RESOLUTION
THE GOVERNMENT’S REGULAR MEETING – MAY 2019
THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated June 19, 2015;
Pursuant to the Government’s Decree No. 138/2016/ND-CP dated October 01, 2016 promulgating the working regulation of the Government;
Based on the discussion of the delegates and the conclusion of the Prime Minister at the Government’s regular meeting in April 2019, held on May 04, 2019,
DECIDES
1. Regarding the implementation of the Government’s Resolutions No. 01/NQ-CP and 02/NQ-CP and the socio-economic situation in May and the first 5 months of 2019
The Government agreed that the socio-economic situation in May and the first 5 months of 2019 continued to witness positive developments. Macroeconomic conditions were relatively stable; inflation was kept under control; the average consumer price index (CPI) in the first 5 months grew by 2.74%, the lowest five-month growth in three years; interest rates and foreign exchange rates were relatively stable; foreign exchange reserves continued to augment. Macroeconomic balances of the economy were safeguarded. Budget revenues recorded decent incremental. Exports were estimated at over US$100 billion, up by 6.7%; in which that of the domestic sector increased by 11.6%, higher than the FDI sector; industrial production (IIP) rose by 9.4%, particularly, that of engineering and manufacturing sector augmented by 11.6% in May, the highest record over the past 5 years. Trade sector had an eventful month, with total retail sales of consumption goods and services increasing by 11.6%. The number of international arrivals to Viet Nam reached nearly 7.3 million, up by 8.8%. Foreign direct investment inflows (FDI) reached US$7.65 billion, up by 2.8 times; total disbursed FDI was estimated at US$7.3 billion, up by 7.8% compared with the same period last year. There were more than 54,000 newly registered enterprises, up by 3.2% in terms of number of businesses and 29.6% in terms of registered capital; there were approximately 20,000 enterprises returning to operation, up by 48.1%. Global credit rating agencies reported positive outlook of macroeconomic growth in Viet Nam; particularly, Fitch Ratings upgraded its rating for Viet Nam from “stable” to “positive”. Viet Nam also hosted successful celebration of the UN Day of Vesak in 2019, highlighting the country’s tradition for preserving peace, unity and mutual development. The fields of culture, society, environment received due attention. People s lives continued to improve; the number of poor households reduced by 30.5%. Many efforts were made to safeguard social order and safety, a number of large-scale drug and online gambling were cracked down. Foreign affairs were promoted, especially with comprehensive and strategic partners.
However, the country was still influenced by external challenges and difficulties such as weaker economic growth and global trade, unexpected developments of the US-China trade tensions, the volatility in crude oil prices…The domestic economy still faced with a number of weaknesses and limitations. Inflation pressures were likely to persist; disbursement of public investment capital hadn’t been improved significantly; a number of key works hadn’t embarked or were predicted to be slower than plan and had not been put into exploitation; agro-forestry-fishery production faced with a number of hurdles, the African swine fever epidemic remained complicated; hot weather created negative influence on agriculture production and people’s daily life; a number of sectors were likely heading for slower growth. Tourism promotion and marketing as well as quality of tourism services remained limited. Manufacturing and business conditions were still difficult. The number of enterprises dissolving, or halting operation increased. A number of pressing social issues hadn’t been radically resolved. Due attention had not been paid to implementing tasks on e-Government development.
The Government had a strong mind to accomplish targets on inflation control and macroeconomic stabilization, focusing on removing limitations and weaknesses, determined not to concede any difficulties or challenges, striving to successfully realize all targets set for 2019, in which GDP growth was projected at 6.8%, inflation rate was expected to be kept under 4%. The Government requested ministries, agencies and localities to actively and flexibly respond in a timely manner to international and domestic developments; have specific plans to execute the instructions of the Government and the Prime Minister; regularly urge, inspect and evaluate the implementation of tasks and solutions proposed under the Resolutions of the Party, the National Assembly and the Government. Attention must be paid to the following contents:
- Ministries, agencies and localities shall continue promoting economic restructuring and rearrangement of branches and/or fields under their management authority; effectively implementing the tasks and solutions enshrined in Resolutions No. 01/NQ-CP and 02/NQ-CP dated January 1, 2019 of the Government, Directive No. 09/CT-TTg dated April 1 2019 by the Prime Minister. Attention must be paid to further improving institutional and policy quality; continuing to drastically cut down on unnecessary administrative procedures and business conditions which cause troubles for businesses. The Government requested ministries, agencies and localities to ensure the planned restructuring progress and prevent the manipulation of group s interests; strengthen coordination and prevent overlaps of roles and responsibilities in inspection, examination and investigation; further improve the investment and business environment, and create favorable conditions to promote production and business development.
