CIRCULAR

Prescribing the list, beneficiaries, scope, quality, maximum charges of public-utility telecommunications services and the levels of subsidies for the provision of public-utility telecommunications services by 2020

Pursuant to the Law on Telecommunications dated November 23, 2009;

Pursuant to the Law on Price dated June 20, 2012;

Pursuant to the Government’s Decree No. 17/2017/ND-CP dated February 17, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Information and Communications;

Pursuant to the Government’s Decree No. 25/2011/ND-CP dated April 06, 2011 detailing and guiding the implementation of a number of articles of the Law on Telecommunications; the Government’s Decree No. 81/2016/ND-CP dated July 01, 2016 on amending and supplementing a number of articles of the Government’s Decree No. 25/2011/ND-CP of April 6, 2011, detailing and guiding the implementation of a number of articles of the Law on Telecommunications and the Government’s Decree No. 49/2017/ND-CP dated April 24, 2017 on amending the Article 15 of the Government’s Decree No. 25/2011/ND-CP dated April 06, 2021 detailing and guiding the implementation of the Law on Telecommunications, and Article 30 of the Government’s Decree No. 174/2013/ND-CP dated November 13, 2013 on penalties for administrative violations in posts, telecommunications, information technology and radio frequency sectors;

Pursuant to the Government’s Decree No. 177/2013/ND-CP dated November 14, 2013 detailing and guiding a number of articles of the Law on Price and the Government’s Decree No. 149/2016/ND-CP dated November 11, 2016, amending and supplementing a number of articles of the Government’s Decree No. 177/2013/ND-CP dated November 14, 2013 detailing and guiding a number of articles of the Law on Price;

Implementing Decision No. 1168/QD-TTg dated July 24, 2015 of the Prime Minister approving the Program for provision of public-utility telecommunications services by 2020 and Decision No. 868/QD-TTg dated July 16, 2018 of the Prime Minister amending and supplementing Decision No. 1168/QD-TTg dated July 24, 2015 of the Prime Minister approving the Program for provision of public-utility telecommunications services by 2020;

At the proposal of the Director of the Authority of Telecommunications,

The Minister of Information and Communications hereby promulgates the Circular prescribing the list, beneficiaries, scope, quality, maximum rates of public-utility telecommunications services and the levels of subsidies for the provision of public-utility telecommunications services by 2020.

 

Chapter I

GENERAL PROVISIONS

 

Article 1. Scope of regulation

This Circular prescribes the list of public-utility telecommunications services, beneficiaries, scope, quality, maximum rates of public-utility telecommunications services and the levels of subsidies for the provision of public-utility telecommunications services by 2020.

Article 2. Subjects of application

This Circular applies to enterprises, organizations, and individuals providing and using public-utility telecommunications services and authorities, organizations, and individuals involved in the management of the provision and use of public-utility telecommunications services in Vietnam.

 

Chapter II

LIST OF PUBLIC-UTILITY TELECOMMUNICATIONS SERVICES

 

Article 3. List of mandatory public-utility telecommunications services

Mandatory public-utility telecommunications services include:

1. Emergency public-utility telecommunications services (calls to emergency telephone numbers, including 113 (Police), 114 (Firefighters), and 115 (Medical Emergency)).

2. Maritime mobile public-utility telecommunications service for search and rescue operations at sea via the coastal radio system.

3. Satellite public-utility telecommunications services for directing and managing natural disaster prevention and control.

Article 4. List of universal public-utility telecommunications services

Universal public-utility telecommunications services include:

1. Public-utility telecommunications service of assistance for search for landline telephone subscriber numbers (calls to 116 (the service of assistance for search for landline telephone subscriber numbers)).

2. Postpaid landline telephone public-utility telecommunications service.

3. Postpaid land mobile information public-utility telecommunications service.

4. Maritime mobile public-utility telecommunications service for fishing vessels at sea via the coastal radio system.

5. Postpaid landline broadband Internet access public-utility telecommunications service.

6. Leased landline public-utility telecommunications service.

7. Public-utility telecommunications service of transmitting digital television signals via VINASAT satellite.

8. Public-utility telecommunications service of leasing optical fiber transmission lines on the fiber-optic communication infrastructure of Vietnam Electricity (EVN).

9. Public-utility telecommunications service of digital microwave transmission to provide broadband services for island districts.

10. Public-utility telecommunications service of leasing satellite capacity to provide broadband services for island districts.

