DECREE

Defining the functions, tasks, powers and organizational structure of the Ministry of Construction[1]

 

Pursuant to the February 18, 2025 Law on Organization of the Government;

At the proposal of the Minister of Construction;

The Government promulgates the Decree defining the functions, tasks, powers and organizational structure of the Ministry of Construction.

Article 1. Position and functions

The Ministry of Construction is an agency of the Government, performing the state management of: construction planning and architecture; construction investment activities; urban development; technical infrastructure; housing; the real estate market; building materials; road, railway, inland waterway, maritime and civil aviation transport nationwide; and the provision of public services in the fields under the Ministry’s state management accordance with law.

Article 2. Tasks and powers

The Ministry of Construction shall perform the tasks and exercise the powers defined in the Law on Organization of the Government and the Government’s regulations on the functions, tasks, powers and organizational structures of ministries and ministerial-level agencies, and has the following specific tasks and powers:

1. To submit to the Government draft laws and draft resolutions of the National Assembly; draft ordinances and draft resolutions of the National Assembly Standing Committee; and draft decrees and draft resolutions of the Government under the Ministry’s approved annual lawmaking programs and plans, and resolutions, projects, schemes and programs as assigned by the Government and the Prime Minister; to submit to the Government and the Prime Minister strategies, master plans, schemes, long-term, medium-term and annual development plans as well as important national projects and works under the Ministry’s state management and in accordance with law.

2. To submit to the Government and the Prime Minister drafts of decisions, directives and other documents as assigned.

3. To promulgate circulars and other documents under the Ministry’s state management; to formulate and promulgate according to the Ministry’s competence, or submit to competent authorities for promulgation, technical regulations, national standards, techno-economic norms, typical designs, model designs, technical instructions, indicators and criteria in the fields under the Ministry’s state management; to guide and inspect the implementation of these documents.

4. To direct and organize the provision of information, public communication, dissemination and education about laws under the Ministry’s state management; to direct, guide, inspect and monitor the implementation of laws concerning the Ministry’s assigned sectors and fields nationwide; to review, evaluate and direct the implementation of strategies, master plans and plans in the fields under the Ministry’s state management.

5. Regarding planning and architecture:

a/ To formulate and appraise the overall master plan on the urban and rural  system; to assume the prime responsibility for formulating and appraising urban and rural planning components in national overall master plans, marine space master plans, regional master plans and other master plans in accordance with the planning law;

b/ To appraise planning tasks and urban and rural master plans subject to the Prime Minister’s approval, or appraise and approve urban and rural master plans as assigned by the Prime Minister;

c/ To promulgate norms and methods of estimating and managing costs of planning activities and formulating architecture management regulations; 

d/ To set, and organize the realization of, orientations for development of Vietnam’s architecture suitable to each period, and submit them to the Prime Minister for approval and promulgation; to guide the listing and management of valuable architectural works;

dd/ To build, manage, operate and exploit the database on planning and architecture which is connected with the system of standardized national geographical databases; to ensure the synchronous connection with the national database on planning and the national database on land nationwide;

e/ To guide and inspect the implementation of regulations on planning and architecture, and management of architectural space and landscape under master plans and architecture management regulations with regard to space (including above-ground space and underground space);

g/ To promulgate model architectural designs for public works and houses in rural areas and other architecture works under regulations;

h/ To regulate and guide the organization of planning idea contests and architectural plan contests, and manage urban and rural planning practice and architecture practice.  

6. Regarding construction investment activities:

a/ To formulate and submit to competent authorities for promulgation, or promulgate according to the Ministry’s competence, mechanisms for, and policies and regulations on, the formulation of investment projects on work construction, construction survey, construction engineering, construction, construction supervision, project management, contractor selection, acceptance testing and handover of works for commissioning, warranty and maintenance of construction works, and other activities related to work construction; construction operation capacity; foreign contractors engaged in construction activities in Vietnam; and the national information system and database on construction activities;

b/ To guide and inspect the implementation of the mechanisms, policies and regulations specified at Point a of this Clause;

