Guiding the determination and management of detailed planning costs according to the shortened process

Pursuant to the Government’s Decree No. 52/2022/ND-CP dated August 8, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Construction;

Pursuant to the Government’s Decree No. 37/2010/ND-CP dated April 07, 2010, on the formulation, evaluation, approval and management of urban planning;

Pursuant to the Government’s Decree No. 44/2015/ND-CP dated May 6, 2015, detailing a number of contents on construction planning;

Pursuant to the Government’s Decree No. 72/2019/ND-CP dated August 30, 2019, on amending and supplementing a number of articles of Decree No. 37/2010/ND-CP of April 7, 2010, on the formulation, appraisal, approval and management of master plans on urban centers, and Decree No. 44/2015/ND-CP of May 6, 2015, detailing a number of provisions on construction master plans;

Pursuant to the Government’s Decree No. 35/2023/ND-CP dated June 20, 2023, amending and supplementing a number of articles of the decrees in the field of the state management by the Ministry of Construction;

At the request of the Director of the Institute of Construction Economics and the Director of the State Authority of Construction Economics;

The Minister of Construction promulgates the Circular guiding the determination and management of detailed planning costs according to the shortened process.

‎‎Article 1. Scope of regulation

1. This Circular guides the determination and management of detailed planning costs according to the shortened process (hereinafter referred to as total land ground planning costs) specified in Articles 1 and 2 of the Government’s Decree No. 35/2023/ND-CP dated June 20, 2023, amending and supplementing a number of articles of the Decrees relating to the Ministry of Construction’s state management.

2. This Circular applies to organizations and individuals using public investment capital and foreign investment capital to determine and manage the costs of total land ground planning.

‎‎Article 2. Determination of costs for elaboration and appraisal the total land ground planning

1. Costs of elaboration of the total land ground planning (for areas within the scope of urban development): shall be equal to 65% of costs of elaboration of the detailed urban planning. Costs of elaboration of the detailed urban planning shall be determined according to the current guidelines for determining the costs of elaborating detailed urban planning projects.

2. Costs of elaboration of the total land ground planning (for areas in functional areas): shall be equal to 65% of costs of the detailed construction planning of functional areas. Costs of elaboration of the detailed construction planning of functional areas shall be determined according to the current guidelines for determining the costs of elaborating functional area construction planning.

3. In case it is necessary to adjust the total land ground planning, the cost of adjusting the total land ground planning shall be determined according to the current guidelines for determining the cost of local adjustment of the urban planning project and construction planning.

4. Charge for appraisal of total land ground planning schemes shall be determined according to current regulations on charge for appraisal of planning schemes.

5. Costs for professional management of elaboration of the total land ground planning and other costs shall be determined according to current guidelines related to the cost of professional management of elaboration of the detailed urban planning and detailed construction planning.

‎‎Article 3. Management of costs for elaboration and appraisal of the total land ground planning

The management of costs for elaboration and charge for appraisal of total land ground planning; costs for professional management of elaboration of the total land ground planning shall comply with the regulations on management of costs of elaborating detailed urban planning, detailed construction planning or according to the current regulations on management of construction investment costs in case the project owner organizes the total land ground planning.

‎‎Article 4. Competence to appraise and approve the total land ground planning cost estimates

Agencies competent to approve the total land ground planning shall organize the appraisal and approval of cost estimates for elaboration, appraisal, and management of planning operations. In case the project owner organizes the elaboration of the total land ground planning, the competence to approve the cost of planning and management of planning operations shall comply with the current regulations on the management of construction investment costs.

Article 5. Effect

This Circular takes effect from July 15, 2024.