 

Chapter III

BENEFICIARIES, SCOPE, MAXIMUM PUBLIC-UTILITY CHARGES, AND LEVELS OF SUBSIDIES FOR THE PROVISION OF MANDATORY PUBLIC-UTILITY TELECOMMUNICATIONS SERVICES

 

Article 5. Emergency public-utility telecommunications services

1. Beneficiaries of emergency public-utility telecommunications service charges include:

a) Users of the landline telephone service making calls to emergency telephone numbers;

b) Users of the land mobile information service making calls to emergency telephone numbers.

2. Beneficiaries of subsidies for the provision of emergency public-utility telecommunications services include:

a) Telecommunications enterprises providing the local landline telephone service for calls to emergency telephone numbers;

b) Telecommunications enterprises providing land mobile information service for calls to emergency telephone numbers.

3. The charge for emergency public-utility telecommunications services applied to the beneficiaries prescribed in Clause 1 of this Article is 0 VND/minute.

4. The subsidy level for telecommunications enterprises providing the local landline telephone service originating calls to emergency telephone numbers is 200 VND/minute (two hundred Vietnamese dong per minute). The amount of time subject to subsidies of each instance of communications shall be rounded to minutes.

5. The subsidy level for telecommunications enterprises providing land mobile information services originating calls to emergency telephone numbers is equal to the connection charge (excluding value-added tax) as prescribed by law at the time of the respective calls. The amount of time subject to subsidies of each instance of communications shall be rounded to minutes.

Article 6. Maritime mobile public-utility telecommunications service via the coastal radio system for search and rescue operations at sea

1. The beneficiaries of the charge of the maritime mobile public-utility telecommunications service via the coastal radio system for search and rescue operations at sea are Vietnamese fishermen on fishing vessels at sea using such service within the Vietnamese sea.

 2. The beneficiaries of subsidies for the maritime mobile public-utility telecommunications service for search and rescue operations at sea via the coastal radio system are telecommunications enterprises providing the service to the beneficiaries prescribed in Clause 1 of this Article.

3. The charge for the maritime mobile public-utility telecommunications service for search and rescue operations at sea via the coastal radio system applied to the beneficiaries prescribed in Clause 1 of this Article is 0 VND/minute.

4. The subsidy level for enterprises prescribed in Clause 2 of this Article is 6,500 VND/minute (six thousand five hundred Vietnamese dong per minute). The amount of time subject to subsidies of each event shall be rounded to minutes. The total subsidized time for search and rescue operations in a year is not more than 20,000 (twenty thousand) hours.

Article 7. Satellite public-utility telecommunications services for directing and managing natural disaster prevention and control

1. The beneficiaries of satellite public-utility telecommunications services for directing and managing natural disaster prevention and control are members of the Central Steering Committee for Natural Disaster Prevention and Control using satellite public-utility telecommunications services for directing and managing natural disaster prevention and control.

2. The beneficiaries of subsidies for the provision of satellite public-utility telecommunications services for directing and managing natural disaster prevention and control are telecommunications enterprises providing services to the beneficiaries prescribed in Clause 1 of this Article.

3. The charge for satellite public-utility telecommunications services for directing and managing natural disaster prevention and control applied to the beneficiaries prescribed in Clause 1 of this Article is 0 VND/respective measurement unit used.

4. The subsidy level for telecommunications enterprises prescribed in Clause 2 of this Article is specified as follows:

a) The subsidy level for enterprises providing VINASAT C-band satellite capacity leasing service is 36,450,000 VND/MHz/month (thirty-six million four hundred fifty thousand Vietnamese dong per Megahertz per month);

b) The subsidy level for enterprises providing VSAT-IP telecommunications services includes a subscription subsidy of 27,000 VND/subscriber/month (twenty-seven thousand Vietnamese dong per subscriber per month) and a call/fax service subsidy of 1,744 VND/minute (one thousand seven hundred forty-four Vietnamese dong per minute);

c) The subsidy level for enterprises providing 3,072/384 kbps Internet access telecommunications service from VSAT-IP stations is VND 53,000/day (fifty-three thousand Vietnamese dong per day);

d) The subsidy level for enterprises providing the IP leased line service and virtual private network (VPN) service using symmetrical two-way channels of VSAT-IP stations is specified as follows:

Chapter IV

BENEFICIARIES, SCOPE, MAXIMUM PUBLIC-UTILITY CHARGES, AND LEVELS OF SUBSIDIES FOR THE PROVISION OF UNIVERSAL PUBLIC-UTILITY TELECOMMUNICATIONS SERVICES

 

Article 8. Public-utility telecommunications service of assistance for search for landline telephone subscriber numbers

1. The beneficiaries of the charges for public-utility telecommunications service of assistance for search for landline telephone subscriber numbers are users of local landline telephone services to call the number of the service of assistance for search for landline telephone subscriber numbers.