c/ To build and manage the national information system and database on construction activities;

d/ To guide the application of building information modeling (BIM) in construction activities; and the selection of contractors in construction activities in accordance with the construction and bidding laws;

dd/ To appraise construction investment feasibility study reports, construction designs to be implemented after basic designs in accordance with the construction law;

e/ To guide and inspect the implementation of regulations on contracts in construction activities and contracts of projects on investment in the form of public-private partnership (PPP projects) in accordance with law; to guide methods of adjusting prices of construction contracts; to announce model construction contracts; to guide the formulation and management of costs and methods of determining technical infrastructure service charge rates;

g/ To perform the functions and tasks of the investment decider and project owner for construction investment projects under the Ministry’s competence in accordance with law;

h/ To recognize socio-professional organizations qualified for being granted practice certificates or construction operation capacity certificates;

i/ To promulgate, and guide and inspect the implementation of, regulations on management of construction investment costs; to regulate the application of necessary tools in the management of construction investment costs; to guide contents and methods of determining and managing construction investment costs; to provide the determination of new norms and norm adjustment; to provide the determination of work construction price indexes for works each located in two or more provinces; to promulgate construction norms; to announce construction investment capital rates, general construction prices, national construction price indexes, shrinkage norms, and basic data for calculation of machinery shift prices;

k/ To guide and inspect the management of construction work quality in the stages of survey, engineering, construction, acceptance testing, handover, warranty and maintenance of construction works; to carry out periodical or extraordinary inspection, handle or propose the handling of violations of construction work quality regulations; to terminate, or propose termination of, the construction and request project owners, consultants and contractors to take remedies in case of detecting that work quality is unsatisfactory or construction activities fail to comply with occupational safety regulations; to inspect the acceptance testing of construction works in accordance with law;

l/ To guide specialized construction testing and construction inspection activities; to inspect, assess, and grant certificates of eligibility for, specialized construction testing activities; to guide and organize according to the Ministry’s competence construction assessment, construction-related judicial assessment and assessment of causes of incidents occurring during construction activities and during the operation and use of construction works according to the Ministry’s competence;

m/ To organize the performance of tasks of the State Inspection Council for Acceptance Testing of Construction Works; to assume the prime responsibility for organizing and approving the conferment of construction work quality awards;

n/ To guide and inspect the maintenance of construction works and assessment of work safety in the course of exploitation and use of construction works; to announce, and guide the disposal of, works with expired lifespan in accordance with law;

o/ To manage codes of practice certificates and construction operation capacity certificates; to publicize the list of individuals and organizations that are granted certificates under regulations; to design and  promulgate the set of questions for testing for grant of practice certificates; to build, and manage the operation of, testing software;

p/ To build and manage the database on construction norms, work construction prices, and construction price indexes in accordance with law.

7. Regarding urban development:

a/ To formulate strategies, programs, plans and national important projects on urban development; and urban development indicators in national socio-economic development tasks in each period;

b/ To formulate and submit to competent authorities for promulgation, or promulgate according to the Ministry’s competence, mechanisms, policies and regulations on: urbanization management; management of, and development investment in, urban space (including above-ground space and underground space), and urban development models; management of plans and programs on upgrading, renovation and embellishment of urban centers, and improvement of urban climate change resilience and response capacity; operation, use and handover of urban centers for management; system of urban classification criteria and standards; estimation and management of utility service costs in urban centers, and costs of the formulation and appraisal of plans on urban development areas, urban development programs, and urban classification schemes and reports;

c/ To appraise for competent authorities to approve urban development programs and plans, urban development areas and urban center construction investment projects in accordance with law;

d/ To appraise, and propose the Prime Minister to decide on recognition of, grades of urban centers, for urban centers of special grade, grade I and grade II; to decide on recognition of grades of urban centers, for urban centers of grade III and grade IV; to decide on recognition of areas where urban districts or wards are expected to be established up to the standards on urban infrastructure development level;

dd/ To guide and inspect the implementation of mechanisms, policies and regulations on urban development and urban development investment under master plans and plans; to guide, inspect and organize annual evaluation and classification of urban centers based on the criteria and standards set by competent authorities; to guide the management of urban construction order;

e/ To guide and inspect the management of land used for urban construction under approved urban development master plans and plans;

g/ To organize the mobilization, promotion and coordination of resources at home and abroad for urban development investment in accordance with law and as assigned by the Government;

h/ To build, integrate, manage and operate the national urban database.

