Promulgating the List of food, food additives, food containers, and packaging materials in direct contact with food with HS codes determined according to the Vietnam’s Nomenclature of exports and imports, subject to state inspection for food safety of imported goods under the Ministry of Health’s management

Pursuant to the Law on Food Safety dated June 17, 2010;

Pursuant to the Law on Customs dated June 23, 2014;

Pursuant to the Government’s Decree No. 08/2015/ND-CP dated January 21, 2015 detailing and providing measures to implement the Customs Law regarding customs procedures and customs inspection, supervision, and control;

Pursuant to the Government’s Decree No. 59/2018/ND-CP dated April 20, 2018 amending and supplementing a number of articles of the Government’s Decree No. 08/2015/ND-CP dated January 21, 2015 detailing and providing measures to implement the Customs Law regarding customs procedures and customs inspection, supervision, and control;

Pursuant to the Government’s Decree No. 15/2018/ND-CP dated February 2, 2018 detailing the implementation of a number of articles of the Law on Food Safety;

Pursuant to the Government’s Decree No. 95/2022/ND-CP dated November 15, 2022 defining the functions, tasks, powers and organizational structure of the Ministry of Health;

At the request of the Director of the Vietnam Food Administration;  

The Minister of Health promulgates the Circular on the List of food, food additives, food containers, and packaging materials in direct contact with food with HS codes determined according to the Vietnam’s Nomenclature of exports and imports, subject to state inspection for food safety of imported goods under the Ministry of Health’s management.

 

Article 1. Scope of regulation

This Circular issues the List and the principles for applying the List of food, food additives, food containers, and packaging materials in direct contact with food with HS codes determined according to the Vietnam’s Nomenclature of exports and imports issued together with Circular No. 31/2022/TT-BTC dated June 8, 2022, of the Minister of Finance, on promulgation of Vietnam’s Nomenclature of exports and imports subject to state inspection for food safety of imported goods under the management of the Ministry of Health (hereinafter referred to as the List).

Article 2. Issuance of the List

The List of food, food additives, food containers, and packaging materials in direct contact with food with HS codes determined according to the Vietnam’s Nomenclature of exports and imports, subject to state inspection for food safety of imported goods under the management of the Ministry of Health is issued together with this Circular.

Article 3. Principles for applying the List

1. In case of discrepancies or inconsistencies in the classification and determination of HS codes for goods in the List to this Circular, the determination of HS codes shall comply with the customs law.

2. For food, food additives, food containers, and packaging materials in direct contact with food that are not listed and assigned HS codes in the List to this Circular, the determination of HS codes shall comply with the customs law. After customs clearance, exporting and importing organizations and individuals shall send a written request to the Ministry of Health (Vietnam Food Administration) to serve as a basis for coordination with the Ministry of Finance to consider, agree upon, update, and issue a supplementary List.

3. State inspection of food safety for imported goods under the management of the Ministry of Health as prescribed in Article 37 of the Government’s Decree No. 15/2018/ND-CP dated February 2, 2018, detailing the implementation of a number of articles of the Law on Food Safety, shall be conducted as follows:

a) For goods on the List: Following Article 40 of the Law on Food Safety and Article 16 of the Government’s Decree No. 15/2018/ND-CP dated February 2, 2018, detailing the implementation of a number of articles of the Law on Food Safety.

b) For goods not on the List but failing to meet requirements in inspections and examinations (if any) or subject to warnings from the Ministry of Health, the Ministry of Agriculture and Rural Development, the Ministry of Industry and Trade, People's Committees of provinces and centrally-run cities, or competent authorities in foreign countries, or from manufacturers: Applying the strict inspection method as prescribed at Point b, Point c, Clause 3, Article 17 of the Government’s Decree No. 15/2018/ND-CP dated February 2, 2018, detailing the implementation of a number of articles of the Law on Food Safety. Competent authorities under the Ministry of Health are responsible for notifying customs authorities of the time of application and termination of the strict inspection method for these cases.

4. The following cases of imported food are exempt from or not subject to state inspection for food safety:

a) Goods on the List but falling under one of the cases specified in Article 13 of the Government’s Decree No. 15/2018/ND-CP dated February 2, 2018, detailing the implementation of a number of articles of the Law on Food Safety (except for cases with food safety warnings);

b) Goods on the List but not intended for use as food, food additives, or food processing aids;

c) Goods that are containers and packaging materials included in the List but do not contain and are not in direct contact with food;

d) Goods not on the List, except for the case specified at Point b, Clause 3, Article 2 of this Circular.

5. For mixed food additives with two (02) or more food additives included in the List, the HS codes of the goods shall be determined according to the six (06) general classification rules issued together with Circular No. 31/2022/TT-BTC dated June 8, 2022, of the Minister of Finance, on promulgation of Vietnam’s Nomenclature of exports and imports.

Article 4. Reference provisions

In case where the legal documents and regulations cited in this Circular are amended, supplemented, or replaced, the new legal documents shall apply.

Article 5. Effect

1. This Circular takes effect on November 2, 2024.

2. Circular No. 28/2021/TT-BYT dated December 20, 2021, of the Minister of Health, promulgating the List of foods, food additives and food packages and containers with commodity codes determined according to Vietnam’s List of imports and exports for state inspection of safety of imported foods, ceases to be effective from the effective date of this Circular.

Article 6. Responsibility of implementation

The Director of the Vietnam Food Administration; Heads of units under and affiliated to the Ministry of Health; Directors of Departments of Health, Departments of Food Safety of provinces and centrally-run cities; Heads of Food Safety Management Agencies under People's Committees of provinces and centrally-run cities; Heads of health agencies of Ministries and sectors; and related agencies, organizations, and individuals are responsible for implementing this Circular.

Any difficulties arising in the course of implementation should be reported to the Ministry of Health (Vietnam Food Administration) for consideration and resolution./.