2. The beneficiaries of subsidies for the provision of public-utility telecommunications service of assistance for search for landline telephone subscriber numbers are telecommunications enterprises providing the service of assistance for search for landline telephone subscriber numbers of the respective enterprises.

3. The charge for public-utility telecommunications service of assistance for search for landline telephone subscriber numbers applied to the beneficiaries prescribed in Clause 1 of this Article is VND 0/minute.

4. The subsidy level for telecommunications enterprises prescribed in Clause 2 of this Article to provide public-utility telecommunications service of assistance for search for landline telephone subscriber numbers for the beneficiaries prescribed in Clause 1 of this Article is VND 1,500/minute (one thousand five hundred Vietnamese dong per minute). The amount of time subject to subsidies of each instance of communications shall be rounded to minutes.

Article 9. Postpaid landline telephone public-utility telecommunications service

1. The beneficiaries of postpaid landline telephone public-utility telecommunications service charges must meet all of the following conditions:

a) They are poor or near-poor households at national poverty lines;

b) They subscribe to use the postpaid landline telephone public-utility telecommunications service;

c) They have not registered to receive subsidies or have registered to stop receiving subsidies for using the postpaid land mobile information public-utility telecommunications service;

d) Each poor or near-poor household is only entitled to receive subsidies for using the postpaid landline telephone public-utility telecommunications service associated with one landline telephone number of only one telecommunications enterprise.

2. The beneficiaries of subsidies for the provision of the postpaid landline telephone public-utility telecommunications service are telecommunications enterprises providing such service to poor and near-poor households prescribed in Clause 1 of this Article.

3. The charge of a postpaid landline telephone public-utility telecommunications service plan for the beneficiaries prescribed in Clause 1 of this Article is VND 0/month/subscriber.

4. The subsidy level for telecommunications enterprises prescribed in Clause 2 of this Article to provide the postpaid landline telephone public-utility telecommunications service to the beneficiaries prescribed in Clause 1 of this Article is VND 20,000/month/subscriber (twenty thousand Vietnamese dong per month per subscriber).

Article 10. Postpaid land mobile information public-utility telecommunications service

1. The beneficiaries of the postpaid land mobile information public-utility telecommunications service charges must meet all of the following conditions:

a) They are poor or near-poor households at national poverty lines;

b) They subscribe to use the postpaid land mobile information public-utility telecommunications service;

c) They have not registered to receive subsidies or have registered to stop receiving subsidies for using the postpaid landline telephone public-utility telecommunications service;

d) Each poor or near-poor household is only entitled to receive subsidies for using the postpaid land mobile information public-utility telecommunications service associated with one land mobile information service subscriber number of only one telecommunications enterprise.

2. The beneficiaries of subsidies for the provision of the postpaid land mobile information public-utility telecommunications service are telecommunications enterprises providing public-utility telecommunications services to poor and near-poor households prescribed in Clause 1 of this Article.

3. The charge of the postpaid land mobile information public-utility telecommunications service for the beneficiaries prescribed in Clause 1 of this Article is VND 0/month/subscriber.

4. The maximum subsidy level for telecommunications enterprises prescribed in Clause 2 of this Article to provide the postpaid land mobile information public-utility telecommunications service to the beneficiaries prescribed in Clause 1 of this Article is VND 45,000/month/subscriber (forty-five thousand Vietnamese dong per month per subscriber).

5. In cases where poor or near-poor households use up the amount of subsidies in a communication month, outgoing calls will be no longer subsidized (one-way lock) until the beginning of the following subsidized communication month. In cases where poor or near-poor households do not use up the amount of subsidies in a communication month, the remaining amount will be carried over to the following subsidies months.

Article 11. Maritime mobile public-utility telecommunications services via the coastal radio system

1. The beneficiaries of the charges of the maritime mobile public-utility telecommunications services via the coastal radio system are Vietnamese fishermen on fishing vessels at sea using such service originating within the Vietnamese sea.

2. The beneficiaries of subsidies for the provision of maritime mobile public-utility telecommunications services via the coastal radio system are telecommunications enterprises providing services to the beneficiaries prescribed in Clause 1 of this Article.