8. Regarding technical infrastructure facilities, including facilities for clean water supply (except rural clean water); water drainage and wastewater treatment (except on-spot wastewater treatment; and water drainage for agricultural production and salt making); urban parks and greeneries; urban lighting; cemeteries (excluding war martyrs’ cemeteries) and crematoria; urban traffic infrastructure facilities; management of underground construction spaces; and management of shared use of urban technical infrastructure facilities and rural residential areas:

a/ To formulate national orientations, strategies, schemes and programs on technical infrastructure development, and national indicators in the field of technical infrastructure in national socio-economic development tasks in each period and organize the implementation thereof after they are approved;

b/ To guide the formulation of technical infrastructure development plans according to technical infrastructure development orientations, regional master plans, provincial master plans, urban master plans and rural master plans; and investment projects on construction of technical infrastructure facilities as assigned by the Prime Minister;

c/ To formulate mechanisms, policies and regulations on development, operation management, use, and handover of technical infrastructure facilities and provision of technical infrastructure services; to guide the process of provision of technical infrastructure services;

d/ To guide and inspect clean water trading and assurance of safe water supply; and provision of crematorium management and operation services;

dd/ To formulate and promulgate technical regulations on construction of urban traffic infrastructure; to provide the grading and classification of urban roads; to formulate and submit to competent authorities for promulgation national standards on construction of urban roads;

e/ To formulate and submit to competent authorities for promulgation, or promulgate according to the Ministry’s competence, regulations on assessment of conformity and responsiveness of technical infrastructure for construction investment projects;

g/ To guide, monitor and inspect the implementation of regulations on technical infrastructure.

9. Regarding road, railway, inland waterway, maritime and civil aviation transport infrastructure facilities:

a/ To submit to the Government regulations on management and protection of road, railway, inland waterway, maritime and civil aviation transport infrastructure facilities in accordance with law; to direct the implementation of transport infrastructure system development master plans and plans approved by the Government
or the Prime Minister;

b/ To promulgate national technical regulations on transport infrastructure and regulations on management, exploitation and maintenance of transport infrastructure according to the Ministry’s competence;

c/ To perform the tasks and exercise the powers of the ministry managing specialized construction works and the management agency in charge of transport infrastructure construction investment programs and projects; to announce the list of projects calling for investment and forms of transport infrastructure investment in accordance with law;

d/ To organize, guide and inspect the management, exploitation and maintenance of transport infrastructure facilities; to manage and exploit transport infrastructure assets under the Ministry’s management in accordance with law;

dd/ To submit to the Government or the Prime Minister for decision, or decide according to the Ministry’s competence, on the announcement, classification, naming, adjustment, closure, opening, dismantlement, commissioning, termination of or suspension from the exploitation of road, railway, inland waterway, maritime and civil aviation works in accordance with law;

e/ To organize the registration and grant of certificates and licenses within the Ministry’s competence and in accordance with law.

10. Regarding housing:

a/ To formulate mechanisms, policies and solutions for development of housing of all types, national target programs with housing-related support contents, and public investment programs on housing; to organize and direct the implementation of social housing development programs and national target programs with housing-related support contents;

b/ To formulate a national housing development strategy for each period, determining basic housing development indicators in national socio-economic development tasks for each period; to organize the implementation thereof after it is approved by the Prime Minister; to set funding levels for the formulation of provincial-level housing development programs and plans; to examine provincial-level housing development programs and plans under regulations;

c/ To set model contracts on purchase and sale, lease-purchase and lease of social houses, resettlement houses, and houses as public assets; and paper forms for proving satisfaction of conditions and subjects eligible for social housing support;