- The National Financial and Monetary Policy Advisory Council and the National Financial Supervisory Committee shall regularly review, evaluate and analyses developments in the country and the world to advise the Government, ministries and industries appropriate resolutions. The National Steering Committee on Price Management shall coordinate with ministries, branches and localities to conduct analysis and formulate plans on public services price adjustment following a roadmap, and at an appropriate level, avoiding accrual of all price adjustments at once to accomplish targets on inflation control; strengthen communication on the Government’s objective and transparent price management.
- Ministries, agencies and localities shall actively review and identify new growth motives of their branches, domains and localities; focusing on removing difficulties and obstacles, speeding up the progress, ensuring the quality of projects and works under their management authority; paying attention to implementing solutions raised at the Private Economic Forum; piloting the organization of new models and replicating successful models that have been validated in practice.
- The State Bank of Viet Nam shall continue to monitor, evaluate and forecast impacts of the world financial and monetary markets, actively and flexibly administer monetary policy tools to create a solid foundation for the economy to withstand external shocks; continue to promote the restructuring of credit institutions associated with bad debt handling according to the Law amending and supplementing a number of articles of the Law on Credit Institutions, Resolution No. 42/2017/QH14 and Decision No. 1058/QD -TTg dated July 19, 2017; properly fulfil functions of a standing body of the Steering Committee for anti-money laundering in Viet Nam and the focal agency in coordination with relevant ministries and agencies in undertaking a mutual evaluation of the Asia/Pacific Group on Money Laundering (APG) for Viet Nam.
- The Ministry of Finance shall strengthen the state budget restructuring; reserve a part of the excess budget revenues for investment preparation. The Ministry shall report to the Prime Minister arising problems and propose solutions to accelerate equitization and divestment of state-owned enterprises; study and develop a draft Decree substituting Decree No. 16/2015/ND-CP dated February 14, 2015 of the Government in the direction of promulgating a common financial autonomy mechanism at public service units for all fields. The Ministry shall assume the prime responsibility for and coordinate with the Ministry of Agriculture and Rural Development and localities in proposing plans to support pig farmers suffering from African swine fever epidemic, report it to the Prime Minister for consideration and decision-making. The Ministry of Finance shall direct the State Security Commission of Viet Nam to monitor and evaluate the security market, especially indirect investments for better risk control.
- The Ministry of Planning and Investment shall urgently complete a Strategy to attract new-generation FDI, in which attention shall be paid to identifying solutions to enhance linkages and technology transfer between foreign-invested enterprises and domestic enterprises. The Ministry shall urgently report to the Prime Minister to approve the equitization plan of state-own enterprises of the whole country in the 2019-2020, including the equitization plan for Ho Chi Minh City before June 15, 2019. The Ministry of Planning and Investment shall assume the prime responsibility for and coordinate with related ministries and agencies in reporting to the Prime Minister to promulgate of a Directive on the development of a medium-term public investment plan in the 2021-2025 period, coordinate with related departments, ministries, branches and agencies in developing a draft 10-year Strategy on socio-economic development in the 2021-2030 period and a 5-year orientation and tasks on socio-economic development in the 2021-2025 period. These documents will be discussed by the Socio-economic sub-committee at the 13th National Congress of the Communist Party.
- The Ministry of Industry and Trade shall continue to closely monitor, follow, update and comprehensively evaluate impacts of external factors, especially impacts of trade tensions and trade protection trends, timely propose solutions and appropriate scenarios, including solutions to diversify markets, focusing on developing the domestic market, properly organizing wholesale, retail and good supply; take advantage of signed trade agreements, especially the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP); promote the ratification of the Viet Nam - EU Free Trade Agreement (EVFTA); assess multi-dimensional impacts of the plan to increase electricity prices and petrol prices at the request of the National Assembly.
- The Government requested ministries, agencies and localities to promote the effective exploitation of opportunities and advantages from the Industry 4.0; accelerate the construction of e-Government, digital economic model transformation; due attention must be paid to facilitating and supporting, first and for most, to improve legal foundation to encourage enterprises in applying digital technology, transforming digital economy, developing shared economic models and new business models, managing virtual property, virtual money, and electronic payment... In addition, the Government requested ministries, agencies and localities to focus on directing, finalizing and submitting assigned reports in due time, providing explanations on report contents serving the multi-dimension evaluation of the Asia/Pacific Group on Money Laundering (APG) on anti-money laundering and counter-terrorist financing measures of Viet Nam in the 4th quarter of 2019. Ministries of Information and Communications, Planning and Investment, Industry and Trade, Science and Technology were requested to coordinate with each other to identify appropriate solutions to attract investment from top global digital businesses and create favorable conditions for new technology adoption and development of Vietnamese digital businesses.
