RESOLUTION
On solutions to encourage and promote enterprises to invest in agriculture effectively, safely and sustainably
THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated June 19, 2015;
Pursuant to the Resolution No. 142/2016/QH13 dated April 12, 2016 of the National Assembly on the 2016-2020 socio-economic development plan from 2016 to 2020;
Pursuant to the Resolution No. 69/2018/QH14 dated November 8, 2018 of the National Assembly on the socio-economic development plan for 2019;
Pursuant to the Resolution No. 26-NQ/TW dated August 5, 2008 at the 7thPlenum of the 10thCentral Executive Committee on farmers and rural areas;
Based on the opinions of the Government Members and the Prime Minister s conclusions at the Conference “Promoting enterprises to invest in agriculture” dated August 27, 2018,
RESOLVES:
I. ASSESSMENT OF THE SITUATION
Over the past time, the growth rate of the agricultural sector has been quite good. Productivity, quality and efficiency are constantly being improved. Currently, Vietnam has firmly ensured national food security and become the second largest exporter of agricultural products in Southeast Asia and the 15thlargest exporter in the world with 10 groups of agricultural, forestry and fishery products with export turnover of over US$ 1 billion, including 6 items with turnover of over US$ 3 billion.
The important achievements mentioned above result from the issuance of proper and effective policies by the Party and the State; from determination and efforts of the Government, institutions in the agricultural sector, farmers and rural areas; from the application of different types of agricultural production organizations such as enterprises, cooperatives, cooperative groups, farms, household economic models; in which, enterprises are the “pillar” and “motive force” in promoting the development of agricultural production value chains towards large-scale commodity production, scientific and technological application, and advanced efficiency, competitiveness and development of Vietnamese agricultural brands.
The reality shows that the State needs to have policies for enterprises to cooperate with agricultural sector institutions, promote the accumulation and concentration of land, create the most favorable conditions for large-scale agricultural production, mechanize agricultural production, apply new and advanced technologies in agriculture, produce high quality agricultural products, greater value added, be able to participate in global value chains; create a position to build a national brand of Vietnam Agriculture, mobilize social resources to invest in developing agricultural and rural infrastructure and agricultural support services, and create a vibrant competitive environment in agriculture.
Currently, many enterprises and large corporations have paid attention and implemented investment projects in the agricultural sector, including the world s leading enterprises in shrimp, Pangasiidae, rice, coffee, etc. The system of enterprises operating in the agricultural and rural sector has been formed with over 50,000 enterprises investing in the agricultural sector, including production, processing and consumption of agricultural materials, agricultural products and services for agricultural development, of which about 10,200 enterprises directly invest in developing agricultural, forestry and fishery production.
However, the development of enterprises in the agricultural sector is still modest compared with the potential and development advantages. The number of enterprises investing in the agricultural sector currently accounts for only 8% of the total number of enterprises nationwide, of which agricultural, forestry and fishery enterprises account for 1%. The main form of agricultural production is still in the form of production households with more than 9.2 million households producing at a very small scale. The scale of enterprises is mainly small and super small, accounting for 96% of enterprises investing in agriculture. Labor productivity in agriculture is limited, only about 38% of the average labor productivity in the whole country and lower than most countries in the region. The level of science and technology of enterprises is still low. The application of science and technology and the national and international quality standards are still limited; only 5% of agro-forestry and fishery enterprises are VietGAP certified and equivalent. Consumption market is not sustainable. limited product consumption channels with large retail distributors are limited. The number of enterprises participating in the production of the value chain is still small. The technical and quality barriers of the international market are increasingly strict. The situation of food safety violations still occurs; this is the competition of unhealthy agricultural production. The communication is not effective when reflecting some violations that unintentionally create the effect of boycotting Vietnamese agricultural products because of food hygiene and safety issues, affecting the production and business activities of enterprises investing in agriculture.
Vietnam s agriculture still has a lot of potential and opportunities to exploit particularly land, human resources and opportunities in the period of industrial revolution 4.0. Therefore, in the coming time, the people and the business community must work together to bring Vietnam to the world leading position in agricultural products.
In order to realize the above objectives, the Government requires ministries, ministerial-level agencies, agencies attached to the Government, People s Committees of centrally-run provinces and cities to direct, administer and organize the effective implementation of the following objectives, tasks and solutions:
II. VISION AND GOALS BY 2030
1. Vision by 2030:
- Developing agriculture in a modern and sustainable direction; producing goods in large quantities; applying innovative science and technology to increase productivity, quality, efficiency and competitiveness; improving farmers lives; developing rural areas towards civilization and modernity.
