Solutions for Implementing Electronic Labor Contracts
The Government issued Resolution No. 44/2026/NQ-CP on October 30, 2026, on solutions for removing difficulties in implementation of electronic labor contracts under the Government's Decree No. 337/2025/ND-CP dated December 24, 2025. To be specific:
Continuation of Services: eContract Providers that were providing electronic labor contract services before July 01, 2026, but had not completed the necessary connection to the Electronic Labor Contract Platform by that date, are permitted to continue their services until December 31, 2026. This provision ensures that electronic labor contracts concluded during this interim period maintain the same legal validity as traditional paper contracts, in compliance with labor and e-transaction laws.
Contract Identification: Electronic labor contracts concluded during the connection-pending period will be assigned identification numbers in the same manner as those concluded before July 01, 2026, as per the guidance of the Ministry of Home Affairs.
Future Compliance: From January 01, 2027, all electronic labor contracts must adhere to the conditions and methods specified in Article 6 of Decree No. 337/2025/ND-CP.
Platform Operation: The official operation of the Electronic Labor Contract Platform is suspended until eContract Providers meet the conditions specified in Clause 3, Article 6 of the Decree and complete the necessary connection procedures. However, the platform must commence official operations no later than December 15, 2026.
This Resolution takes effect on the date of its signing, with specific provisions applicable from July 01, 2026.