- The Ministry of Science and Technology shall urgently finalize and report to the Prime Minister to promulgate a Directive on promoting the role and efficiency of the National Foundation for Science and Technology Development at Enterprises to support and promote innovation sprit, inventive innovations and technology transfer at enterprises, groups and corporates, and promulgate a Decision of the Prime Minister on a National Strategy on Intellectual Property.
- The Ministry of Education and Training shall formulate a plan to organize the 2019 national high school examination, ensuring its elaborateness and stringency, preventing the occurrence of negative and fraudulent behaviors in examination; strengthening direction, inspection and supervision at local and grassroots levels. The People s Committees of the provinces and centrally run cities take initiative in taking measures to organize the examination in an absolutely benign manner, taking responsibility before the Party, the State and the people for exam seriousness, honesty and fairness.
- The Committee for Management of State Capital at Enterprises shall coordinate with ministries and agencies to properly fulfil the assigned functions and tasks; promote equitization and divestment according to regulations; improve the management efficiency of state capital at enterprises; continue to apply solutions to handle 12 weak projects creating losses by the Industry and Trade sector.
- The Ministry of Agriculture and Rural Development shall assume the prime responsibility for and coordinate with ministries, agencies and localities in mobilizing socio-political organizations, business communities and people to drastically implement solutions to prevent and control the African swine fever epidemic. And at the same time, the Ministry shall proactively develop and implement plans to develop livestock and poultry production in replacement of the infected ones and formulate a herd repopulation plan whenever possible to ensure sufficient food supply for people s needs and export in the near future.
- The Ministry of Natural Resources and Environment shall assume the prime responsibility for and coordinate with ministries, agencies, localities and mass organizations in promoting communication, raising awareness and changing people s behaviors in environmental protection. Special attention shall be paid to reducing and proceeding to eliminate plastic waste. The Ministry shall assume the prime responsibility for and coordinate with the Ministry of Agriculture and Rural Development, the Ministry of Industry and Trade and concerned ministries and agencies in enhancing the management and strict control over the import, trading, supplying and farming of crawfish; lead and coordinate with the Ministry of Justice in reporting to the Prime Minister before collecting comments of the Government members on the adoption of a specialized mechanism and procedure to shorten processing time for providing compensation and support the relocation and site handover at land acquisition areas in Ho Chi Minh City.
- The Ministry of Transport and the Ministry of Industry and Trade, according to their assigned functions and tasks, shall assume the prime responsibility for studying and formulating a special mechanism to attract social capital for investment in traffic infrastructure construction projects and works as well as projects and works in the energy sector.
- The Government Inspectorate shall urgently report to the Prime Minister the inspection conclusions of the Thu Thiem New Urban Area Project, clarifying the responsibilities and violations of related organizations and individuals, and proposing handling measures in accordance with the law.
- The Ministry of Defense shall direct, closely monitor the situation, proactively formulate plans and promptly respond to new developments, not to stay passive and unprepared in any circumstance, firmly maintain the national sovereignty at the border and islands.
- The Ministry of Public Security shall take the initiative in grasping the situation, deploying measures and plans to protect security and safety of important political events of the country and activities of the Party and the State leaders. The Ministry of Public Security shall continue to utterly ensure safety of the 7th session of the 14th National Assembly and concentrate on implementing measures to prevent and suppress crimes, safeguard political security, social order and safety.
- The Ministry of Foreign Affairs and the Ministry of Industry and Trade shall actively coordinate and work with the competent authorities of the European Union to ratify the Viet Nam-EU Free Trade Agreement (EVFTA) soon. The Ministry of Foreign Affairs shall properly prepare contents for the ASEAN Summit and G20 Summit in June 2019.
- Ministries, agencies and localities, according to their assigned functions, tasks, domains and geographical areas, shall stringently collect inputs of the National Assembly and take drastic measures to handle inadequacies and pressing issues concerned by members of the National Assembly, voters and people such as child and woman abuse, school violence, examination frauds ... Government members shall actively prepare answers and explanations to issues that are currently concerned by the National Assembly, the Viet Nam Fatherland Front, voters and people.