3. The maximum public-utility charge for maritime mobile public-utility telecommunications services via the coastal radio system applied to the beneficiaries prescribed in Clause 1 of this Article is VND 1,800/minute (one thousand eight hundred Vietnamese dong per minute).

4. The subsidy level for telecommunications enterprises prescribed in Clause 2 of this Article is VND 1,000/minute (one thousand Vietnamese dong per minute). The amount of time subject to subsidies of each instance of communications shall be rounded to minutes.

Article 12. Public Internet access service points

1. The beneficiaries of subsidies for maintaining the operation of public Internet access service points are telecommunications enterprises providing public Internet access services within the scope of the Program for provision of public-utility telecommunications services by 2020 under Decision No. 1168/QD-TTg dated July 24, 2015 of the Prime Minister.

2. The subsidy level for the beneficiaries prescribed in Clause 1 of this Article to maintain the operation of public Internet access service points is VND 1,500,000/month/point (one million five hundred thousand Vietnamese dong per month per point).

3. Public Internet access service points eligible for the subsidies prescribed in Clause 2 of this Article must meet all of the following conditions:

a) They are public Internet access service points that are still operating within the scope of the Program for provision of public-utility telecommunications services by 2010 under Decision No. 74/2006/QD-TTg dated April 7, 2006 of the Prime Minister, specifically those that are still operating at the time of being subsidized within the scope of the Program for provision of public-utility telecommunications services under Decision No. 74/2006/QD-TTg dated April 7, 2006 of the Prime Minister; or are among 500 public Internet access service points developed in communes with a low percentage of households subscribing to fixed broadband Internet access services and no public Internet access service points under Decision No. 1168/QD-TTg dated July 24, 2015 of the Prime Minister;

b) They are public Internet access service points with at least 03 computers for Internet access to directly provide the Internet access service to service users.

Article 13. Postpaid landline broadband Internet access public-utility telecommunications service

1. The beneficiaries of the postpaid landline broadband Internet access public-utility telecommunications service charge are subscribers using the postpaid landline broadband Internet access public-utility telecommunications service of the following organizations:

a) Preschools established under decisions of the Chairpersons of the People's Committees of urban districts, rural districts, towns, or provincial cities;

b) Primary schools;

c) High schools, including one-level or multi-level schools;

d) Trade schools;

dd) Colleges;

e) Universities;

g) Vocational education - continuing education centers;

h) District-, provincial-, and central-level State-owned specialist hospitals and general hospitals; private specialist hospitals and general hospitals; foreign-invested specialist hospitals and general hospitals;

i) Commune-level People's Committees.

2. Each organization prescribed in Clause 1 of this Article is only entitled to receive subsidies for using one postpaid landline broadband Internet access public-utility telecommunications service plan of only one telecommunications enterprise.

3. The beneficiaries of subsidies for the provision of the postpaid landline broadband Internet access public-utility telecommunications service are telecommunications enterprises providing the service to the beneficiaries prescribed in Clause 1 of this Article.

4. The maximum public-utility charge for the postpaid fixed landline broadband Internet access public-utility telecommunications service applied to the beneficiaries prescribed in Clause 1 of this Article is specified as follows:

a) VND 75,000/month/organization (seventy-five thousand Vietnamese dong per month per organization) when using a postpaid landline broadband Internet access service plan with a maximum download speed of between 4 Mbps and less than 12 Mbps;

b) VND 100,000/month/organization (one hundred thousand Vietnamese dong per month per organization) when using a postpaid landline broadband Internet access service plan with a maximum download speed of between 12 Mbps and less than 32 Mbps;

c) VND 250,000/month/organization (two hundred fifty thousand Vietnamese dong per month per organization) when using a postpaid landline broadband Internet access service plan with a maximum download speed of between 32 Mbps and less than 45 Mbps;

d) VND 450,000/month/organization (four hundred fifty thousand Vietnamese dong per month per organization) when using a postpaid landline broadband Internet access service plan with a maximum download speed of 45 Mbps or more.

