Resolution 120/2026/UBTVQH15 amend Resolution 70/2025/UBTVQH15 on state budget allocation for public investment 2026-2030

RESOLUTION 

Amending and supplementing a number of articles of the National Assembly Standing Committee’s Resolution No. 70/2025/UBTVQH15 of February 7, 2025, on principles, criteria and norms for allocation of state budget funds reserved for public investment for the 2026 - 2030 period

THE NATIONAL ASSEMBLY STANDING COMMITTEE

Pursuant to the Constitution of the Socialist Republic of Vietnam, which has a number of articles amended and supplemented by Resolution No. 203/2025/QH15;

Pursuant to Law No. 58/2024/QH15 on Public Investment, which has a number of articles amended and supplemented by Law No. 90/2025/QH15;

Pursuant to Law No. 89/2025/QH15 on the State Budget;

Pursuant to Law No. 64/2025/QH15 on Promulgation of Legal Documents, which has a number of articles amended and supplemented by Law No. 87/2025/QH15;

RESOLVES:

Article 1. To amend and supplement a number of articles of Resolution No. 70/2025/UBTVQH15 of February 7, 2025, on principles, criteria and norms for allocation of state budget funds reserved for public investment for the 2026 - 2030 period.

1. To amend and supplement Point a, Clause 8, Article 3 as follows:

“a/ Special public investment projects and urgent public investment projects;”

2. To amend and supplement Point a, Clause 2, Article 4 as follows:

“a/ To reserve a maximum of 30% of target transfers from the central budget (excluding funds for projects under national target programs, official development assistance (ODA) capital, foreign donors’ concessional loans and central budget funds allocated for tasks, programs and projects as specified at Point b of this Clause) to local budgets to be allocated by sector and field;”

3. To amend and supplement a number of points and clauses of Article 8 as follows:

a/ To amend and supplement Point a, Clause 1, Article 8 as follows:

“a/ To ensure a reasonable correlation between the development of key economic regions, driving force regions and growth poles and the prioritization of the Northern midland and mountainous region, the South Central Coast and Central Highlands, the Mekong River delta, mountainous areas, border areas, islands, ethnic minority areas and other areas facing difficulties in order to contribute to narrowing the gap in development levels, income and living standards among regions and areas nationwide;”

b/ To amend and supplement Point b, Clause 2 as follows:

“b/ Allocation to programs, tasks and projects in local sectors and fields based on scoring on following criteria:

- Population criterion: The average population and the number of ethnic minority people in localities (except Hanoi and Ho Chi Minh City);

- Development level criterion: multi-dimensional poverty rate; domestic revenues of localities as prescribed by the Law on the State Budget (excluding revenues from land use and construction lottery); and the rate of balancing transfers from the central budget to local budgets;

- Area criterion: Natural land area, paddy land area and forest coverage rate of localities;

- Communal-level administrative unit criterion: the number of communal-level administrative units; the number of mountainous communes, highland communes, special zones and communes with land borders in separate locality;

- Additional criteria, including:

+ Criterion on communes with former resistance bases; areas affected by national defense works and special-group military zones; communes facing extreme difficulties in region III;

+ Regional criterion, including regions heavily affected by natural disasters and climate change (storms, landslides, flash floods, riverbank and coastal erosion, drought, saltwater intrusion, sea level rise, etc.);

+ Priority criterion as stated in the National Assembly’s Resolutions.”

4. To amend and supplement Clause 2, Article 9 as follows:

“2. To focus investment on inter-provincial and inter-communal works and projects. To invest with focus, efficiency and high spillover effects, ensuring no scattered or fragmented investments.”

Article 2. Effect

This Resolution takes effect on the date of its adoption and applies to the budget years of the 2026 - 2030 period.

This Resolution was adopted on February 3, 2026, by the 15th National Assembly of the Socialist Republic of Vietnam.