- The Ministry of Information and Communications shall urgently finalize and submit to the Prime Minister to promulgate a Directive to promote the development of Vietnamese technology enterprises; organize the effective implementation of the National Planning on Press Development and Management by 2025 following an approved roadmap; assume the prime responsibility for and coordinate with ministries and agencies in studying and proposing the organization of the Government s briefing on information and communication work in order to provide timely, orthodox and unified information; strengthen the strict control and handling of false information, which could seriously affect personal and/or organization prestige and honor on social networks.
2. Regarding the plan to use the 10% reserves of the capital investment plan by using 70% consular fee for the implementation of investment projects to build Viet Nam s representative missions in foreign countries
The Government agreed to endorse the use of the 10% reserves of the capital investment plan by using 70% consular fee for the implementation of investment projects to build Viet Nam s representative missions in foreign countries proposed by the Ministry of Foreign Affairs. The Ministry of Planning and Investment was assigned to review the allocation plan to use the 10% reserves of the capital investment plan by using 70% consular fee for the implementation of investment projects to build Viet Nam s representative missions in foreign countries proposed by the Ministry of Foreign Affairs (including a list of projects, capital levels and specific explanations), and report to the Prime Minister for consideration and assignment of capital plans according to regulations.
3. Regarding the promulgation progress of detailing regulations; the implementation of Work Programs and tasks assigned by the Government and the Prime Minister to ministries, agencies and localities in the first 5 months of the year
Government requested that:
a) Regarding detailing regulations:
- Ministers of Public Security, National Defense, Industry and Trade, Transport, Finance, Agriculture and Rural Development, Education and Training, and the Government Inspectorate shall urgently complete and submit to the Prime Minister for signing and promulgating detailing regulations before June 15, 2019, resolutely opposing to any postpone to draft regulation submission. The Ministry of Justice and the Government Office shall coordinate with and urge related ministries to speed up the finalization and submission of detailing regulations.
- Ministers and heads of ministerial-level agencies shall promptly direct the review and proposal of a list of legal documents detailing the laws passed by the National Assembly at the 7th session of the 14th National Assembly, and submit it to the Ministry of Justice before June 30, 2019 for synthesis and reporting to the Prime Minister.
- Upon the promulgation of legal documents, ministries and agencies in charge of document formulation must update, arrange and classify them according to regulations in order to enable people and enterprises in searching, accessing and synchronous application.
- The Ministry of Justice shall monitor and synthesize a list of laws and regulations for which the submission of detailing legal documents was postponed by ministries and agencies. This shall be considered as a criterion for performance evaluation of the respective ministries and agencies.
b) Regarding Work Programs:
- Ministries and agencies shall speed up the submission of outstanding projects in their Work Programs in May 2019 before June 15, 2019. At the same time, ministries and agencies were requested to actively implement the Work Programs in June, preventing accumulations of uncompleted tasks.
c) Regarding the situation of performing tasks:
- Ministries, agencies and localities shall regularly review, urge, inspect and take more drastically action in accomplishing the tasks assigned by the Government and the Prime Minister, especially the tasks related to difficulty and obstacle removal in support of business production, growth promotion, institutional improvement, and resolving pressing social issues.
- Ministries having specialized inspection procedures and business conditions that have been reduced and/or simplified must publicize them on the electronic portal of their ministries and agencies, not to give rise to additional business conditions and or specialized inspection requirements for products and goods in accordance with the Government s direction in Resolution No. 162/NQ-CP dated December 31, 2018 and the Prime Minister s direction in Document No. 320/TTg-KSTT dated March 15, 2019.
4. Regarding draft Decrees regulating the organization of specialized agencies under the provincial and district People s Committees
The Ministry of Home Affairs was assigned to collect comments of the Government members, improve draft Decrees and report to the Government. In particular, it was requested to thoroughly uphold decentralization and autonomy of localities in deciding the organization of specialized agencies, arranging the number of deputies based on the framework, criteria and conditions set by the Government’s regulations. The reorganization and rearrangement of agencies must attach with reasonable adjustments to functions and tasks of specialized agencies at provincial and district levels and avoiding to omit state management functions and tasks. The Ministry was requested to study and propose criteria for establishment of Public Administrative Service Centres.
5. Regarding the proposal to build a draft Law amending and supplementing a number of articles of the Law on entry, exit, transit and residence of foreigners in Viet Nam
The Government agreed to approve the proposal to develop a draft Law amending and supplementing a number of articles of the Law on entry, exit, transit and residence of foreigners in Viet Nam. Regarding the progress, the Government requested related ministries and agencies to urgently study, formulate and submit to the National Assembly for consideration and approval of the draft Law at the 8th session of the 14th National Assembly.
