RESOLUTION
On COVID-19 vaccine for children aged from 5 years to under 12 years

THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;
Pursuant to the Law on Prevention and Control of Infectious Diseases dated November 21, 2007;
Pursuant to the Conclusion No. 20-KL/TW dated October 16, 2021 of the 13th Party Central Committee at its 4th session, Conclusion No. 16-KL/TW dated October 08, 2021 of the Political Bureau, Notice No. 18-TB/VPTW dated December 04, 2021 of the Officer of the Party Central Committee, Official Dispatch No. 2717-CV/VPTW dated December 24, 2021 of Officer of the Party Central Committee;
Pursuant to the Government’s Decree No. 138/2016/ND-CP dated October 01, 2016, on promulgating the Working Regulation of the Government;
At the proposal of the Minister of Health at the Document No. 489/TTr-BYT dated April 8, 2022 and Document No. 500/BC-BYT dated April 13, 2022,
RESOLVES:
Article 1. Agreement with the proposal of the Ministry of Health on receiving the COVID-19 vaccine for children from 5 to under 12 years old that are aided from the Governments of other countries and international organizations for Vietnam.
The Ministry of Health shall base on the epidemic situation, vaccination progress, vaccines available as aid, vaccines purchased commercially to determine and take responsibility for the quantity and type of vaccines that are received in aid or commercially purchased to ensure timeliness, safety, quality, and efficiency, according to the schedule; avoiding passive or without shortage or surplus of vaccines.
In case the commercial purchase of vaccine for children from 5 to under 12 years old is required, the Ministry of Health shall proactively determine and take responsibility for the quantity, time and types of vaccines to be purchased according to the schedule and report to the Prime Minister. The Prime Minister's permission for applying the method of selecting the contractor in special cases as specified in Article 26 of the Bidding Law with conditions under the Government’s Resolutions on the purchase of COVID-19 vaccine for adults is approved.
Article 2. The Ministry of Health shall take responsibility for receiving aid, purchasing and organizing vaccination against COVID-19 for children from 5 to under 12 years old in a reasonable, safe, scientific, and effective manner, according to the schedule as mentioned in the Ministry of Health’s Report No. 489/TTr-BYT dated April 8, 2022.
Article 3. This Resolution takes effect on the date of its signing. The Government’s Resolutions and the Prime Minister’s decisions on purchasing and vaccinating children from 5 to under 12 years old that are not consistent with the contents of this Resolution, shall be null and void.
Article 4. The Minister of Health, relevant ministers and heads of relevant agencies shall implement this Resolution./.