d/ To act as the owner’s representative for official residences and social houses constructed with central budget funds; and student houses currently managed by public education institutions attached to the Ministry;

dd/ To appraise housing-related contents for housing investment projects subject to the Prime Minister’s investment policy decision or approval in accordance with law; to assume the prime responsibility for appraising decisions on investment policy or decisions on investment in projects on construction of official residences or projects on purchase of commercial houses for use as official residences subject to the Prime Minister’s investment policy decision; to give opinions on official residence construction investment projects of the Ministry of National Defense and the Ministry of Public Security;

e/ To promulgate regulations on condominium management and use; to provide framework programs on professional training and further training in condominium operation management; to publicize the list of units qualified for condominium operation management on the Ministry’s Portal;

g/ To formulate and submit to the Prime Minister for promulgation standards, floor areas and norms of interior furniture of official residences, and decide on subjects entitled to use official residences of the ministries and sectors; to appraise, or give opinions on, the demand for official residences and plans on official residence development in accordance with law.

To build and manage the operation, maintenance, renovation, repair and lease of official residences for cadres of central agencies as assigned by the Prime Minister;

h/ To formulate and submit to the Government regulations on determination of rent rates of official residences; sale prices, rent rates, and lease-purchase prices of social houses not with public investment funds and the Trade Union’s financial sources; prices of social houses and houses for the people’s armed forces that are public assets; and methods of determining management and operation service charge rates for condominiums as public assets;

i/ To set requirements on the construction of multi-floor and multi-apartment buildings of individuals;

k/ To inspect the reservation of land areas and appropriateness of the reservation of land areas for development of social houses, accommodation houses for industrial park workers, and houses for the people’s armed forces under master plans and regulations;

l/ To approve, or report to the Prime Minister for decision, the conversion of house utilities in accordance with law.

11. Regarding the real estate market:

a/ To assume the prime responsibility for, and coordinate with other ministries, ministerial-level agencies and provincial-level People’s Committees in, formulating schemes and policies on real estate development, organization and management, and devising measures to regulate the real estate market;

b/ To manage the grant of real estate brokerage practice certificates and manage real estate brokerage activities; and the establishment and operation of real estate exchanges;

To promulgate framework programs for training and further training in knowledge for real estate brokerage practice and real estate exchange administration; to study models of real estate exchanges managed by the State;

c/ To guide and examine the implementation of the law on real estate business regarding conditions required for organizations and individuals wishing to conduct real estate business and conditions on real estate to be put for trading, and coordinate with provincial-level People’s Committees in inspecting and reviewing real estate business activities under regulations;

d/ To assume the prime responsibility for, and coordinate with other ministries, ministerial-level agencies and provincial-level People’s Committees in, building, managing and operating the national information system on housing and real estate market; to connect and share information from the housing and real estate market database with other related national databases and specialized databases in accordance with law; to formulate and announce indicators for evaluation of the real estate market nationwide;

dd/ To appraise or give opinions on the transfer of the whole or part of real estate projects subject to the Prime Minister’s consideration and decision; to give appraisal opinions on investment policy and investment policy adjustment for real estate projects in accordance with the law on real estate business that are subject to the Prime Minister’s investment policy approval under regulations;

e/ To assume the prime responsibility for, and coordinate with related agencies in, implementing measures to prevent and combat money laundering in the field of the real estate business in accordance with law.

12. Regarding building materials:

a/ To formulate and submit to competent authorities for promulgation legal documents and policies on management and development of building materials;

b/ To formulate, appraise and submit to competent authorities for approval or adjustment, master plans on group-II minerals in accordance with the planning and mineral laws; to guide and inspect the implementation of master plans on minerals after they are approved by the Prime Minister;

c/ To propose and report to the Prime Minister the promotion or restriction of the development, production, use, import and export of building materials; to promulgate regulations on technical criteria and guide the export of minerals for use as building materials under regulations;

d/ To propose and report to the Prime Minister roadmaps to reduce or eliminate establishments producing building materials involving outdated technology and intensive use of materials and energy and causing environment pollution; and roadmaps on use of non-baked building materials, resource-efficient, energy-efficient and eco-friendly building materials, and domestically produced building materials;