The Ministry of Public Security was assigned to assume the prime responsibility for and coordinate with the related ministries and agencies in collecting comments of the Government members, completing the application for developing a draft Law, submitting it to the Ministry of Justice to urgently make a proposal of the Government in accordance with the Law on Promulgation of Legal Documents.
The Minister of Justice was authorized by the Prime Minister to act on behalf of the Government to submit the proposal to develop this draft Law to the National Assembly Standing Committee in June 2019.
6. Regarding the pilot plan to expand autonomy of Ha Noi University of Science and Technology, National Economics University, University of Economics Ho Chi Minh City
The Government agreed to approve that:
- In the 2019-2023 period, Ha Noi University of Science and Technology, National Economics University and University of Economics Ho Chi Minh City shall pilot the application of higher pension age (no more than 65 for men and 60 for women) for the Chairman of the School Council under Clause 3, Article 187 of the Labor Code to encourage people with good political, moral, reputable and higher education managerial qualities and good health to voluntarily uptake duties, participate in the School Council and to be elected as Chairman of the School Council to improve the effectiveness and efficiency of the School Council. The election mechanism of Chairman of the School Council must ensure objectiveness, competitiveness and transparency in identifying the right and qualified people, in which the candidates shall be requested to present an action plan and dialogue with an expanded committee of key officials of the university. The Minister of Education and Training was assigned to report to the Prime Minister before issuing a decision to recognize the Chairman of the School Council for the above cases.
- Foreigners participating in teaching and research at Ha Noi University of Science and Technology, National Economics University and University of Economics Ho Chi Minh City and certified by these universities shall not be required to apply for work permit issuance.
7. Regarding borrowing limits for re-lending and Government guarantee limits in 2019
In principle, the Government agreed to approve the borrowing limits for re-lending and the Government guarantee limits in 2019 proposed by the Ministry of Finance. The Ministry of Finance was assigned to report to the Prime Minister for consideration and signing of the Prime Minister s Decision to implement the public debt repayment plan in 2019, submit to the Prime Minister to issue a decision on the Government guarantee limit in 2019 of the Viet Nam Development Bank after the Prime Minister had issued a decision on credit growth of Viet Nam Development Bank in 2019./.

The Government requested ministries, agencies and localities to ensure the planned restructuring progress and prevent the manipulation of group s interests; strengthen coordination and prevent overlaps of roles and responsibilities in inspection, examination and investigation; further improve the investment and business environment, and create favorable conditions to promote production and business development.
- The National Financial and Monetary Policy Advisory Council and the National Financial Supervisory Committee shall regularly review, evaluate and analyses developments in the country and the world to advise the Government, ministries and industries appropriate resolutions. The National Steering Committee on Price Management shall coordinate with ministries, branches and localities to conduct analysis and formulate plans on public services price adjustment following a roadmap, and at an appropriate level, avoiding accrual of all price adjustments at once to accomplish targets on inflation control; strengthen communication on the Government’s objective and transparent price management.
- Ministries, agencies and localities shall actively review and identify new growth motives of their branches, domains and localities; focusing on removing difficulties and obstacles, speeding up the progress, ensuring the quality of projects and works under their management authority; paying attention to implementing solutions raised at the Private Economic Forum; piloting the organization of new models and replicating successful models that have been validated in practice.
- The State Bank of Viet Nam shall continue to monitor, evaluate and forecast impacts of the world financial and monetary markets, actively and flexibly administer monetary policy tools to create a solid foundation for the economy to withstand external shocks; continue to promote the restructuring of credit institutions associated with bad debt handling according to the Law amending and supplementing a number of articles of the Law on Credit Institutions, Resolution No. 42/2017/QH14 and Decision No. 1058/QD -TTg dated July 19, 2017; properly fulfil functions of a standing body of the Steering Committee for anti-money laundering in Viet Nam and the focal agency in coordination with relevant ministries and agencies in undertaking a mutual evaluation of the Asia/Pacific Group on Money Laundering (APG) for Viet Nam.
- The Ministry of Finance shall strengthen the state budget restructuring; reserve a part of the excess budget revenues for investment preparation. The Ministry shall report to the Prime Minister arising problems and propose solutions to accelerate equitization and divestment of state-owned enterprises; study and develop a draft Decree substituting Decree No. 16/2015/ND-CP dated February 14, 2015 of the Government in the direction of promulgating a common financial autonomy mechanism at public service units for all fields. The Ministry shall assume the prime responsibility for and coordinate with the Ministry of Agriculture and Rural Development and localities in proposing plans to support pig farmers suffering from African swine fever epidemic, report it to the Prime Minister for consideration and decision-making. The Ministry of Finance shall direct the State Security Commission of Viet Nam to monitor and evaluate the security market, especially indirect investments for better risk control.
