RESOLUTION

Amending and supplementing a number of articles of the Constitution of the Socialist Republic of Vietnam

THE NATIONAL ASSEMBLY

Pursuant to the Constitution of the Socialist Republic of Vietnam;

Pursuant to the National Assembly’s Resolution No. 194/2025/QH15 dated May 5, 2025, amending and supplementing a number of articles of the 2013 Constitution;

RESOLVES:

Article 1

To amend and supplement a number of articles of the Constitution of the Socialist Republic of Vietnam as follows:

1. To amend and supplement Article 9 as follows:

“Article 9.

1. The Vietnam Fatherland Front is a political alliance and a voluntary union of the political organization, socio-political organizations and social organizations, and prominent individuals representing their class, social strata, ethnicity or religion and overseas Vietnamese.

The Vietnam Fatherland Front is a component of the political system of the Socialist Republic of Vietnam, under the leadership of the Communist Party of Vietnam. It constitutes the political base of the people’s administration; rally and fully utilizes the strength of the great national unity; reflects the will and aspirations of the People and promotes the People’s right to mastery; represents and protects the lawful and legitimate rights and interests of the People; exercises democracy and promotes social consensus; conducts social supervision and criticism; conveys the opinions and recommendations of the People to state agencies; and participates in the building of the Party and the State, and in people’s external relations’ activities, thus contributing to national construction and defense.

2. The Trade Union of Vietnam, the Vietnam Peasants’ Association, the Ho Chi Minh Communist Youth Union, the Vietnam Women’s Union and the Vietnam War Veterans’ Association are socio-political organizations affiliated to the Vietnam Fatherland Front, established on a voluntary basis to represent and protect the lawful and legitimate rights and interests of their members; organized and operating in a unified manner within the Vietnam Fatherland Front; and, together with other member organizations of the Fatherland Front, coordinate and unify action under the lead of the Vietnam Fatherland Front.

3. The Vietnam Fatherland Front, its member organizations and other social organizations shall operate within the framework of the Constitution and law. The State shall create the conditions for the Vietnam Fatherland Front, its member organizations and other social organizations to operate.”;

2. To amend and supplement Article 10 as follows:

“Article 10.

The Trade Union of Vietnam is a socio-political organization of the working class and laborers; represents, takes care for and protect the lawful and legitimate rights and interests of trade union members and laborers; is the sole representative of laborers at the national level in labor relations and international labor union relations; participates in the state management and socio-economic management; participates in the examination, inspection and supervision of the operations of state agencies, organizations, units and enterprises regarding issues related to the rights and obligations of laborers; and mobilizes laborers to learn to improve their professional qualifications and skills, abide by law, and build and defend the Fatherland.”;

3. To amend and supplement Clause 1, Article 84 as follows:

“1. The President, Standing Committee of the National Assembly, Ethnic Council and Committees of the National Assembly, Government, Supreme People’s Court, Supreme People’s Procuracy, State Audit Office, Central Committee of the Vietnam Fatherland Front, and central bodies of socio-political organizations have the right to submit draft laws to the National Assembly or submit draft ordinances to the Standing Committee of the National Assembly.”;

4. To amend and supplement Article 110 as follows:

“Article 110.

1. The administrative units of the Socialist Republic of Vietnam shall be organized into two tiers, including provinces, centrally-run cities and administrative units under provinces and centrally-run cities as prescribed by law.

2. Special administrative-economic units may be established by the National Assembly.

3. The establishment, dissolution, consolidation, separation or adjustment of the boundaries of, an administrative unit must be consulted with local People and must comply with the process and procedures prescribed by the National Assembly.”;

5. To amend and supplement Article 111 as follows:

“Article 111.

1. Local administrations shall be organized in administrative units of the Socialist Republic of Vietnam.

2. Local administration levels composed of the People’s Council and People’s Committee shall be organized in the administrative units consistent with the characteristics of the rural areas, urban areas, islands prescribed by the National Assembly.

3. Local administration of special administrative-economic units shall be prescribed by the National Assembly when establishing such units.”.

Article 2

1. This Resolution takes effect on the date of adoption.

The President shall publish this Resolution.

2. Operations of district-level administrative units nationwide shall be terminated from July 1, 2025.

3. When consolidating the organizational structure of agencies after the implementation of administrative unit rearrangement and the termination of the operation of district-level administrative units in 2025, the election of the titles of Chairpersons, Vice Chairpersons of People’s Councils, Heads of Committees of the People’s Councils, Chairpersons, Vice Chairpersons, Members of the People’s Committees at administrative units formed after the rearrangement shall not be conducted; neither shall the election of Heads or Deputy Heads of delegations of National Assembly deputies of provinces and centrally-run cities formed after the rearrangement. Based on the notice of the competent Party committee managing cadres, the Standing Committee of the National Assembly shall designate the Chairpersons, Vice Chairpersons of People’s Councils, Heads of Committees of the People’s Councils, Heads and Deputy Heads of delegations of National Assembly deputies of provinces and centrally-run cities formed after the rearrangement; the Prime Minister shall designate the Chairpersons and Vice Chairpersons of the People’s Committees of provinces and centrally-run cities formed after the rearrangement; the Standing Committees of the People’s Councils of provinces and centrally-run cities shall designate Members of the People’s Committees of the same level and designate the Chairpersons, Vice Chairpersons of People’s Councils, Heads of Committees of the People’s Councils, Chairpersons and Vice Chairpersons of the People’s Committees of subordinate administrative units formed after the rearrangement; the Standing Committees of the People’s Councils of administrative units under provinces or centrally-run cities formed after the rearrangement shall designate Members of the People’s Committees of the same level. In special cases, it is permitted to designate personnel who are not deputies of the People’s Council to assume the titles of Chairperson, Vice Chairperson, Heads of Committees of the People’s Council of the administrative units formed after the rearrangement or to serve as deputies of the People’s Council to form provisional People’s Councils in wards implementing the urban government model without organizing People’s Councils.