- By 2030, Vietnam s agriculture ranks among the 15 most developed countries in the world, of which the agricultural processing industry ranks among the top 10 countries in the world. Vietnam is a deep processing center of world agriculture, a logistics center of global agricultural trade.
- Agricultural enterprises have been identified as a “pillar” in promoting the development of our agricultural production in the direction of producing the commodity, improving the competitiveness of Vietnamese agricultural products.
2. Objectives by 2030:
- The growth rate of agricultural, forestry and fishery production value reaches about 3.0%/year.
- The growth rate of agricultural, forestry and fishery export turnover is about 6-8%/year.
- By 2030, there are 80,000 to 100,000 enterprises with business investment activities in the agricultural sector effectively, of which there are about 3,000 to 4,000 large-scale enterprises and 6,000 to 8,000 medium-sized enterprises.
III. TASKS AND SOLUTIONS
1. Continuing to improve institutions, reform administrative procedures, drastically reduce barriers to business conditions in agriculture, attract businesses to invest in agriculture.
a) The Ministry of Agriculture and Rural Development shall summarize policies on agricultural, farmer and rural development, continue to promote the review and simplification of administrative procedures in the agricultural sector.
b) The Ministry of Finance shall study and amend the simplification of tax administrative procedures; urgently review and reduce inappropriate administrative tax procedures, standardize administrative procedures and issue them at the Decree level.
c) The Ministry of Planning and Investment shall:
- Urgently urge the ministries and localities to implement the Decision No. 1203/QD-TTg dated September 18, 2018 of the Prime Minister on the plan to implement Decree No. 57/2018/ND-CP on mechanism and policies to encourage enterprises to invest in agriculture and rural areas.
- Assume the prime responsibility for, and coordinate with the Ministry of Finance and the Ministry of Agriculture and Rural Development in, reviewing and summing up projects of localities requesting support according to the provisions of Decree No. 57/2018/ND-CP; report to the Prime Minister to consider and balance support from the central budget.
d) The Ministry of Industry and Trade promotes effective implementation of Decree No. 107/2018/ND-CP dated August 15, 2018 of the Government on rice export business. The Ministry of Agriculture and Rural Development and The Ministry of Health shall urgently issue documents to guide the contents assigned in Decree No. 107/2018/ND-CP in the fourth quarter of 2019.
e) The ministries review and propose amendments and supplements to regulatory policies, creating the most favorable conditions for agricultural development, investment and business in the agricultural sector.
f) The People s Committees of the provinces and centrally-run cities shall step up the improvement of the business and investment environment, based on the local natural advantages, to adopt policies on encouraging enterprises to efficiently exploit natural conditions such as land, soil, water and resources, making the localities quickly become clean and highly-technological agricultural centers; focus on effectively implementing Decree No. 57/2018/ND-CP.
2. Developing the production, processing and consumption of agricultural products to ensure compliance with market demands, agricultural sector development plans and strategies.
a) The Ministry of Agriculture and Rural Development shall:
- Preside over the review, research and development of strategies, plans and projects for the development of a sustainable, effective and sustainable branch; give the priority to the development of key industries and products in three main product axes (National key agricultural products, provincial key agricultural products and local specialty products); research and implement a scheme to develop 03 processing industries with the aim of being among the top 5 countries in the world in terms of vegetables, seafood, wood and wood products, and then submit it to the Prime Minister in the third quarter of 2020.
- Assume the prime responsibility for, and coordinate with the Ministry of Science and Technology in, concentrating on research and development of post-harvest technologies, overcoming post-harvest losses, benefiting farmers, increasing product value and creating certain comparative advantages for Vietnamese agricultural products.
b) The Ministry of Industry and Trade shall assume the prime responsibility and coordinate with the Ministry of Agriculture and Rural Development in developing schemes, plans and logistics development strategies associated with agricultural production and business areas in order to help enterprises reduce costs and time of product delivery and distribution. In the third quarter of 2020, schemes, plans and logistics development strategies will be submitted to the Prime Minister.
c) The Ministry of Health shall assume the prime responsibility for, and coordinate with the Ministry of Agriculture and Rural Development and concerned agencies in, studying and elaborating a scheme on development of pharmaceutical processing industry, and then submit it to the Prime Minister in the third quarter of 2020.