- The Ministry of Planning and Investment shall urgently complete a Strategy to attract new-generation FDI, in which attention shall be paid to identifying solutions to enhance linkages and technology transfer between foreign-invested enterprises and domestic enterprises. The Ministry shall urgently report to the Prime Minister to approve the equitization plan of state-own enterprises of the whole country in the 2019-2020, including the equitization plan for Ho Chi Minh City before June 15, 2019. The Ministry of Planning and Investment shall assume the prime responsibility for and coordinate with related ministries and agencies in reporting to the Prime Minister to promulgate of a Directive on the development of a medium-term public investment plan in the 2021-2025 period, coordinate with related departments, ministries, branches and agencies in developing a draft 10-year Strategy on socio-economic development in the 2021-2030 period and a 5-year orientation and tasks on socio-economic development in the 2021-2025 period. These documents will be discussed by the Socio-economic sub-committee at the 13th National Congress of the Communist Party.
- The Ministry of Industry and Trade shall continue to closely monitor, follow, update and comprehensively evaluate impacts of external factors, especially impacts of trade tensions and trade protection trends, timely propose solutions and appropriate scenarios, including solutions to diversify markets, focusing on developing the domestic market, properly organizing wholesale, retail and good supply; take advantage of signed trade agreements, especially the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP); promote the ratification of the Viet Nam - EU Free Trade Agreement (EVFTA); assess multi-dimensional impacts of the plan to increase electricity prices and petrol prices at the request of the National Assembly.
- The Government requested ministries, agencies and localities to promote the effective exploitation of opportunities and advantages from the Industry 4.0; accelerate the construction of e-Government, digital economic model transformation; due attention must be paid to facilitating and supporting, first and for most, to improve legal foundation to encourage enterprises in applying digital technology, transforming digital economy, developing shared economic models and new business models, managing virtual property, virtual money, and electronic payment... In addition, the Government requested ministries, agencies and localities to focus on directing, finalizing and submitting assigned reports in due time, providing explanations on report contents serving the multi-dimension evaluation of the Asia/Pacific Group on Money Laundering (APG) on anti-money laundering and counter-terrorist financing measures of Viet Nam in the 4th quarter of 2019. Ministries of Information and Communications, Planning and Investment, Industry and Trade, Science and Technology were requested to coordinate with each other to identify appropriate solutions to attract investment from top global digital businesses and create favorable conditions for new technology adoption and development of Vietnamese digital businesses.
- The Ministry of Science and Technology shall urgently finalize and report to the Prime Minister to promulgate a Directive on promoting the role and efficiency of the National Foundation for Science and Technology Development at Enterprises to support and promote innovation sprit, inventive innovations and technology transfer at enterprises, groups and corporates, and promulgate a Decision of the Prime Minister on a National Strategy on Intellectual Property.
- The Ministry of Education and Training shall formulate a plan to organize the 2019 national high school examination, ensuring its elaborateness and stringency, preventing the occurrence of negative and fraudulent behaviors in examination; strengthening direction, inspection and supervision at local and grassroots levels. The People s Committees of the provinces and centrally run cities take initiative in taking measures to organize the examination in an absolutely benign manner, taking responsibility before the Party, the State and the people for exam seriousness, honesty and fairness.
- The Committee for Management of State Capital at Enterprises shall coordinate with ministries and agencies to properly fulfil the assigned functions and tasks; promote equitization and divestment according to regulations; improve the management efficiency of state capital at enterprises; continue to apply solutions to handle 12 weak projects creating losses by the Industry and Trade sector.
- The Ministry of Agriculture and Rural Development shall assume the prime responsibility for and coordinate with ministries, agencies and localities in mobilizing socio-political organizations, business communities and people to drastically implement solutions to prevent and control the African swine fever epidemic. And at the same time, the Ministry shall proactively develop and implement plans to develop livestock and poultry production in replacement of the infected ones and formulate a herd repopulation plan whenever possible to ensure sufficient food supply for people s needs and export in the near future.
