RESOLUTION
Defining the support levels of health insurance premiums for elderly and pupils in Ho Chi Minh City
Pursuant to the Law No. 72/2025/QH15 on Organization of Local Administration;
Pursuant to the Law No. 64/2025/QH15 on Promulgation of Legal Documents, which was amended and supplemented by the Law No. 87/2025/QH15;
Pursuant to the Law No. 25/2008/QH12 on Health Insurance, which was amended and supplemented by the Law No. 51/2024/QH15;
Pursuant to the Law No. 41/2024/QH15 on Social Insurance;
Pursuant to the National Assembly’s Resolution No. 202/2025/QH15 on the reorganization of provincial-level administrative divisions;
Pursuant to the Government’s Decree No. 78/2025/ND-CP detailing a number of articles of, and providing measures for organizing and guiding the implementation of the Law on Promulgation of Legal Documents;
Pursuant to the Government’s Decree No. 79/2025/ND-CP on defining the inspection, review, systematization, and handling of legal documents;
Pursuant to the Government’s Decree No. 187/2025/ND-CP amending and supplementing a number of articles of the Government’s Decree No. 78/2025/ND-CP dated April 01, 2025 detailing a number of articles of, and providing measures for organizing and guiding the implementation of the Law on Promulgation of Legal Documents and the Government’s Decree No. 79/2025/ND-CP dated April 01, 2025 on defining the inspection, review, systematization, and handling of legal documents;
Pursuant to the Government's Decree No. 188/2025/ND-CP detailing, and guiding the implementation of, a number of articles of the Law on Health Insurance;
Considering Report No. 690/TTr-UBND dated November 03, 2025, of the City People's Committee drafting the Resolution defining the support levels of health insurance premiums for groups of subjects in Ho Chi Minh City; Verification Report No. 755/BC-BVHXH dated November 13, 2025, of the Culture - Society Committee of the City People's Council; opinions of City People's Council deputies at the session;
The Ho Chi Minh City People’s Council hereby promulgates the Resolution defining the support levels of health insurance premiums for elderly and pupils in Ho Chi Minh City.
Article 1. Scope of regulation and subjects of application
1. Scope of regulation
This Resolution defines the support levels of health insurance premiums for elderly and pupils in Ho Chi Minh City.
2. Subject of application
a) Persons aged between full 65 years and under 75 years who are permanent residents in Ho Chi Minh City and have not yet received health insurance-related support from other policies (collectively referred to as the elderly).
b) General education students; learners in general education programs, including: learners in continuing education programs at the lower secondary level and learners in continuing education programs at the upper secondary level in public and non-public education institutions in Ho Chi Minh City (collectively referred to as pupils).
c) Agencies, organizations, and individuals involved in the implementation of this Resolution.
Article 2. Support levels of health insurance premiums
1. To provide the support of 100% of the health insurance premiums for elderly.
2. To provide the support of 50% of the health insurance premiums for pupils (so that the pupils are entitled to the support of 100% of health insurance premiums).
Article 3. Funding source for implementation
The funding source for implementation shall be allocated from the State budget in accordance with current regulations on budget decentralization.
Article 4. Organization of implementation
1. the City People's Committee is assigned to organize the implementation of this Resolution.
2. The Standing Committee of the People's Council, the Committees of the People's Council, the groups of deputies, and deputies of the City People's Council shall strictly supervise the process of organizing the implementation of this Resolution.
Article 5. Implementation provisions
1. This Resolution takes effect on November 14, 2025.
2. In case the subjects of this Resolution already have health insurance cards, the support levels shall be applied starting from the day immediately following the expiration date of such health insurance cards.
3. To repeal the following Resolutions:
a) Resolution No. 12/2024/NQ-HDND of the People's Council of Ba Ria - Vung Tau Province defining the policy on support of health insurance cards for persons aged full 65 years or older who are permanent residents in Ba Ria - Vung Tau Province.
b) Resolution No. 04/2020/NQ-HDND of the People's Council of Ba Ria - Vung Tau Province specifying the support levels for health insurance premiums for pupils and students at education and training institutions in Ba Ria - Vung Tau Province.
4. To repeal part of a number of Resolutions as follows:
a) The content specified that the elderly aged between 70 and 79 years shall be eligible for support of 100% health insurance premiums at Point a Clause 2 Article 1; Point b Clause 2 Article 1 of the Resolution No. 15/2022/NQ-HDND of the People's Council of Binh Duong Province defining the support levels of voluntary social insurance and health insurance premiums for a number of subjects in Binh Duong Province in the period 2023 - 2025;
b) The content specified that the elderly aged from full 75 years or older who are members of poor households or households living just above the poverty line according to the City's multidimensional poverty standards and currently reside in Can Gio District under the Law on Residence shall be eligible for free health insurance cards at Point a Clause 1 Article 1; Point c Clause 4 Article 1 of the Resolution No. 35/2023/NQ-HDND of the Ho Chi Minh City People's Council on specific policies for caring for and supporting the elderly, orphaned children, and subjects with difficult circumstances in the City.
This Resolution was passed on November 14, 2025, by the Xth Ho Chi Minh City People's Council at its 5th session./.