3. Renovating mechanisms to support enterprises to promote market expansion, step by step taking initiative in the market.
a) The Ministry of Agriculture and Rural Development shall assume the prime responsibility for, and coordinate with the Ministry of Industry and Trade in, formulating a scheme to step up the application of information technology in collecting information and forecasting the market situation, through which enterprises are given advice and provided with information to regulate appropriate operations according to market demand and be able to avoid the selling price squeeze. In the third quarter of 2020, this scheme will be submitted to the Prime Minister.
b) The Ministry of Industry and Trade shall assume the prime responsibility for, and coordinate with the Ministry of Agriculture and Rural Development in, reviewing and evaluating trade promotion programs and activities, focusing on deploying trade promotion contents to support enterprises to expand consumer market of agricultural products, improve product development capacity to meet market requirements, build and promote product brands in key markets; coordinate with the Foreign Trade Service system in promoting trade promotion to bring Vietnamese agricultural products to the market of retail systems and supermarket chains in foreign countries.
c) The Ministry of Foreign Affairs shall direct the network of overseas representative agencies to closely coordinate with the Ministry of Agriculture and Rural Development as well as with the concerned ministries and branches in improving the effectiveness of agricultural product export support and promotion, attracting high quality investment and technology transfer in the agricultural sector.
4. Perfecting credit policies for agricultural projects in the direction of supporting and encouraging investment in the agricultural sector.
The State Bank of Vietnam studies and directs credit institutions to:
- Balance capital sources to meet the demand for agricultural and rural development; strengthen the connection of banks and enterprises to remove difficulties and obstacles in accessing credit capital, especially enterprises and projects of high technology application and linkages in agricultural production.
- Step up the reform of administrative procedures, simplify borrowing procedures for people and enterprises.
- Effectively implement credit policies for agriculture and rural areas according to Decree No. 55/2015/ND-CP dated June 9, 2015 of the Government on credit policies for agricultural and rural development and Decree No. 116/2018/ND-CP dated September 7, 2018 amending and supplementing Decree No. 55/2015/ND-CP; diversify credit products suitable to customers, contributing to limiting black credit in rural areas.
5. The Ministry of Finance shall assume the prime responsibility for, and coordinate with the ministries, branches and localities in, studying, proposing and adjusting reasonable tax policies in order to encourage enterprises to invest in agriculture, ensuring the macroeconomic policy stability; effectively implementing Decree No. 58/2018/ND-CP dated April 18, 2018 of the Government on agricultural insurance.
6. Building and perfecting policies to create favorable conditions for enterprises to access and apply modern advanced scientific and technological research results in service of agricultural production and business; maximizing the opportunities of industrial revolution 4.0 to develop outstanding, efficient and sustainable agriculture.
a) The Ministry of Agriculture and Rural Development shall:
- Plan for development of concentrated agricultural production areas is the content of the provincial planning. The localities are making a plan according to the Planning Law and the development orientation of the industry. In the second quarter of 2019, the plan will be reported to the Prime Minister.
- Assume the prime responsibility for reviewing, evaluating and perfecting the system of agencies managing and certifying the quality of agricultural products from the central to local levels, standards for agricultural products in harmony with international standards; study and amend mechanisms and policies on research and testing of new varieties along the direction of creating favorable conditions for enterprises to participate in implementing research projects and receive research results.
- Focus on improving the capacity of quality management agencies through training human resources and upgrading and equipping with modern machinery to get accurate test results, compatible with developed countries.
- Preside over research and improve policies to promote mechanization in agriculture.
- Assume the prime responsibility for, and coordinate with the Ministry of Science and Technology in, perfecting the system of national standards and national technical regulations in the agricultural sector. The national standards and national technical regulations shall be reported to to the Prime Minister in the third quarter of 2019.
b) The Ministry of Science and Technology shall assume the prime responsibility for, and coordinate with the Ministry of Agriculture and Rural Development in,
- Focusing on investment in science and technology in production and processing for key products, especially selecting and using new varieties, post-harvest preservation technology and processing technology; creating chains and improving the quality of agricultural products, aquatic products, seafood and livestock.
- Stepping up the reform of administrative processes and procedures on technology transfer; creating favorable conditions for enterprises to access resources on seeds and scientific research results.
- Enhancing the protection of intellectual property in the country and abroad for key and specific agricultural products; promoting the construction and development of trademarks, geographical indications, traceability (bar code, QR code, etc.), intellectual property for protected products.