5. The subsidy level for telecommunications enterprises prescribed in Clause 2 of this Article to provide the postpaid landline broadband Internet access public-utility telecommunications service to the beneficiaries prescribed in Clause 1 is specified as follows:

a) VND 50,000/month/organization (fifty thousand Vietnamese dong per month per organization) when the enterprise provides a postpaid landline broadband Internet access service plan with a maximum download speed of between 4 Mbps and less than 12 Mbps;

b) VND 100,000/month/organization (one hundred thousand Vietnamese dong per month per organization) when the enterprise provides a postpaid landline broadband Internet access service plan with a maximum download speed of between 12 Mbps and less than 32 Mbps;

c) VND 150,000/month/organization (one hundred fifty thousand Vietnamese dong per month per organization) when the enterprise provides a postpaid landline broadband Internet access service plan with a maximum download speed of between 32 Mbps and less than 45 Mbps;

d) VND 250,000/month/organization (two hundred fifty thousand Vietnamese dong per month per organization) when the enterprise provides a postpaid landline broadband Internet access service plan with a maximum download speed of between 45 Mbps or more.

Article 14. Leased landline public-utility telecommunications service

1. The beneficiaries of the leased landline public-utility telecommunications service charges with backup must meet all of the following conditions:

a) They are satellite hospitals or core hospitals of the Satellite Hospital Project for the 2013-2020 period under Decision No. 774/QD-BYT dated March 11, 2013 of the Minister of Health;

b) They obtain confirmation from the provincial-level Departments of Health in the localities where the hospitals are headquartered that such hospitals are then implementing the Project for the provision of remote medical examination and treatment consultancy using information technologies (Telemedicine Project) under Decision No. 774/QD-BYT dated March 11, 2013 of the Minister of Health;

c) They subscribe to use the leased landline service with backup to connect the satellite hospitals with the core hospital in the group.

2. Each satellite hospital or core hospital prescribed in Clause 1 of this Article is only entitled to the public-utility telecommunications service charge for one leased landline with backup of only one telecommunications enterprise.

3. The beneficiaries of subsidies for the provision of leased landline public-utility telecommunications services with backup are telecommunications enterprises providing services to the beneficiaries prescribed in Clauses 1 and 2 of this Article.

4. The charge for leased landline public-utility telecommunications service with backup is VND 0/month/subscriber.

5. The maximum subsidy level for telecommunications enterprises prescribed in Clause 3 of this Article to provide leased landline public-utility telecommunications services with backup to the beneficiaries prescribed in Clause 1 of this Article is VND 15,000,000/month/channel with backup (fifteen million Vietnamese dong per month per channel with backup).

Article 15. Public-utility telecommunications service of transmitting digital television signals for a television channel using the Ku band of VINASAT satellite

1. The beneficiaries of the charge for the public-utility telecommunications service of transmitting digital television signals for a local television channel using the Ku band of VINASAT satellite must meet all of the following conditions:

a) They are provincial-level radio and television stations that are not financially autonomous;

b) They use such service to broadcast television programs serving political tasks and essential information and communications for one of the following areas: mountainous areas, border areas, islands, or areas that are difficult to receive terrestrial digital television signals.

2. Each provincial-level radio and television station prescribed in Clause 1 of this Article is only entitled to the charge for the public-utility telecommunications service of transmitting digital television signals for a local television channel using the Ku band of VINASAT satellite of only one telecommunications enterprise that has a license to provide direct-to-home television services via satellite and is performing a contract to provide broadcasting transmission services on the Ku band of VINASAT satellite for provincial-level radio and television stations.

3. The beneficiaries of subsidies for the provision of the public-utility telecommunications service of transmitting digital television signals for a local television channel using the Ku band of VINASAT satellite are telecommunications enterprises that have licenses to provide direct-to-home television services via satellite and are performing contracts to provide broadcasting transmission services on the Ku band of VINASAT satellite for provincial-level radio and television stations prescribed in Clauses 1 and 2 of this Article.

4. The charge for the public-utility telecommunications service of transmitting digital television signals for a television channel using the Ku band of VINASAT satellite applied to the beneficiaries prescribed in Clauses 1 and 2 of this Article is VND 0/month/television channel using the Ku band (including the transmission from the provincial-level radio and television station to the uplink location to VINASAT satellite).

5. The maximum subsidy level for the beneficiaries prescribed in Clause 3 of this Article to provide services to the beneficiaries prescribed in Clauses 1 and 2 of this Article is VND 150,000,000/month/television channel (one hundred fifty million Vietnamese dong per month per television channel) using the Ku band of VINASAT satellite.

Article 16. Public-utility telecommunications service of fiber-optic transmission from the mainland to the administrative centers of island districts

1. The beneficiaries of subsidies for establishing optical fiber transmission lines from the mainland to the administrative centers of island districts on the fiber-optic communication infrastructure of entities under Vietnam Electricity (EVN) to provide public-utility telecommunications services are telecommunications enterprises leasing optical fiber cables of such entities under Vietnam Electricity (EVN) connecting from the mainland to the administrative centers of island districts.