- The Ministry of Natural Resources and Environment shall assume the prime responsibility for and coordinate with ministries, agencies, localities and mass organizations in promoting communication, raising awareness and changing people s behaviors in environmental protection. Special attention shall be paid to reducing and proceeding to eliminate plastic waste. The Ministry shall assume the prime responsibility for and coordinate with the Ministry of Agriculture and Rural Development, the Ministry of Industry and Trade and concerned ministries and agencies in enhancing the management and strict control over the import, trading, supplying and farming of crawfish; lead and coordinate with the Ministry of Justice in reporting to the Prime Minister before collecting comments of the Government members on the adoption of a specialized mechanism and procedure to shorten processing time for providing compensation and support the relocation and site handover at land acquisition areas in Ho Chi Minh City.
- The Ministry of Transport and the Ministry of Industry and Trade, according to their assigned functions and tasks, shall assume the prime responsibility for studying and formulating a special mechanism to attract social capital for investment in traffic infrastructure construction projects and works as well as projects and works in the energy sector.
- The Government Inspectorate shall urgently report to the Prime Minister the inspection conclusions of the Thu Thiem New Urban Area Project, clarifying the responsibilities and violations of related organizations and individuals, and proposing handling measures in accordance with the law.
- The Ministry of Defense shall direct, closely monitor the situation, proactively formulate plans and promptly respond to new developments, not to stay passive and unprepared in any circumstance, firmly maintain the national sovereignty at the border and islands.
- The Ministry of Public Security shall take the initiative in grasping the situation, deploying measures and plans to protect security and safety of important political events of the country and activities of the Party and the State leaders. The Ministry of Public Security shall continue to utterly ensure safety of the 7th session of the 14th National Assembly and concentrate on implementing measures to prevent and suppress crimes, safeguard political security, social order and safety.
- The Ministry of Foreign Affairs and the Ministry of Industry and Trade shall actively coordinate and work with the competent authorities of the European Union to ratify the Viet Nam-EU Free Trade Agreement (EVFTA) soon. The Ministry of Foreign Affairs shall properly prepare contents for the ASEAN Summit and G20 Summit in June 2019.
- Ministries, agencies and localities, according to their assigned functions, tasks, domains and geographical areas, shall stringently collect inputs of the National Assembly and take drastic measures to handle inadequacies and pressing issues concerned by members of the National Assembly, voters and people such as child and woman abuse, school violence, examination frauds ... Government members shall actively prepare answers and explanations to issues that are currently concerned by the National Assembly, the Viet Nam Fatherland Front, voters and people.
- The Ministry of Information and Communications shall urgently finalize and submit to the Prime Minister to promulgate a Directive to promote the development of Vietnamese technology enterprises; organize the effective implementation of the National Planning on Press Development and Management by 2025 following an approved roadmap; assume the prime responsibility for and coordinate with ministries and agencies in studying and proposing the organization of the Government s briefing on information and communication work in order to provide timely, orthodox and unified information; strengthen the strict control and handling of false information, which could seriously affect personal and/or organization prestige and honor on social networks.
2. Regarding the plan to use the 10% reserves of the capital investment plan by using 70% consular fee for the implementation of investment projects to build Viet Nam s representative missions in foreign countries
The Government agreed to endorse the use of the 10% reserves of the capital investment plan by using 70% consular fee for the implementation of investment projects to build Viet Nam s representative missions in foreign countries proposed by the Ministry of Foreign Affairs. The Ministry of Planning and Investment was assigned to review the allocation plan to use the 10% reserves of the capital investment plan by using 70% consular fee for the implementation of investment projects to build Viet Nam s representative missions in foreign countries proposed by the Ministry of Foreign Affairs (including a list of projects, capital levels and specific explanations), and report to the Prime Minister for consideration and assignment of capital plans according to regulations.
3. Regarding the promulgation progress of detailing regulations; the implementation of Work Programs and tasks assigned by the Government and the Prime Minister to ministries, agencies and localities in the first 5 months of the year
Government requested that:
a) Regarding detailing regulations:
- Ministers of Public Security, National Defense, Industry and Trade, Transport, Finance, Agriculture and Rural Development, Education and Training, and the Government Inspectorate shall urgently complete and submit to the Prime Minister for signing and promulgating detailing regulations before June 15, 2019, resolutely opposing to any postpone to draft regulation submission. The Ministry of Justice and the Government Office shall coordinate with and urge related ministries to speed up the finalization and submission of detailing regulations.
- Ministers and heads of ministerial-level agencies shall promptly direct the review and proposal of a list of legal documents detailing the laws passed by the National Assembly at the 7th session of the 14th National Assembly, and submit it to the Ministry of Justice before June 30, 2019 for synthesis and reporting to the Prime Minister.