- Appraising and announcing national standards; appraising national technical regulations.
c) The Ministry of Industry and Trade shall assume the prime responsibility for, and coordinate with the Ministry of Agriculture and Rural Development in, studying and promulgating a list of mechanical engineering products, components, agricultural machines and auxiliary products in service of agricultural and rural development subject to investment support. This list will be reported to the Prime Minister in the fourth quarter of 2019.
7. Improving the operation mechanism for the market of land use rights; creating a synchronous mechanism for the market of agricultural land use rights to develop; urgently studying the pilot mechanism on land accumulation, concentration; ensuring the harmonization of the interests of the State, farmers and enterprises.
a) The Ministry of Natural Resources and Environment shall assume the prime responsibility for, and coordinate with the ministries, branches and localities in,
- Studying and submitting to the Government and the National Assembly amendments and supplements to the Land Law along the direction of developing the market of land use rights in agriculture, expanding the limits on transfer of agricultural land of households and individuals; completing regulations on agricultural land use rights and obligations of organizations and individuals; setting up favorable mechanisms for farmers, cooperatives, cooperative groups and enterprises to access land; forming concentrated production and processing areas; and submitting these to the Government in 2021.
- Researching and proposing solutions for the contents that need to be piloted for accumulation and concentration of land; and submitting these solutions to the Government in November 2019.
- Developing a Government Decree stipulating the accumulation and concentration of land for agricultural production; and submitting it to the Government in October 2019.
b) People s Committees of centrally-run provinces and cities shall, on the basis of natural, economic and social characteristics, potentials and advantages of land, review, make, adjust and publicize the land use planning to ensure stable planning, concentrate land suitable for agricultural purposes.
8. Developing and improving the quality of human resources for production and business activities of enterprises in agriculture.
The Ministry of Labor, War Invalids and Social Affairs shall assume the prime responsibility for:
a) Studying and promulgating policies to support and prioritize vocational training support according to the needs of employers; attaching training with specific employers (enterprises, cooperatives, business establishments, etc.); attaching training with the orientation of industrial and service development of each locality; attaching training with skills and experience of craft villages; reporting this to the Prime Minister in the third quarter of 2019.
b) Researching and developing reasonable policies to attract craftsmen to participate in vocational training; adjusting and supplementing policies to encourage and support enterprises to participate in vocational training as well as support vocational trainees; reporting this to the Prime Minister in the second quarter of 2019.
c) Studying and promulgating policies to prioritize training of farmers in planned key production areas, laborers in farms, laborers in agricultural enterprises and cooperative members; reporting this to the Prime Minister in the third quarter of 2019.
9. Continuing to improve the efficiency of state management in the spirit of the Government to create and empower the market to decide; improving the quality of agricultural business environment.
a) The Ministry of Agriculture and Rural Development shall:
- Assume the prime responsibility for, and coordinate with localities and concerned agencies in, studying and formulating a scheme on development of a system of modern agricultural product supply centers in Vietnam in the 2019-2020 period with orientations towards 2030; submitting this scheme to the Prime Minister in the third quarter of 2019.
- Concentrate on managing production, trading and use of plant protection drugs, chemicals for preserving agricultural products, veterinary drugs, animal feed, especially pesticide residues and antibiotics, banned chemicals in agricultural products.
- Assume the prime responsibility for, and coordinate with the Ministry of Health, relevant ministries and branches in, continuing to improve mechanisms and policies on food safety management during the process of production, preliminary processing, processing, preservation, transportation and trading in agricultural products and foodstuffs in the direction of “increasing post-inspection and reducing pre-inspection”; strengthen the application of the ordering mechanism, assign tasks in independent testing activities in the market, and strengthen inspection and strictly handle food production organizations and individuals that violate food safety laws.
b) The Ministry of Industry and Trade shall continue to guide localities to build and replicate the pilot model of food safety market and the model of safe food business establishments.
c) The Ministry of Health shall assume the prime responsibility for organizing the dissemination and education of legislation on food safety; giving warnings of incidents of food poisoning; closely coordinating with the Ministry of Agriculture and Rural Development and the Ministry of Industry and Trade in combining inter-branch inspection and examination of contents in each period of inspection of food safety and hygiene for agricultural products in strict accordance with the law (no more than once per year), except for unexpected inspection and examination when there are clear signs of law violation.
- Assume the prime responsibility for, and coordinate with the Ministry of Agriculture and Rural Development in, formulating a mechanism for independent food quality accreditation agencies on the market (on the basis of the State’s orders and state-assigned targets every year); based on the inspection results, strictly handle production organizations and individuals that violate the food safety law; report to the Prime Minister in the third quarter of 2019.
d) The Ministry of Information and Communication shall:
- Assume the prime responsibility for, and coordinate with the Ministry of Agriculture and Rural Development in, promoting the application of information technology for smart agricultural development.