dd/ To guide and inspect provincial-level People’s Committees in the formulation, appraisal, approval and implementation management of local programs and plans on development of building materials; and local plans on exploration, exploitation and use of minerals for use as ordinary building materials in provincial master plans;

e/ To guide and inspect localities and enterprises in implementing the regulations on quality of products and goods as building materials;

g/ To guide the appraisal and assessment of quality of products and goods as building materials; and quality of minerals for use as building materials; to designate, and manage the operation of, conformity assessment organizations to serve the state management of quality of products and goods as building materials; to carry out inspection and quality conformity certification of products and goods as building materials and building components;

h/ To promulgate according to the Ministry’s competence, or submit to competent authorities for promulgation, lists of, and conditions for and technical regulations on, building materials to be imported or exported; building materials restricted from import or export; and building materials subject to conditional business; to guide and inspect the implementation thereof;

i/ To guide and inspect localities and enterprises in implementing the regulations on production and use of resource-efficient, energy-efficient and eco-friendly building materials in construction works.

13. Regarding means of transport, and complete parts, systems, spare parts and accessories thereof; vessels and equipment for offshore exploration, exploitation and transportation; special-use loading/unloading and construction vehicles and equipment; machines, equipment and supplies subject to strict requirements on occupational safety and health in transport (except vehicles for use for national defense and security purposes and fishing vessels), and special-use technical equipment and devices:

a/ To provide the registration of, and issuance of number plates for, railway and inland waterway means of transport and special-use vehicles and machines for operating on railways or inland waterways; to organize the registration of railway, inland waterway, maritime and civil aviation means of transport according to the Ministry’s competence and in accordance with law;

b/ To provide technical safety and environmental protection quality and occupational safety and health requirements for means of transport; and vessels and equipment for offshore exploration, exploitation and transport;

c/ To promulgate, and guide the implementation of, standards and technical regulations, provide the inspection, testing and certification of technical safety and environmental protection quality, manage activities of regulation conformity declaration and certification for road motor vehicles and complete parts, systems, spare parts and accessories thereof; railway, inland waterway, maritime and civil aviation means of transport; vessels and equipment for offshore exploration, exploitation and transport; special-use loading/unloading and construction vehicles and equipment, and special-use works, vehicles and equipment for the transport purpose and other purposes in accordance with law;

d/ To grant airworthiness certificates for aircraft; to grant export airworthiness certificates for aircraft and engines and propellers thereof upon export; to grant or recognize type certificates for aircraft and engines and propellers thereof upon their manufacture in Vietnam or import;

dd/ To provide the appraisal of technical designs in the manufacturing, assembly, repair, conversion or import of means of transport; special-use loading/unloading and construction vehicles and equipment; vessels and equipment for offshore exploration, exploitation and transport, and specialized transport technical equipment and devices in accordance with law;

e/ To grant licenses for establishments engaged in designing, manufacturing, repairing, maintaining or testing aircraft and engines, propellers, equipment and devices thereof in Vietnam; to specify conditions and procedures for grant of operation licenses for flight assurance service providers and flight assurance technical system and equipment suppliers; to promulgate national technical regulations applicable to establishments building or repairing seagoing ships and inland waterway craft; to specify conditions and standards for establishments engaged in inspecting technical safety and environmental protection quality of means of transport; vessels and equipment for offshore exploration, exploitation and transport, and other vehicles, equipment and works in accordance with law;

g/ To draw up the list of likely unsafe products and goods under regulations; to promulgate the process of inspecting and managing machines, equipment, supplies and substances subject to strict requirements on occupational safety and health under the Ministry’s management; to grant, re-grant, extend and revoke certificates of eligibility for  motor vehicle inspection, certificates of eligibility for occupational technical safety inspection under the Ministry’s competence.