2. The subsidy level for telecommunications enterprises prescribed in Clause 1 of this Article is equal to 50% of the value of the pre-VAT invoices for optical fiber cable lease that the respective entities under Vietnam Electricity (EVN) issue to the telecommunications enterprises when leasing their optical fiber cables connecting from the mainland to the administrative centers of island districts.

Article 17. Public-utility telecommunications service of digital microwave transmission to provide broadband services for island districts

1. The beneficiaries of subsidies for public-utility telecommunications service of digital microwave transmission to provide broadband services for island districts are telecommunications enterprises leasing digital microwave transmission lines to provide broadband services for island districts.

2. The subsidy level for telecommunications enterprises prescribed in Clause 1 of this Article is equal to 50% of the value of the pre-VAT invoices for digital microwave transmission line lease hat the leasing enterprises issue to the telecommunications enterprises when leasing digital microwave transmission lines to provide broadband services for island districts.

Article 18. Public-utility telecommunications service of satellite transmission to provide broadband services for island districts

1. The beneficiaries of subsidies for public-utility telecommunications service of satellite transmission to provide broadband services for island districts are telecommunications enterprises leasing satellite capacity to provide broadband services for island districts.

2. The subsidy level for telecommunications enterprises prescribed in Clause 1 of this Article is VND 36,450,000/MHz/month (thirty-six million four hundred fifty thousand Vietnamese dong per Megahertz per month).

 

Chapter V

IMPLEMENTATION PROVISIONS

 

Article 19. Regulations on value-added tax (VAT) and invoices involving public-utility telecommunications services

The collection of value-added tax on public-utility telecommunications services and on the subsidies for the provision of public-utility telecommunications services, and the issuance of invoices involving public-utility telecommunications services shall be conducted in accordance with the law regulations on tax, accounting, and auditing.

Article 20. Responsibilities of telecommunications enterprises for quality when providing public-utility telecommunications services

Telecommunications enterprises are responsible for providing public-utility telecommunications services with quality in accordance with applicable regulations and standards on telecommunications service quality.

Article 21. Responsibilities of telecommunications enterprises for public-utility charges when providing public-utility telecommunications services

1. For public-utility telecommunications services prescribed in Articles 5, 6, 7, 8, and 14 of this Circular, telecommunications enterprises are responsible for providing services to beneficiaries of public-utility telecommunications services at the proper public-utility charges, and using the usage time and charge calculation methods as prescribed in the respective Articles.

2. For public-utility telecommunications services prescribed in Articles 9, 10, 11, and 13 of this Circular, telecommunications enterprises providing public-utility telecommunications services shall:

a) Issue decisions on the specific public-utility charge applied to each public-utility telecommunications service provided by them. The public-utility charges set by the enterprises must not be higher than the respective maximum public-utility charges prescribed in this Circular;

b) Submit reports on public-utility telecommunications service charges to the Ministry of Information and Communications at least 03 (three) working days before their decisions on such public-utility charges takes effect. In cases where their decisions on such public-utility charges are found to be inconsistent with current regulations on the management of public-utility telecommunications service charges, the Ministry of Information and Communications shall send written requests to the respective enterprises to review and adjust them accordingly.

A dossier of reporting on public-utility telecommunications service charges shall comprise: a written report on the public-utility charges of the enterprise; the decision on the public-utility charges of the enterprise; a list of subscription plans with the same content as the public-utility plans reported by the enterprise.

c) Apply the methods of calculating the usage time and the public-utility telecommunications service charges, which are currently applied by the telecommunications enterprises, to service users who are not beneficiaries of the public-utility telecommunications services of such respective plans.

Article 22. Effect and organization of implementation

1. This Circular takes effect from April 01, 2020.

2. Circular No. 09/2016/TT-BTTTT dated March 30, 2016 of the Minister of Information and Communications detailing the list, beneficiaries, scope, quality, charges, charge brackets, and the levels of subsidies for the provision of public-utility telecommunications services by 2020 ceases to be effective from the time this Circular takes effect.

3. The Chief of Ministerial Office, Director of the Authority of Telecommunications, Director of the Vietnam Public-Utility Telecommunications Service Fund, Director of the Management Board of the Program for provision of public-utility telecommunications services, heads of under-ministerial authorities and units, Directors of Departments of Information and Communications of provinces and municipalities, General Directors or Directors of telecommunications enterprises, and relevant organizations and individuals shall implement this Circular./.