- Direct the media agencies to uphold the national spirit, honestly and promptly reflect violations to ensure sufficient deterrence but not adversely affect bona fide enterprises.
e) People s Committees at all levels shall:
- Focus on implementing specific policies of the central government in accordance with the local reality to build and develop material areas for safe agricultural production; promote widespread application of VietGAP model, other safe production models and develop a safe food distribution system.
- Be responsible for ensuring food safety and hygiene in the area; determine the assurance of food hygiene and safety as an important task that needs to be directed and implemented; prioritize the allocation of sufficient funds and resources for the management and assurance of food safety; in the immediate future, take the initiative in allocating funds in proportion to the collected amounts of administrative sanctions on food safety under the local budget under the provisions of the State Budget Law to invest in technical equipment as well as inspection, testing and disposal of unsafe food.
- Coordinate with ministries, branches and localities to control food safety and hygiene for food trade villages; maintain and develop traditional craft villages and ensure food safety for consumers; deploy the model of food safety control points at food markets and supermarkets.
10. The Ministry of Public Security and the Ministry of Industry and Trade shall assume the prime responsibility for, and closely coordinate with the concerned agencies in, preventing smuggling, trade fraud and fake goods production in order to protect the legitimate rights and interests of enterprises investing in production and business in the agricultural sector.
IV. ORGANIZATION OF IMPLEMENTATION
1. Deputy Prime Minister - Head of the Steering Committee for Enterprise Innovation and Development, and the Deputy Prime Ministers are assigned to take charge of branches and domains, direct ministries, ministerial-level agencies, government agencies, People s Committees of concerned centrally-run provinces and cities to implement this Resolution.
2. According to their assigned functions and tasks, ministers, heads of ministerial-level agencies, government agencies as well as chairpersons of People s Committees of concerned centrally-run provinces and cities shall:
a) Promptly direct the implementation of tasks assigned under the Resolution in order to promptly solve difficulties for enterprises, regularly inspect and supervise, ensure the implementation of the objectives, tasks, solutions and reporting regimes in this Resolution on schedule.
b) Promptly summarize proposals, difficulties and problems of enterprises within the branches, domains and geographical areas under their management to handle or transfer them to competent agencies for settlement.
c) Strictly handle cases of officials and public servants causing difficulties and harassing enterprises in accordance with the provisions of law.
3. Business associations and professional associations shall:
a) Develop specific and feasible programs and measures to continue to improve the quality of activities; well implement the role of supporting member enterprises, acting as an effective bridge between enterprises and the Government.
b) Coordinate with the Ministry of Planning and Investment, ministries, branches, localities and relevant agencies in developing and organizing the implementation of programs and projects to encourage enterprises to invest in agriculture.
c) Improve the quality of operations; make business associations become the mainstream dialogue channel between enterprises and authorities; gather recommendations, difficulties and problems of enterprises investing in agriculture, and then transfer these to state management agencies for handling and settlement, and send to the Government Office and the Ministry of Planning and Investment for monitoring; report to the Prime Minister on the situation of solving difficulties of enterprises.
4. Enterprises shall:
a) Exercise their rights and obligations in accordance with the provisions of law; be proactive in exchanging and reporting difficulties and obstacles to state management agencies for prompt resolution.
b) Promote the spirit of actively strengthening links, business cooperation; promote the leading role in the chain of links, agricultural value chains; support to improve the capacity of farming households and cooperatives in the direction of producing clean agricultural products and organic agricultural products.
c) Enhance the application of advanced science and technology in production and business; improve the management capacity, productivity, quality and competitiveness of agricultural products.
d) Promote entrepreneurship, business ethics; build corporate culture, develop sustainable and environmentally-friendly businesses; uphold the spirit of national pride, solidarity; cooperate with the Government and people to successfully bring Vietnamese agricultural products to the world market.
5. The Ministry of Information and Communications shall promote the dissemination of this Resolution and policies to encourage enterprises to invest in agriculture.
6. The Ministry of Planning and Investment shall assume the prime responsibility for, and coordinate with the Steering Committee for Enterprise Renewal and Development and concerned ministries and agencies in, urging, inspecting and supervising the implementation of the Resolution. The implementation situation shall be annually reported to the Government./.