14. Regarding occupational safety in construction activities:

a/ To assume the prime responsibility for formulating national standards on occupational safety and health, and formulate and promulgate national technical regulations on occupational safety and health in the fields under the Ministry’s management;

b/ To perform the state management of machines, equipment, supplies and substances subject to strict requirements on occupational safety and health and used in construction activities; to draw up a detailed list of machines, equipment, supplies and substances subject to strict requirements on occupational safety and health; to formulate and promulgate the process of inspecting, and guide and examine the inspection of, machines, equipment and supplies subject to strict requirements on occupational safety and health under the Ministry’s management after consulting competent agencies;

To develop, manage and update the database on technical inspection of occupational safety for machines, equipment and supplies subject to strict requirements on occupational safety and used in construction activities;

c/ To organize the training and further training in, and testing of, inspection of machines, equipment and supplies subject to strict requirements on occupational safety and health under the Ministry’s management;

d/ To grant, extend, re-grant and revoke certificates of eligibility for technical inspection of occupational safety and grant and re-grant inspector’s certificates under the Ministry’s management and publish information thereon on the Ministry’s website;

dd/ To guide the making of statistics, declaration and survey of and reporting on technical incidents affecting occupational safety under the Ministry’s management; to guide and inspect occupational safety and health falling under the Ministry’s management.

15. To provide the training, coaching, testing, grant, recognition and revocation of licenses, diplomas and professional certificates for operators of means of transport, operators of special-use vehicles and equipment in transport (except the tasks of testing and granting road vehicle driver licenses; operators of special-use vehicles and equipment for the national defense and security purposes and fishing vessels); registration and inspection officers, professional inspection staffs and persons performing special jobs in the field of transport under the Ministry’s competence.

16. Regarding road, railway, inland waterway, maritime and civil aviation transport and multi-modal transport:

a/ To guide and inspect the satisfaction of transport business conditions, the implementation of transport development mechanisms and policies, and the provision of transport support services under the Government’s regulations;

b/ To formulate and promulgate national technical regulations in the field of transport operation;

c/ To announce civil flight routes after they are licensed by the Prime Minister; to announce road, railway, inland waterway and maritime transport routes and the public transport network in accordance with law;

d/ To guide multi-modal transport under the Government’s regulations;

dd/ To license civil flight activities; to direct and inspect the implementation of regulations on coordinated management of civil flight activities;

e/ To provide in detail the management of activities at airports and aerodromes (excluding flight activities), seaports, inland container depots, inland waterway landing stages, and railway stations, and the management of railway, inland waterway and maritime transport routes.

17. Regarding transport security and safety (except the task of ensuring in-flight and ground security):

a/ To assume the prime responsibility for, or coordinate with others in, implementing strategies, programs, plans and general schemes on assurance of traffic safety nationwide after they are approved by the Government or the Prime Minister; to guide and inspect the implementation of regulations on assurance of road, railway, inland waterway, maritime and civil aviation traffic safety within the ambit of the Ministry’s functions and tasks;

b/ To promulgate civil aviation security and safety programs according to the Ministry’s competence; to provide in detail the formulation, evaluation and approval of ship security plans, seaport security plans, and water area and water zone security plans; to provide the grant of certificates related to seagoing ship security and seaport security; to assume the prime responsibility for, or coordinate with others in, carrying out inspection of, and providing information about, civil aviation and maritime security and safety in accordance with law;

c/ To organize investigation into aircraft incidents and accidents and maritime accidents within the Ministry’s competence and in accordance with law;

d/ To assume the prime responsibility for, or coordinate with others in, organizing search and rescue, and response to oil spill incidents in road, railway, inland waterway, maritime and civil aviation transport according to the Ministry’s competence.

