THE NATIONAL ASSEMBLY

Pursuant to the Constitution of Socialist Republic of Vietnam;

Pursuant to the Law No. 57/2014/QH13 on organization of the National Assembly

Pursuant to conclusions of the meeting sessions from October 22 to November 20, 2018;

At the request of Standing Committee of the National Assembly and opinions of delegates of the National Assembly;

RESOLVES THAT:

Article 1

The 14^thhas completed the agenda of the 6^thmeeting, which reflects the effort and resolve of the National Assembly, the President, the Government and authorities concerned in preparation and organization of the meeting, ensuring democracy, transparency of operation of the National Assembly and supervision by the people. The National Assembly has considered and decided the following:

1. Election of the President and ratification of the Resolution on Election of the President.

Ratification of dismissal and designation of the Minister of Information and Communications; ratification of 02 Resolutions on these persons.

2. Ratification of 09 new laws: Anti-corruption Law; the Law on Public Security Forces; the Law on Pardon; the Law on Amendments to the Law on Higher Education; the Law on Husbandry; the Law on Crop Production; the Law on Vietnam Coastguard; the Law on State Secret Protection; the Law on Amendments to 37 laws relevant to planning.

The Government has the responsibility to prepare and submit the Ordinance on amendments to ordinances relevant to planning; issue the list of master plans integrated with national, regional and provincial master plans according to Clause 4 Article 59 of the Law on Planning No. 21/2017/QH14. In the cases where a master plan ends before the superior master plan into which it is integrated is issued or ratified, the Government, pursuant to relevant laws, shall consider extending the duration of the former until the latter is issued or ratified.

Ratification of the Resolution on Ratification of the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) and relevant documents. The Government has the responsibility to propose amendments to legislative documents to fulfill the roles of CPTTT in Vietnamese socio-economic development, Vietnam’s commitment to deeper and wider international integration.

3. Comments on 06 Bills: Law on Education (amended); Law on Architecture; Law on Tax Administration (amended); Law on Amendments to the Law on Public Investment; Law on Enforcement of Criminal Sentence Execution (amended); Law on Alcohol Harm Prevention.

Suspension of development of and removal of the Bill for promulgation of the Law on Public Administration from the 2019’s Law/Ordinance Formulation Program; ratification of the Bill for amendment of the Law on Education during 7^thmeeting (May 2019); extension and renaming of the Bill for amendments of the Law on Criminal Sentence Execution (amended).

4. Confidence vote and ratification of the Resolution certifying the result of the confidence vote for 48 holders of positions elected or approved by the National Assembly.

5. Question time regarding implementation of the National Assembly’s Resolutions on thematic supervision and questioning from the beginning of the tenure until the end of the 4^thmeeting. The National Assembly’s request that members of the Government and heads of ministries to listen to comments of delegates of the National Assembly, promptly implement harmonious and effective measures to eliminate the weaknesses in implementation of the Resolutions on thematic supervision and questioning from the beginning of the tenure until the end of the 4^thmeeting and submit a report to the National Assembly during the next meeting.

6. Examination of reports on implementation of the National Assembly’s Resolutions on: socio-economic development plans, 2018’s state budget, 2019’s socio-economic development and state budget plans; mid-term evaluation of implementation of the public investment plan 2016-2020. Ratification of 04 Resolutions on: 2019’s socio-economic development plan, 2019’s state budget estimate, 2019’s allocation of central government budget, revisions to the 2016 – 2020 public investment plan.

7. Examination of mid-term reports on implementation of 5-year plans (2016-2020) regarding socio-economic development, economy restructuring, national target programs, and national finance. The National Assembly’s recognition of the achievements of the Government, the People’s Supreme Court, the People’s Supreme Procuracy, State Audit Office of Vietnam and state agencies of various levels; commendation for the effort of enterprises and the people to implement the National Assembly’s Resolution on the 5-year plans over the first half of its tenure. The National Assembly requests that the Government, ministries and local authorities keep building up the strengths, innovation and creativity; be more resolved in their managerial and administrative works; try to achieve or exceed the targets in the National Assembly’s Resolutions on the 5-year plans in 2019 and 2020. The Government has the responsibility to complete legislative documents on Public-Private Partnerships (PPP), instruct the ministries to introduce mechanisms for resolving payment-related difficulties faced by BT investors.

8. Examination of the report on implementation of the policies on socio-economic development in ethnic minority areas and mountainous areas in the last 03 years. The Government has the responsibility to develop the overall scheme for investment in socio-economic development in ethnic minority areas, mountainous areas and extremely disadvantaged area, which will be submitted to the National Assembly for decision during the 8^thmeeting (October 2019) and implemented in 2021.

9. Examination of reports on prevention and fight against crimes and violations of law; enforcement of judgments and anti-corruption works; settlement of complaints and denunciations, and other works of the Executive Judge of the People’s Supreme Court and Director of the People’s Supreme Procuracy in 2018; consolidation of comments and proposals of voters and the people; result of supervision of responding to voters’ proposals to the 5^thmeeting and other reports from relevant organizations. The National Assembly requests that the Government and relevant organizations to receive opinions of delegates of the National Assembly, voters and the people that are sent to the meetings; synchronously implement measures for improving effectiveness of their works in the near future.

10. Extension of the duration of pilot issuance of electronic visa to foreigners entering Vietnam under the National Assembly’s Resolution No. 30/2016/QH14 for up to 02 more years from February 01, 2019. The Government has the responsibility to report the implementation of the Law on Entry, Exit, Transit and Residence of foreigners in Vietnam and propose amendments to the Law to the National Assembly by February 01, 2021.

11. The Government has the responsibility to develop the national strategy for land use by 2045; keep completing the system of laws and policies serving implementation of Resolution No. 36-NQ/TW of the 12^thCentral Committee of the Communist Party regarding the strategy for sustainable development of Vietnam’s marine economy by 2030 and the orientation towards 2045.

12. Replacement of the phrase “kiểm toán việc sử dụng nguồn thu từ đất của các doanh nghiệp nhà nước đã cổ phần hóa giai đoạn 2011-2017” (“audit the use of revenue from land of equitized state-owned enterprises during 2011-2017”) with the phrase “kiểm toán việc quản lý, sử dụng đất trong và sau quá trình cổ phần hóa của doanh nghiệp nhà nước giai đoạn 2011-2017” (“audit the management and use of land during and after equitization of state-owned enterprise during 2011-2017") in the National Assembly’s Resolution No. 60/2018/QH14.

Article 2

1. Standing Committee of the National Assembly, the Government, Central Committee of Vietnamese Fatherland Front, the People’s Supreme Court, the People’s Supreme Procuracy, Ethnicity Council, Committees of the National Assembly, State Audit Office of Vietnam, ministries and local authorities, within the scope of their functions and responsibility, shall ensure effective implementation and legal education to bring about the laws and Resolutions ratified by the National Assembly. Consider and respond to comments of delegates of the National Assembly to complete the bills commented on by the National Assembly. Prepare the documents to be submitted to the National Assembly during its 7^thmeeting.

2. Standing Committee of the National Assembly, Ethnicity Council, and Committees of the National Assembly and delegates of the National Assembly shall supervise implementation of the laws and the National Assembly’s Resolutions.

Central Committee of Vietnamese Fatherland Front and its member organizations shall supervise and encourage the people from all social strata to implement the laws and the National Assembly’s Resolutions.

This Resolution is ratified by the 14^thNational Assembly of Socialist Republic of Vietnam during its 6^thmeeting on November 20, 2018.
