNPTNT lists of exported and imported goods subject to specialized inspection in the field of agriculture and rural development

CIRCULAR

Promulgating Lists of HS codes for goods under the state management by the Ministry of Agriculture and Rural Development and lists of exported and imported goods subject to specialized inspection in the field of agriculture and rural development^[1]

Pursuant to the Government’s Decree No. 105/2022/ND-CP of December 22, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Government’s Decree No. 69/2018/ND-CP of May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management;

Pursuant to the Government’s Decree No. 85/2019/ND-CP of November 14, 2019, prescribing the performance of administrative procedures under the National Single-Window Mechanism and the ASEAN Single-Window Mechanism and specialized inspection of exported and imported goods;

At the proposal of the Director of the Department of Legal Affairs and Directors of the Departments of Forestry; Fisheries; Plant Protection; Animal Health, Livestock Production; Crop Production; Cooperatives and Rural Development; and Agro Processing and Market Development;

The Minister of Agriculture and Rural Development promulgates the Circular promulgating tables of HS codes for lists of goods under the state management by the Ministry of Agriculture and Rural Development and lists of exported and imported goods subject to specialized inspection in the field of agriculture and rural development.

Article 1. To promulgate together with this Circular Lists of HS codes for goods under the state management by the Ministry of Agriculture and Rural
Development and lists of exported and imported goods subject to specialized inspection in the field of agriculture and rural development

1. Appendix I: Lists of HS codes for goods under the state management by the Ministry of Agriculture and Rural Development, including:

Section 1: List of HS codes for terrestrial animals and terrestrial animal products subject to quarantine.

Section 2: List of HS codes for other animals in livestock production.

Section 3: List of HS codes for animal breeds banned from export.

Section 4: List of HS codes for animal breeds in need of conservation.

Section 5: List of HS codes for aquatic animals and aquatic animal products subject to quarantine.

Section 6: List of HS codes for aquatic species permitted for trading in Vietnam.

Section 7: List of HS codes for aquatic species subject to conditional export.

Section 8: List of HS codes for aquatic species banned from export.

Section 9: List of HS codes for Vietnam’s objects subject to plant quarantine.

Section 10: List of HS codes for food originating from imported plants.

Section 11: List of HS codes for plant varieties.

Section 12: List of HS codes for plant genetic resources banned from export.

Section 13: List of HS codes for salt products (including also table salt and denatured salt).

Section 14: List of HS codes for commercial animal feed products published on the Portal of the Ministry of Agriculture and Rural Development.

Section 15: List of HS codes for chemicals, bio-products and microorganisms banned from use in animal feeds.

Section 16: List of HS codes for chemicals, biologicals, microorganisms and animal feed ingredients permitted for use in aquaculture in Vietnam, and aquatic animal feeds and aquaculture environment treatment finished-products.

Section 17: List of HS codes for chemicals, biologicals and microorganisms banned from use in aquatic animal feeds and aquaculture environment treatment products.

Section 18: List of HS codes for veterinary drugs and veterinary drug materials permitted for import and sale in Vietnam.

Section 19: List of HS codes for fertilizers.

Section 20: List of HS codes for assorted logs and sawn timber from domestic natural forests that are banned from export.

Section 21: List of HS codes for timber and timber products for which legal timber dossiers are required upon their export.

Section 22: List of HS codes for forest tree cultivars.

Section 23: List of HS codes for pesticides.

Section 24: List of HS codes for pesticides banned from use in Vietnam.

Section 25: List of HS codes for products in the field of fishing.

Section 26: List of HS codes for livestock waste treatment products.

Section 27: List of HS codes for agricultural machinery and equipment.

2. Appendix II: List of HS codes for imported goods subject to specialized inspection before customs clearance that are under the state management by the Ministry of Agriculture and Rural Development.

3. Appendix III: List of HS codes for imported goods subject to specialized inspection after customs clearance that are under the state management by the Ministry of Agriculture and Rural Development.

Article 2. Provisions on use of the lists

1. The lists of goods under the state management by the Ministry of Agriculture and Rural Development with identified codes promulgated together with this Circular serve as a basis for organizations and individuals to make customs declaration when exporting and importing such goods into Vietnam.

2. When exporting or importing goods in the agricultural sector that are not yet accompanied by codes on the Lists issued together with this Circular, customs declaration shall be made according to the actual description of the goods and Vietnam’s Nomenclature of exported and imported goods issued together with the Minister of Finance’s Circular No. 31/2022/TT-BTC of June 8, 2022. After customs clearance, organizations and individuals shall send requests to the Ministry of Agriculture and Rural Development for the latter to coordinate with the Ministry of Finance in considering unifying, updating and promulgating the additional Lists.

3. The specialized inspection of exported goods under the state management by the Ministry of Agriculture and Rural Development shall be carried out at the request of enterprises to serve customs clearance for goods in importing countries.

Article 3. Effect

1. This Circular takes effect on March 20, 2024.

2. This Circular:

a/ Replaces the Minister of Agriculture and Rural Development’s Circular No. 11/2021/TT-BNNPTNT of September 20, 2021, promulgating tables of HS codes for lists of goods under the state management by the Ministry of Agriculture and Rural Development and lists of exported and imported goods subject to specialized inspection in the field of agriculture and rural development;

b/ Replaces Sections 3.1, 4, 8 and 9 of the Appendix to the Minister of Agriculture and Rural Development’s Circular No. 16/2021/TT-BNNPTNT of December 20, 2021, promulgating the List of likely unsafe products and goods subject to the management by the Ministry of Agriculture and Rural Development with the corresponding sections provided in Appendix IV to this Circular;

c/ Annuls Article 9 of the Minister of Agriculture and Rural Development’s Circular No. 01/2022/TT-BNNPTNT of January 18, 2022, amending and supplementing a number of circulars in the fisheries sector; and,

d/ Annuls Appendix XXIII to the Minister of Agriculture and Rural Development’s Circular No. 01/2022/TT-BNNPTNT of January 18, 2022, amending and supplementing a number of circulars in the fisheries sector.

Article 4. Implementation responsibility

1. The Chief of the Office, Director of the Department of Legal Affairs, and heads of units of the Ministry of Agriculture and Rural Development, and related agencies, organizations and individuals shall implement this Circular.

2. Any problems arising in the course of implementation of this Circular should be promptly reported to the Ministry of Agriculture and Rural Development for study and revision as appropriate.-