18. Regarding environmental protection in construction and transport activities:

a/ To direct and guide the incorporation of master plans, plans and programs on environmental protection, digital transformation, green transformation, climate change response and energy efficiency and conservation in development strategies, master plans, plans and programs in the fields under the Ministry’s state management;

b/ To perform the state management of environmental protection in construction, management, exploitation and use of transport infrastructure; and management of activities of means of transport and other activities within the ambit of the Ministry’s competence in accordance with law and treaties to which the Socialist Republic of Vietnam is a contracting party;

c/ To provide the grant of certificates of conformity to environmental standards for road motor vehicles, railway, inland waterway and maritime means of transport, vehicles and equipment for offshore exploration, exploitation and transport, and civil aviation means of transport (except means of transport of the Army and the Public Security forces for use for the national defense and security purposes, and fishing vessels); to assume the prime responsibility for guiding the inspection and certification of conformity to environmental standards for automobiles and other motor vehicles;

d/ To formulate and promulgate according to the Ministry’s competence legal documents on environmental protection, climate change response and energy efficiency and conservation in the fields under the Ministry’s management in accordance with law;

dd/ To promulgate national technical regulations on technical safety and environmental protection quality of means of transport under the Ministry’s competence in accordance with law;

e/ To promulgate technical regulations on and norms of energy consumption, and guide and inspect means of transport’s compliance with energy consumption norms in accordance with law;

g/ To plan and organize environmental protection, climate change response and energy efficiency and conservation activities in the fields under the Ministry’s management;

h/ To develop and manage the network of special-use hydro-meteorological monitoring stations in the field of transport.

19. To formulate, and guide and organize the implementation of, the science, technology and innovation strategy; to organize the implementation of plans on scientific research and development, transfer and application of science and technology in the fields under the Ministry’s management; to appraise, evaluate and recognize construction technologies and scientific and technological advances in the fields under the Ministry’s state management; to develop, guide and inspect measurement and quality management activities for products and goods in the sectors and fields under the Ministry’s management; to direct the formulation and performance of the construction sector’s digital transformation tasks, programs and projects on application of information technology and building of e-government; to build and manage databases, ensuring information services serving the state management work and meeting needs of organizations and individuals engaged in construction and transport activities; to develop, and manage the operation of, the system of provision of online public services in the fields under the Ministry’s state management.

20. To organize the making of statistics and archive of documents and data in the fields under the Ministry’s state management in accordance with law.

21. Regarding public services:

a/ To perform the state management of public services in the sectors and fields under the Ministry’s state management in accordance with law;

b/ To set criteria and standards on public service quality; and mechanisms for testing, evaluation and inspection of public service quality and operation efficiency of public non-business units in the fields under the Ministry’s management;

c/ To guide organizations to provide public services in accordance with law.

22. Regarding enterprises and cooperatives:

a/ To submit to competent authorities for promulgation mechanisms and policies to promote and support the development of enterprises and cooperatives in the fields under the Ministry’s management in accordance with law, and coordinate with related agencies and organizations in directing, guiding and inspecting the organization of implementation thereof;

b/ To approve or submit to competent authorities for approval the overall scheme on restructuring and the scheme on reorganization, renewal and development of state enterprises operating in the fields under the Ministry’s state management, and direct the implementation thereof as assigned;

c/ To guide and inspect the implementation of regulations applicable to conditional sectors, trades and services, and handle violations according to the Ministry’s competence;

d/ To exercise the rights and perform the responsibilities and obligations of the state owner toward state enterprises and state capital amounts invested in other enterprises in accordance with law.

23. Regarding the form of public-private partnership:

a/ To promulgate or submit to competent authorities for promulgation legal documents, strategies and plans on investment from non-state budget funds in transport infrastructure projects;

b/ To submit to the Government or the Prime Minister for approval, or approve according to the Ministry’s competence, mechanisms and policies to attract non-state budget funds for transport infrastructure investment projects and services in the form of public-private partnership;

c/ To organize investment promotion activities and mobilize non-state budget funds in conformity with approved strategies, plans and lists of projects;

d/ To guide, examine and sum up the list of priority programs and projects for attraction of investment capital other than state budget funds; to monitor and evaluate programs and projects on the implementation and efficiency of attraction and use of investment capital other than state budget funds.

dd/ To manage and guide investment in the form of public-private partnership in the fields under the Ministry’s state management in accordance with the law on investment in the form of public-private partnership.

24. To formulate, and organize the implementation of, schemes, programs and projects to support and promote the development of construction mechanical engineering and transport products.