- Upon the promulgation of legal documents, ministries and agencies in charge of document formulation must update, arrange and classify them according to regulations in order to enable people and enterprises in searching, accessing and synchronous application.
- The Ministry of Justice shall monitor and synthesize a list of laws and regulations for which the submission of detailing legal documents was postponed by ministries and agencies. This shall be considered as a criterion for performance evaluation of the respective ministries and agencies.
b) Regarding Work Programs:
- Ministries and agencies shall speed up the submission of outstanding projects in their Work Programs in May 2019 before June 15, 2019. At the same time, ministries and agencies were requested to actively implement the Work Programs in June, preventing accumulations of uncompleted tasks.
c) Regarding the situation of performing tasks:
- Ministries, agencies and localities shall regularly review, urge, inspect and take more drastically action in accomplishing the tasks assigned by the Government and the Prime Minister, especially the tasks related to difficulty and obstacle removal in support of business production, growth promotion, institutional improvement, and resolving pressing social issues.
- Ministries having specialized inspection procedures and business conditions that have been reduced and/or simplified must publicize them on the electronic portal of their ministries and agencies, not to give rise to additional business conditions and or specialized inspection requirements for products and goods in accordance with the Government s direction in Resolution No. 162/NQ-CP dated December 31, 2018 and the Prime Minister s direction in Document No. 320/TTg-KSTT dated March 15, 2019.
4. Regarding draft Decrees regulating the organization of specialized agencies under the provincial and district People s Committees
The Ministry of Home Affairs was assigned to collect comments of the Government members, improve draft Decrees and report to the Government. In particular, it was requested to thoroughly uphold decentralization and autonomy of localities in deciding the organization of specialized agencies, arranging the number of deputies based on the framework, criteria and conditions set by the Government’s regulations. The reorganization and rearrangement of agencies must attach with reasonable adjustments to functions and tasks of specialized agencies at provincial and district levels and avoiding to omit state management functions and tasks. The Ministry was requested to study and propose criteria for establishment of Public Administrative Service Centres.
5. Regarding the proposal to build a draft Law amending and supplementing a number of articles of the Law on entry, exit, transit and residence of foreigners in Viet Nam
The Government agreed to approve the proposal to develop a draft Law amending and supplementing a number of articles of the Law on entry, exit, transit and residence of foreigners in Viet Nam. Regarding the progress, the Government requested related ministries and agencies to urgently study, formulate and submit to the National Assembly for consideration and approval of the draft Law at the 8th session of the 14th National Assembly.
The Ministry of Public Security was assigned to assume the prime responsibility for and coordinate with the related ministries and agencies in collecting comments of the Government members, completing the application for developing a draft Law, submitting it to the Ministry of Justice to urgently make a proposal of the Government in accordance with the Law on Promulgation of Legal Documents.
The Minister of Justice was authorized by the Prime Minister to act on behalf of the Government to submit the proposal to develop this draft Law to the National Assembly Standing Committee in June 2019.
6. Regarding the pilot plan to expand autonomy of Ha Noi University of Science and Technology, National Economics University, University of Economics Ho Chi Minh City
The Government agreed to approve that:
- 777 under Clause 3, Article 187 of the Labor Code to encourage people with good political, moral, reputable and higher education managerial qualities and good health to voluntarily uptake duties, participate in the School Council and to be elected as Chairman of the School Council to improve the effectiveness and efficiency of the School Council. The election mechanism of Chairman of the School Council must ensure objectiveness, competitiveness and transparency in identifying the right and qualified people, in which the candidates shall be requested to present an action plan and dialogue with an expanded committee of key officials of the university. The Minister of Education and Training was assigned to report to the Prime Minister before issuing a decision to recognize the Chairman of the School Council for the above cases.
- Foreigners participating in teaching and research at Ha Noi University of Science and Technology, National Economics University and University of Economics Ho Chi Minh City and certified by these universities shall not be required to apply for work permit issuance.
7. Regarding borrowing limits for re-lending and Government guarantee limits in 2019
In principle, the Government agreed to approve the borrowing limits for re-lending and the Government guarantee limits in 2019 proposed by the Ministry of Finance. The Ministry of Finance was assigned to report to the Prime Minister for consideration and signing of the Prime Minister s Decision to implement the public debt repayment plan in 2019, submit to the Prime Minister to issue a decision on the Government guarantee limit in 2019 of the Viet Nam Development Bank after the Prime Minister had issued a decision on credit growth of Viet Nam Development Bank in 2019./.
