RESOLUTION

Amending and supplementing a number of articles of the Constitution of the Socialist Republic of Vietnam[1]

 

THE NATIONAL ASSEMBLY

Pursuant to the Constitution of the Socialist Republic of Vietnam;

Pursuant to the National Assembly’s Resolution No. 194/2025/QH15 of May 5, 2025, on the amendment and supplementation of a number of articles of the 2013 Constitution;

RESOLVES:

Article 1. To amend and supplement a number of articles of the Constitution of the Socialist Republic of Vietnam as follows:

1. To amend and supplement Article 9 as follows:

“Article 9

1. The Vietnam Fatherland Front is a political alliance, a voluntary union of political organizations, socio-political organizations and social organizations, and prominent individuals representing their classes, social strata, ethnicities or religions and overseas Vietnamese.

The Vietnam Fatherland Front constitutes part of the political system of the Socialist Republic of Vietnam and submits to the leadership of the Communist Party of Vietnam; serves as the political base of the people’s administration; and shall rally, and bring into full play the strength of, the great national unity; express the will and aspirations, and promote the right to mastery, of the People; represent and protect the lawful and legitimate rights and interests of the People; exercise democracy and promote social consensus; conduct oversight and social criticism; convey the People’s opinions and petitions to state agencies; and participate in the building of the Party and the State, and in people’s diplomacy activities, thus contributing to the building and defense of the Fatherland.

2. The Trade Union of Vietnam, the Vietnam Peasants’ Association, the Ho Chi Minh Communist Youth Union, the Vietnam Women’s Union and the Vietnam Veterans’ Association are socio-political organizations under the Vietnam Fatherland Front, established on a voluntary basis to represent and protect the lawful and legitimate rights and interests of their members; are organized and operate uniformly within the Vietnam Fatherland Front; and, together with other member organizations of the Vietnam Fatherland Front, conduct democratic negotiations, and coordinate and unify actions under the chair of the Vietnam Fatherland Front.

3. The Vietnam Fatherland Front and its member organizations and other social organizations shall operate within the framework of the Constitution and law. The State shall create conditions for the operation of the Vietnam Fatherland Front and its member organizations and other social organizations.”;

2. To amend and supplement Article 10 as follows:

“Article 10

The Trade Union of Vietnam is a socio-political organization of the working class and of laborers; represents laborers, cares for and protects the lawful and legitimate rights and interests of its members and laborers; acts as the national-level sole representative of laborers in industrial relations and in international relations concerning trade unions; participates in state management and socio-economic management activities; participates in the examination, inspection and supervision of the operation of state agencies, organizations, units and enterprises regarding issues related to the rights and obligations of laborers; and mobilizes laborers to learn to improve their professional qualifications and skills, abide by law, and build and defend the Fatherland.”;

3. To amend and supplement Clause 1, Article 84 as follows:

“1. The President, the Standing Committee , the Ethnic Council and Committees of the National Assembly, the Government, the Supreme People’s Court, the Supreme People’s Procuracy, the State Audit Office of Vietnam, the Central Committee of the Vietnam Fatherland Front, and central bodies of socio-political organizations have the right to submit draft laws to the National Assembly or submit draft ordinances to the National Assembly Standing Committee.”;

4. To amend and supplement Article 110 as follows:

“Article 110

1. Administrative units of the Socialist Republic of Vietnam shall be organized into two tiers, including provinces and centrally run cities and administrative units under provinces and centrally run cities as specified by law.

2. Special administrative-economic units shall be established by the National Assembly.

3. The establishment, dissolution, consolidation, division, or adjustment of boundaries, of administrative units shall be subject to consultation with the local People and must comply with the order and procedures specified by the National Assembly.”;

5. To amend and supplement Article 111 as follows:

“Article 111

1. Local administrations shall be organized in administrative units of the Socialist Republic of Vietnam.

2. Local administrations, each composed of the People’s Council and the People’s Committee, shall be organized in administrative units as appropriate to the characteristics of rural areas, urban areas or islands as specified by the National Assembly.

3. Local administrations in special administrative-economic units shall be specified by the National Assembly upon the establishment of such special administrative-economic units.”.

Article 2

1. This Resolution takes effect on the date of its adoption.

The President shall announce this Resolution.

2. To terminate the operation of district-level administrative units nationwide from July 1, 2025.

3. When consolidating the organizational apparatus of agencies after the reorganization of administrative units and the termination of the operation of district-level administrative units in 2025, no elections shall be held for holders of the posts of the Chairpersons and Vice Chairpersons of the People’s Councils, the Heads of the Boards of the People’s Councils, and the Chairpersons, Vice Chairpersons and Members of the People’s Committees in the administrative units formed after the reorganization of administrative units; and no elections shall be held for the Heads and Deputy Heads of the National Assembly Deputies’ Delegations of the provinces and centrally run cities formed after the reorganization of administrative units. Based on the notices of the Party Committees with the cadre management competence, the National Assembly Standing Committee shall appoint the Chairpersons and Vice Chairpersons of the People’s Councils, the Heads of the Boards of the People’s Councils, and the Heads and Deputy Heads of the National Assembly Deputies’ Delegations of the provinces and centrally run cities formed after the reorganization of administrative units; the Prime Minister shall appoint the Chairpersons and Vice Chairpersons of the People’s Committees in the provinces and centrally run cities formed after the reorganization of administrative units; the Standing Bodies of the People’s Councils of provinces and centrally run cities shall appoint Members of the People’s Committees of the same level, and appoint the Chairpersons and Vice Chairpersons of the People’s Councils, the Heads of the Boards of the People’s Councils, and the Chairpersons and Vice Chairpersons of the People’s Committees of the subordinate administrative units formed after the reorganization of administrative units; and the Standing Bodies of the People’s Councils of the administrative units subordinate to provinces and centrally run cities formed after the reorganization of administrative units shall appoint Members of the People’s Committees of the same level. In special cases, it is permitted to appoint personnel who are not People’s Council deputies to hold the titles of the Chairpersons, Vice Chairpersons, and Heads of the Boards, of the People’s Councils in the administrative units formed after the reorganization of administrative units, or to act as People’s Council deputies to form the provisional People’s Councils in the wards where the urban administration model without People’s Council is currently applied.-

This Resolution was adopted on June 16, 2025, by the 15th National Assembly of the Socialist Republic of Vietnam, at its 9th session.-