25. To formulate, and organize the implementation of, plans on and strategies for training and development of human resources for the sectors and fields under the Ministry’s state management; to formulate programs on, and organize, professional training and further training for the construction sector’s cadres, civil servants and public employees; to formulate programs on, and organize, training and further training in construction management, urban development and transport for leading and professional civil servants at all levels.

26. To formulate, and organize the implementation of, plans and programs on international cooperation and integration in the fields under the Ministry’s state management as assigned by the Government; to negotiate, conclude, and organize the implementation of, treaties in the name of the Government as authorized by the latter; to negotiate, conclude, and organize the implementation of, international agreements in the name of the Ministry in accordance with law; to join international organizations as assigned by the Government.

27. To decide on and direct the implementation of the Ministry’s administrative reform program according to the objectives and contents of the state administrative reform program approved by the Prime Minister; to request competent authorities to decide, or decide according to the Ministry’s competence, on the delegation of powers to local administrations to perform a number of tasks under the Ministry’s state management.

28. To perform the tasks and exercise the powers toward associations and non-governmental organizations under the Ministry’s state management in accordance with law.

29. To carry out inspection and examination, receive citizens, and settle complaints, denunciations, reports and petitions of organizations and citizens; to prevent and combat corruption, negative practices and waste, and handle violations in the fields under the Ministry’s state management in accordance with law.

30. To manage organizational apparatus, payroll, cadres, civil servants, public employees and workers; to implement the salary regime and regulations and policies on preferential treatment, commendation and disciplining of cadres, civil servants, public employees and workers; to train and further train cadres, civil servants and public employees under the Ministry’s state management.

31. To manage and organize financial affairs, state property, development investment and construction under the Ministry’s management; to organize the management of state budget funds allocated to the Ministry in accordance with law.

32. To perform other tasks as assigned or authorized by the Government or the Prime Minister and in accordance with law.

12. The Urban Development Agency.

13. The Construction Infrastructure Agency.

14. The Housing and Real Estate Market Management Agency.

15. The Department for Roads of Vietnam.

16. The Vietnam Maritime and Waterways Administration.

17. The Civil Aviation Authority of Vietnam.

18. The Vietnam Railways Authority.

19. The Vietnam Register.

20. The Information Technology Center.

21. The Construction Newspaper.

22. The Construction Journal.

23. The Academy of Strategic Studies and Construction Cadre Training.

The organizations specified in Clauses 1 thru 19 of this Article are those assisting the Minister in performing the state management function; the organizations specified in Clauses 20 thru 23 of this Article are public non-business units serving the performance of the Ministry’s state management.

The Plan-Finance Department has 5 divisions.

The Vietnam Maritime and Waterways Administration, the Civil Aviation Authority of Vietnam, and the Department for Roads of Vietnam may use their official seals bearing the national emblem.

The Minister of Construction shall promulgate decisions defining the functions, tasks, powers and organizational structures of units attached to the Ministry; and submit to the Prime Minister for promulgation a decision on the list of other public non-business units attached to the Ministry under regulations.

Article 4. Effect

1. This Decree takes effect on March 1, 2025.

2. This Decree replaces:

a/ The Government’s Decree No. 52/2022/ND-CP of August 8, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Construction; and,

b/ The Government’s Decree No. 56/2022/ND-CP of August 24, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Transport.

3. The Department for Roads of Vietnam, the Vietnam Expressway Authority, the Vietnam Maritime Administration, the Vietnam Inland Waterways Administration, and the Civil Aviation Authority of Vietnam may continue to operate under current regulations until the Minister of Construction completes the arrangement of, and promulgate decisions defining the functions, tasks, powers and organizational structures of, these units under regulations, which must be before March 31, 2025. The Enterprises Management Department may continue to operate to carry out legal procedures related to restructuring of the Shipbuilding Industry Corporation, and cease its operation before December 31, 2030.

Article 5. Implementation responsibility

The Minister of Construction, other ministers, heads of ministerial-level agencies, heads of government-attached agencies, and chairpersons of provincial-level People’s Committees shall implement this Decree.-
